*1934 SOFTWARE TENDER—Mr Hartcher to Minister for Fair Trading, and Minister Assisting the Minister for Commerce, representing the Special Minister of State, Minister for Commerce, Minister for Industrial Relations, Assistant Treasurer, and Minister for the Central Coast—

(1) Which computer software company currently provides the NSW Government with software for the collation of electoral results for:

(a) State elections?

(b) local government elections?

(2) Was this service put out to tender by the NSW Government?

(3) If so, when was this service tendered for?

(4) How many companies applied to provide this service in the initial tender process?

(5) What was the accepted tender price?

(6) When does the contract expire?

Answer—

I am advised by the Premier that the answer to the Honourable Member’s question is:

(1) (a) First State Computing (a then NSW Government owned service provider) adapted a system from the Australian Electoral Commission to manage data associated with the NSW Legislative Council (LC) elections. It was first used in 1999 and was further upgraded for the 2003 LC elections to cater for legislative changes and to allow its use in Local Government elections. The State Electoral Office currently has a contract with LogicaCMG for support of this system during the recent Local Government 2004 elections.

(b) The LC system (as described at (a) above) was enhanced to suit the counting of Local Government (LG) elections. The enhanced system managed the recent 2004 LG elections but only for those Councils which had “above the line” voting and where there were three or more to be elected. The remainder of Council elections were processed locally by Returning Officers and their results were recorded into an Excel spreadsheet based system developed by the Office specifically for that purpose.

(2) to (6) The development, enhancement and support of this system was undertaken using State Contracts Control Board contracts. Three tenders were offered. Each tender received responses from two companies. All contracts have expired.

*1936 SCHOOL MAINTENANCE BUDGET—Mr Hartcher to Deputy Premier, Minister for Education and Training, and Minister for Aboriginal Affairs—

(1) What is planned in the maintenance program (for the next 5 years) for schools in the electorate of Gosford?

(2) What is the total maintenance budget (in the Gosford electorate) broken down per school, per year, for:

(a) 2004-05?

(b) 2005-06?

(c) 2006-07?

(d) 2007-08?

(e) 2008-09?

(3) What was the total maintenance budget (in the Gosford electorate) broken down per school, per year, for:

(a) 1999-2000?

(b) 2000-01?

(c) 2001-02?

(d) 2002-03?

(e) 2003-04?

Answer—

With respect to maintenance, the Department of Education and Training allocates funding by contract packages, which is based on school education areas, and not to individual schools. All schools in the Gosford electorate have and will continue to have some work undertaken as a result of this funding.

An indication of the funding and time frame for the inclusion of individual projects in a forward program cannot be provided, as it is not possible to pre-empt the deliberations of the Budget Committee in the formulation of the annual State Budget.

*1937 ACCESS TO REPORT—Mr O'Farrell to Minister for Health—

Given correspondence to Mrs Lyn Tonkin from (i) Dr Stephen Christley, CEO of the Northern Sydney Area Health Service dated 24 June 2002 and (ii) Dr Mark Parish, General Manager of the Hornsby Ku-ring-gai Hospital and Community Health Services dated 17 January 2003 make reference to a report of a “formal review” or “subsequent investigation” of an incident at Hornsby Hospital on 30 April 1998, why is Mrs Tonkin being denied access to the report?

Answer—

I am advised that in accordance with a Health Care Complaints Commission recommendation of conciliation, Northern Sydney Area Health Service (NSAH) has met with Mrs Tonkin on numerous occasions without being able to resolve her concerns despite all parties acting in good faith. The first internal review of the issues was conducted informally and there was no documented outcome that could be provided to Mrs Tonkin.

A second review was conducted in early 2004. Mrs Tonkin was kept fully informed of the investigation process and received a copy of the investigation report.

Northern Sydney Area Health Service has also written to Mrs Tonkin formally apologizing for unresolved issues regarding her care at the time of her admission to Hornsby Ku-ring-gai Hospital in April 1998.

I am advised that Mrs Tonkin still has unresolved concerns and as such NSAHS and Mrs Tonkin have agreed jointly to write to the Health Care Complaints Commission seeking further assistance in resolving matters of continuing concern to Mrs Tonkin.

*1938 FIREARMS REGISTRY—Mr Debnam to Minister for Police—

In relation to Firearms Registry resources as at 6 April 2004:

(1) How many firearms applications have been received by the Firearms Registry?

(2) How many permanent staff are employed and how many casual/part time staff are employed to process the applications?

(3) How many firearms applications have been processed?

(4) Are firearms applications being processed in date received order and, if so, up to what date received have applications been processed?

(5) How many fulltime and casual/part time staff service incoming calls on the firearms registry 1300 362 562 number?

(6) What is the average waiting time for a caller wishing to speak to an operator?

(7) Have callers been advised that the best time to call if they wish to have their call answered by an operator is before 9am Tuesday – Thursday, and if so why?

Answer—

(1) Since when?

(2) The NSW Firearms Registry has been allocated an additional $2.9 million to fund the recruitment of new staff to deal with the workloads they currently face. I am advised that of those positions, NSW Police have advertised all but one. New premises have been identified to accommodate the increase.

(4) See (2).

(5) The average varies from week to week.

(6) Some licensees have been advised to call when the call centre is least busy.

*1939 SENIOR POLICE ALLEGATIONS—Mr Debnam to Minister for Police—

In relation to the allegations against Superintendent Paul Lowe:

(1) Will you detail the nature of the allegations?

(2) Will you explain why the investigation was not made public for over a year?

(3) Will you change the process of investigating serious allegations against senior police officers to ensure transparency and openness?

Answer—

(1) – (3) The Commissioner of Police advises me that former Superintendent Paul Lowe has been dismissed from NSW Police pursuant to S181D of the Police Act 1990. The Police Act 1990 provides for management action to be taken against any police officer who no longer retains the confidence of the Commissioner.

*1943 WEED MITIGATION—Mrs Hopwood to Minister for Infrastructure and Planning, and Minister for Natural Resources, representing the Minister for Transport Services, Minister for the Hunter, and Minister Assisting the Minister for Natural Resources (Forests)—

(1) What is the policy for weed mitigation on rail property?

(2) When will weeds on rail land along the Pacific Highway through the length of the Hornsby electorate be removed?

Answer—

I am advised:

Throughout the metropolitan rail network, the Rail Infrastructure Corporation (RIC) has a range of Regional Vegetation Management Plans in place. These Plans have established guidelines and procedures relating to the control and management of weeds, including:

• the provision of a corridor for the effective operation and maintenance of rail services;

• the control and management of weeds as expected by the community;

• control and manage noxious weeds as required under the Noxious Weeds Act 1993; and

• protect native and non-threatened plant species and communities as required under conservation legislation.

A Vegetation Management Plan is in place for Metro North to manage all vegetation on the railway corridor between North Strathfield and Newcastle and between Waverton and Hornsby. This covers management of trees as well as lower vegetation, weeds, grass and includes revegetation and bush regeneration.

This plan has been presented to all local Councils through which boundaries the rail corridor runs, including Hornsby and Ku-ring-gai. All Councils have expressed support for the Plan.

The Plan includes an annual program for spraying noxious weeds along the corridor and also slashing long grass and other weeds in nominated areas. This work is carried out by the corridor presentation team and contractors.

Slashing is next scheduled along the rail line between Hornsby and Hawkesbury River during May 2004.

The Weed Control Program which includes the spraying and cutting of woody weeds was conducted in March and April and will continue in June 2004.

These works will cost around $80,000.

*1945 WESTCLUB—Mr Pringle to Minister for Health—

In relation to Westclub Social and Recreational Club for mentally ill persons:

Will the Government provide funding to enable Westclub to continue to operate at least at the current level?

Answer—

I am advised that when Westclub tendered for the program to provide particular social and recreational opportunities for people with mental health issues Wentworth Area Health Service (WAHS) clearly stipulated that funding would be made available for a defined period of two years only.

Nevertheless, WAHS has offered to assist Westclub with identifying alternative sources of funding so that it may continue its program. The Area Health Service is also assisting Westclub with $80,000 in funding and contributions in kind; such as the use of a building in Katoomba, payment of electricity accounts, and the use of a bus.

*1946 OYSTER RACKS—Mr J.H. Turner to Minister for Regional Development, Minister for the Illawarra, and Minister for Small Business, representing the Minister for Agriculture and Fisheries—

(1) When is an oyster rack deemed to be derelict?

(2) What, if any, existing use rights are there in relation to oyster racks and when would those existing use rights expire?

(3) Has the Minister or his department received any application from any oyster farmer to change the species of oyster to be grown on any oyster rack in the Port Stephens area, specifically to Pearl Oysters?

(4) If so, how does this conflict with a Commission of Inquiry’s determination and the subsequent then Minister for Planning’s decision not to allow the Pearl Oyster Farm that presently exists in Port Stephens to continue?

Answer—

The Minister for Primary Industries has provided the following response:

(1) NSW Fisheries advises that oyster racks are deemed derelict when they are no longer serviceable for their intended use and on a former lease area that has expired or been surrendered or cancelled.

(2) Existing use rights in relation to oyster leases are as defined under the Environmental Planning and Assessment Act.

(4) A determination regarding a previous development application does not prevent other applications to grow pearls from being considered.

*1947 METHADONE PROGRAMME—Mr Amery to Minister for Health—

(1) How many pharmacies in the electorate of Mount Druitt are approved to dispense methadone to people on a methadone programme?

(2) From how many locations, other than pharmacies, is methadone dispensed in the Mount Druitt Electorate?

(3) How much money is paid to each of the above service providers on a per dose rate, to dispense methadone?

(4) How many persons are currently obtaining methadone in the Mount Druitt electorate?

(5) Is the Department currently considering further applications to dispense methadone in Mount Druitt?

(6) If so, at what locations do these applications relate?

(7) What guidelines exist, that service providers of methadone have to comply with, relating to public amenity and public behaviour of persons attending methadone distribution outlets?

(8) Who audits these guidelines?

Answer—

(1) to (6) Two pharmacies in the Mt Druitt electorate are approved to dose methadone. Currently fifteen patients are obtaining methadone from these pharmacies.

The Department of Health is not currently considering further applications to dispense Methadone in the Mt Druitt electorate.

(7) The Department of Health Circular on the “Establishment of Private Drug Treatment Clinics in NSW that provide Methadone and/or Buprenorphine” requires consideration to be given to the clinic’s impact on the amenity of surrounding businesses and residences.

All licensed drug treatment clinics are required to be accredited. The standards for accreditation include the clinic being responsive to the community it services, and addressing community concerns about the clinic.

All patients on an Opioid Dependence Treatment program in NSW are required to sign a Treatment Agreement which details the client’s responsibilities regarding behaviour, congregation, and not remaining in the area for longer than necessary.

Many community pharmacies dosing patients have an individual agreement with patients that relate to behaviour and amenity. This is in addition to the standard NSW Health Treatment Agreement.

(8) The NSW Department of Health.

*1948 HEAVY VEHICLE TRAFFIC OFFENCES—Mr Armstrong to Minister for Police—

(1) How many trucks have been booked and fined for breaching the law on speed limited vehicles in 1993:

(a) in total?

(b) on the Hume Highway?

(c) on the Newell Highway?

(d) on the Pacific Highway?

(e) on the Federal Highway?

(f) on the Mid-West Highway?

(g) on the Olympic Highway?

(2) How many heavy vehicles have been booked for exceeding speed limits on the highways listed in (1) above in 1993?

(3) How many heavy vehicles have been booked for speeding on New South Wale roads in 1993?

Answer—

(1)-(3) NSW Police has advised me that no traffic infringement records for 1993 are available. Traffic infringement statistics are maintained by the Infringement Processing Bureau. I suggest the Honourable Member direct his question to the Treasurer, within whose portfolio the Bureau resides.

(1) How many jobs will be lost as a result of the Government’s decision to have the Department of Environment and Conservation work more closely with the Department of Planning, Infrastructure and Natural Resources and the new Department of Primary Industry?

(2) What monitoring programs will this decision affect?

(3) How many jobs will be cut from country New South Wales?

(4) How many staff will remain in the Environment Protection Authority?

Answer—

I am advised by the Department of Environment and Conservation that it is currently considering how it will best maintain and improve services in the 2004/2005 budget year. Decisions about individual programs and positions are still being determined.

*1950 DEPARTMENT OF ENVIRONMENT AND CONSERVATION—Mr Richardson to Attorney General, and Minister for the Environment—

Following the cut of $30m in the Department of Environment and Conservation’s budget announced by the Treasurer, which agency or agencies will in future be responsible for:

(a) monitoring water quality in the Murray-Darling system?

(b) monitoring water quality in other river systems in New South Wales?

(c) auditing State Forests’ operations?

Answer—

The Department of Infrastructure Planning and Natural Resources will retain primary responsibility within the NSW Government for monitoring water quality in the Murray Darling basin, as well as other NSW river systems. The Department of Environment and Conservation does not conduct routine water quality monitoring of river systems.

The Department of Environment and Conservation will continue to audit and enforce the provisions of the Integrated Forestry Operations Approvals that relate to water quality and threatened species protection.

*1951 SES AFFILIATIONS—Mr Humpherson to Minister for Police, representing the Minister for Rural Affairs, Minister for Local Government, Minister for Emergency Services, and Minister Assisting the Minister for Natural Resources (Lands)—

(1) Will the Government agree to the formal affiliation of the Volunteer Rescue Association (VRA) and Royal Volunteer Coastal Patrol (RVCP) with the State Emergency Services (SES) if requested?

(2) If such a merger or formal affiliation were to occur would you guarantee minimum funding levels to individual units?

(3) Will you guarantee overall funding being maintained for the VRA, SES and RVCP?

Answer—

(1) While the RVCP is already affiliated with the SES, there are no plans to affiliate the VRA.

(3) All three agencies have been the beneficiaries of significant funding increases under this government.

*1954 PERSONAL PROTECTION EQUIPMENT—Mr Humpherson to Minister for Police representing the Minister for Rural Affairs, Minister for Local Government, Minister for Emergency Services, and Minister Assisting the Minister for Natural Resources (Lands)—

With respect to the Rural Fire Service:

(1) Will you guarantee funding levels will be maintained for personal protection equipment in the 2004-05 budget?

(2) Will you guarantee no cuts to funding for fire tankers?

Answer—

(1) As with many of the items of equipment available to Rural Fire Brigades, the quantity of PPE to be purchased during 2004-05 will be dependent upon the requests received from the districts.

*1955 RURAL FIRE SERVICE VEHICLES—Mr Humpherson to Minister for Police representing the Minister for Rural Affairs, Minister for Local Government, Minister for Emergency Services, and Minister Assisting the Minister for Natural Resources (Lands)—

(1) How many motor vehicles (sedans and station wagons) does the department have?

(2) What is the budget in 2003-04 for these vehicles?

(3) What is expenditure year to date?

Answer—

(1) 173 throughout the State.

(3) $571,000 as at 31 March 2004.

*1956 BICKHAM COAL MINE—Mr Piccoli to Minister for Infrastructure and Planning, and Minister for Natural Resources—

With respect to the proposed Bickham Coal Mine in the Hunter Valley why has the water licence for this project been increased from 16ML to 20ML in light of the fact that there is a moratorium on new water licences across New South Wales?

Answer—

Bickham Coal applied for a number of groundwater licences after I granted development consent for the bulk sampling pit. The applicant sought an annual allocation of 20ML. After assessment and due process, the Department of Infrastructure, Planning and Natural Resources granted the licences for this volume.

These licences are from hard rock aquifers which are not embargoed in this location.

*1958 WATER FINES—Mr Kerr to Minister for Energy and Utilities, Minister for Science and Medical Research, Minister Assisting the Minister for Health (Cancer), and Minister Assisting the Premier on the Arts—

How many fines have Sydney Water patrol officers issued since 1 April 2004 in the following suburbs:

(a) Cronulla?

(b) Gymea Bay?

(c) Kareela?

(d) Caringbah?

(e) Engadine?

(f) Menai?

(g) Woolooware?

(h) Sylvania Waters?

(i) Woronora Heights?

(j) Yarrawarra?

Answer—

Sydney Water issued three infringement notices in the Sutherland Shire between 1 and 30 April 2004.

*1960 LICENSING OF BUILDER—Ms Hodgkinson to Minister for Fair Trading, and Minister Assisting the Minister for Commerce—

(1) Why does the information provided to the public by the Office of Fair Trading under Section 120 of the Home Building Act 1989 for Licence Number 148919C show that the holder of the licence has not been fined and has no prosecutions against him when the same person holding licence number Q11172 is noted as having been fined?

(2) Why was this person, with several outstanding complaints against him, allowed to obtain a new, unblemished licence on 29 May 2003 under a different trading name?

(3) Why has the Office of Fair Trading not acted to resolve this problem despite being informed about this matter in writing by Mr W Gorman of Bowral in June 2003, July 2003 and August 2003?

(4) How many other builders hold multiple licences under these circumstances?

(1) I am advised the holder of Licence Number 148919C, Gavan & Shallala Pty Ltd, has not received a fine nor been the subject of disciplinary action.

(2) Qualified Supervisors Certificate number Q11172 was fined on 24 June 2003.

(3) The Home Building Register contains relevant information including name, date of birth and address of the directors of a corporation, nominated supervisors and disciplinary action.

*1961 CONSUMER TRADER AND TENANCY TRIBUNAL—Ms Hodgkinson to Minister for Fair Trading, and Minister Assisting the Minister for Commerce—

(1) How many complaints has the Department of Fair Trading received about a company(s) trading as either Indent Trading Pty Ltd, Indent, the Tile People Pty Ltd, The Tile People Pty Ltd or The Tile (Coffs Harbour) Pty Ltd?

(2) What has been the basis of these complaints?

Answer—

(1) I am advised that the former Department of Fair Trading received nine complaints relating to the identified companies, during the period December 1993 to December 2000.

(2) The application received by the Tribunal for Indent The Tile People Pty Ltd related to the incorrect measurement of a floor plan, increased product costs to tile the extra area and the use of non-matching tiles. The application received in relating to Indent Trading Pty Ltd related to the supply of chipped, flawed and cracked tiles and the poor laying of tiles.

*1962 HEALTH CARE COMPLAINTS COMMISSION—Ms Hodgkinson to Minister for Health—

(1) How many complaints about the Southern Area Health Service (SAHS) were lodged with the Health Care Complaints Commission during:

(b) 2001?

(c) 2002?

(d) 2003?

(2) How many of these complaints involved the death of a patient, either in a SAHS facility or shortly after being transferred from a SAHS facility?

The Health Care Complaints Commission Annual Report contains information regarding complaints it has received.

1963 BICKHAM COAL MINE—Mr Piccoli to Minister for Mineral Resources—

(1) With respect to the proposed Bickham Coal Mine:

(a) Why did the existing Bickham Community Consultation Committee have to be dissolved?

(b) Why is a special investigation into coal mining in the area being undertaken after the bulk sample has been approved?

(c) Why not have this before approval has been given?

(d) With regard to the special investigation, who is to conduct the investigation, what will it investigate, will it be an open investigation, will public submissions be accepted and when will it report and to whom?

(e) When is the Minister going to visit the site of the proposed mine?

(2) In light of the fact that the bulk sample will be processed at the Rix Creek Colliery to accept coal, does the Rix Creek Colliery have approval to take coal from other coalmines?

(3) Why was the bulk sample assessed under Part 5 rather than under Part 4 of the Environmental Planning and Assessment Act?

(4) When the exploration licence for Bickham Coal Company expired, did the Minister backdate a new one?

(1) What is the status of the Great River Walk Project?

When the new CityRail timetable is introduced, what action will be taken to ensure that all off-peak and weekend services are air-conditioned?

What action has taken place regarding the resolution of Parliament of 13 November 2002, “that this House calls on the Government to immediately implement a review of the formula that determines the staffing levels of country schools”?

(1) Did the Minister for Health set up a steering committee to assess public health options for the Great Lakes region?

1971 REMOVAL OF POSITIONS—Mr Stoner to Minister for Infrastructure and Planning, and Minister for Natural Resources—

In relation to the Government’s plans for reduction of expenditure in the Department of Infrastructure and Planning and Natural Resources:

(1) How many positions are intended to be removed from the Department?
