MINUTES OF THE STANLEY CITY COUNCILMAY 14, 2019Mayor Gary Weisenberger called the May 14, 2019 regular meeting to order at 7:00 P.M. The following Council Members were present: Jacob Hellman, Ty Taylor, Gary Weisenberger, and David Minton. Zachary Gaaskjolen, Linda Wienbar and Tim Holte were absent. Others in attendance were Deputy City Auditor, Ada Arneson; Planning & Zoning Administrator, Amanda Dennis; Chief of Police, Kris Halvorson; Public Works Director, Curtis Larson and City Attorney, Jordon Evert from the Furuseth Olson & Evert P.C. Law Firm. City Auditor, Allyn Sveen was absent.MINUTESMotion made by Taylor, seconded by Hellman, to approve the minutes of the April 9, 2019 regular meeting and April 25, 2019 special meeting. Motion carried.PLANNING & ZONING RECOMMENDATIONSTodd Heidbreder, Chairman of the Planning & Zoning Commission, presented the P&Z Commission report and recommendations to the City Council.Chairman Heidbreder commented on the public hearing held on the application submitted by Opportunity Foundation Inc. for a mobile food permit to serve shaved ice in Wilson Park. The P&Z Commission recommended approving the permit at a pro-rated permit fee with the publication fee remaining the same. Mayor Weisenberger suggested that a set fee of $50.00 for a permit less than six months be used rather than pro-rating by the month. The Council also discussed services such as electricity and garbage that may be used by Opportunity Foundation Inc. at Wilson Park. Motion made by Hellman, seconded by Minton, to approve a mobile food permit to Opportunity Foundation Inc. to allow a mobile stand unit to be located in Wilson Park as recommended by the P&Z Commission with a pro-rated permit fee of $50.00 for the approximate five month season. Motion carried.Chairman Heidbreder mentioned a public hearing has been set for June 10, 2019 to receive comments on the application submitted by Dayne Bruhn Glaholt/Rachel & Tom Lonier for a mobile food permit to allow a mobile ice cream bike to sell individually wrapped ice cream treats throughout the City.Chairman Heidbreder mentioned the P&Z Commission will be reviewing the Zoning Ordinance and will be presenting a few minor revisions, including a seasonal permit fee for a mobile food permit. Motion carried.STANLEY VISITORS’ COMMITTEEGeorge Littlecreek, Chairman of the Visitors’ Committee, met with the Council to present requests for grant funding from the Stanley Visitors’ Promotion Fund. Motion made by Hellman, seconded by Minton, to approve a grant of $5,000 to the Stanley Park District for the Dueling Pianos fundraiser event on October 23, 2019 as recommended by the Visitors’ Committee. Motion made by Hellman, seconded by Minton, to approve a grant of $1,800 to the Stanley Commercial Club for updates and maintenance to the Visit Stanley Website. Motion made by Hellman, seconded by Taylor, to approve a grant of $2,500 to the Sibyl Center for Life Enrichment for entertainment events on June 22, July 4 & 6, 2019. Motion made by Minton, seconded by Hellman, to reappoint George Littlecreek and Brandi Larson to the Stanley City Visitors’ Committee for four year terms ending May 31, 2023. Motion carried.BROSZ ENGINEERING UPDATESEngineer Jeff Ebsch was present to update the Council on projects being handled through Brosz Engineering. Westview Lane – Engineer Ebsch stated Kemper has installed the new lift station pumps, control panel and level monitoring system near Holiday. PW Director Larson is working with Dakota Pump & Control Inc. to work out issues with the new level control sensor (FOGRod). Engineer Ebsch mentioned $5,000 has been withheld from Pay Application 3 for the District 50 Water & Sewer Improvements for the Westview Lane Project. Also, Engineer Ebsch mentioned Bechtold Paving will be onsite the first part of June to complete final grading and paving of Westview Lane.Motion made by Hellman, seconded by Taylor, to approve payment to Farden Construction for Pay Estimate #3 in the amount of $42,750.00 for District #50 Water & Sewer Improvements for the Westview Lane Project. Motion carried.Discussion was held on the approaches accessing agricultural property to the south of Westview Lane. No changes would be made to the approaches as the street is constructed to specifications.Chip Seal – Engineer Ebsch presented the following list of streets to be chip sealed in the 2019 season: Frontier Village and 8th Ave SW; North Frontage Road and Alexis from 8th Avenue SE to 4th Street SW; South Frontage Road from Highway 8 to Cenex; 3rd Street SE from US Highway 2 to South Bypass; 1st Street NW from 4th Street NW to 63rd Street NW and Golf Drive. Motion made by Hellman, seconded by Minton, to advertise for bids for 2019 Chip Seal projects as presented by Engineer Ebsch. ON ROLL CALL VOTE, the following Council Members voted “AYE”: Hellman, Taylor and Minton; and no “NAYS”. Motion carried. Reservoir Road & 1st Avenue SE Shared Use Pathway – Outdoor Heritage Fund Grant Application – Engineer Ebsch mentioned the grant application for a shared use path to Stanley City Pond was submitted to the North Dakota Industrial Commission the end of April. The project consists of reconstructing two blocks of city sidewalk from 1st St SE to 3rd St SE and a pathway along the north side of Reservoir Road from 3rd St SE to the City Pond. The City will be allowed a ten minute presentation before the Outdoor Heritage Advisory Committee on June 7, 2019 in Bismarck. The total estimated project cost is $661,900 with $496,425 of grant funding being requested. If approved the City and in-kind match would need to cover the remaining costs. Stanley Truck Route Maps – Engineer Ebsch mentioned truck route maps have been developed on the City GIS for the permitting system. GAMING SITE AUTHORIZATIONMotion made by Hellman, seconded by Minton, to approve a Gaming Site Authorization to the Veteran’s Club of Kenmare Inc. to conduct games of chance at the Beach Bar for a one year period from 7/1/2019 to 6/30/2020. Motion carried. GAMING PERMITSMotion made by Taylor, seconded by Minton, to approve a Local Permit to the Friends of Mell Family from 5/15/2019 to 6/15/2019 for a raffle. Motion carried. SPECIAL EVENT LIQUOR LICENSEMotion made by Minton, seconded by Hellman, to approve two permits to the Five Spot Bar to sell alcoholic beverages at a special event at the Mountrail County South Complex on June 1, 2019 and on June 22, 2019. Motion carried. APPOINT JDA REPRESENTATIVEMotion made by Hellman, seconded by Taylor, to rescind the motion made on April 9, 2019 appointing Hannah Collins to the Mountrail County Job Development Authority Board as Section 11-11.1-01(2b) specifies the representative must be from the city council. Motion carried.Motion made by Minton, seconded by Taylor, to appoint Linda Wienbar to the Mountrail County Job Development Authority Board for an unexpired term ending December 31, 2019 to represent the City of Stanley. Motion carried. POLICE REPORTChief of Police, Kris Halvorson, mentioned officer(s) will be attending SWAT training in Kenmare and a Desert Snow three day training in Fargo this June. Also, Police Chief Halvorson updated the Council on the outdated driver’s license program and discussed updating the software used by his department. Police Chief Halvorson will look into the different options to update the computer needs for the Police Department including the Zuercher program used by Mountrail County. Police Chief Halvorson also mentioned another body camera was ordered so the officers all have one and issues are being worked out with the body cams being used by officers. Chief Police Halvorson stated he has not received a response from NDDOT authorizing posting of 4’ X 4’ sign for the truck route so will follow up with NDDOT. Also, a six ton sign has been picked up.Motion made by Minton, seconded by Taylor, to approve the Police Report. Motion carried.PUBLIC WORKS REPORTCurtis Larson, Public Works Director, presented the Public Works (PW) Report to the Council. PW Director Larson presented two estimates to tear down the existing building under the old water tower adjacent the County Courthouse and construct a new 16’ X 16’ building. Motion made by Minton, seconded by Hellman, to approve the estimate of Sveen Enterprises Inc. in the amount of $17,785.45 to replace the building under the old water tower. ON ROLL CALL VOTE, the following Council Members voted “AYE”: Hellman, Taylor, and Minton; and no “NAYS”. Motion carried.Motion made by Hellman, seconded by Minton, to approve the purchase of a spill container from Border States in the amount of $1,170.26 for the Public Works shop. Motion carried.PW Director Larson discussed removing the electric pole on Main Street and relocate electrical in the maintenance room in the new City Hall. Motion made by Minton, seconded by Hellman, to approve the estimate in the amount of $6,652.05 from Rudolph Electric LLC to provide electrical services as presented by PW Director Larson. Motion carried.Discussion was held on removing ten (10) dead pine trees on the east side of Pine Tree Rearrangement adjacent Wally Kowitz’s property in Horseshoe Drive. PW Director Larson was asked to determine the location of the trees as to whether the trees are within a dedicated easement or if they are in NDDOT right of way. Also, it was mentioned the responsibility and costs to remove the trees would need to be determined and the Tree Committee may need to be involved in the abatement process.Motion made by Hellman, seconded by Taylor, to approve the purchase of a post hole digger from John Deere in the amount of $3,450. Motion carried.PW Director Larson mentioned Enbridge is donating one of their retired trucks to the City of Stanley. The Council expressed no objections to accept the 2012 Chevrolet Silverado K2500HT LT from Enbridge. Motion made by Minton, seconded by Hellman, to authorize PW Works Director to purchase 65 tree gator bags from Lowe’s at a total cost of $1,300 ($19.99 per bag). Motion carried.PW Director Larson will be getting an estimate to repair the approximate 30’ X 9’ wide section of missing pavement adjacent the Elementary School on 4th Ave SW. PW Director Larson mentioned recycled material will be used to fill this area until it is properly repaired. Motion made by Hellman, seconded by Taylor, to approve the Public Works Report. Motion carried.ATTORNEY UPDATESAttorney Evert commented an executive session may need to be held at the next Council meeting regarding John Rian LLC v. City of Stanley, et. al., Mountrail County Case. PW Director Larson mentioned repairs are necessary in the John Rian Addition. Attorney Evert informed PW Director Larson to document before proceeding and to keep track of costs and hours spent working on repairs. COUNCIL CONCERNSCouncilman Minton thanked the PW Department for doing the curbside garbage pickup.Councilman Hellman asked that the next meeting at the new Scout facility be advertised so the public is aware of the location.
