The 1st prize for the Raffle is a brand new 2020 Chevy Blazer RS. The Rules and Regulations of the Raffle are set forth below. By purchasing a raffle ticket, the purchaser agrees to be bound by these Rules and Regulations. MHRC’s interpretation and application of these Rules and Regulations are final.This offer is void where prohibited by law, and all federal, state, and local laws and regulations apply.The drawing of the winners of the Raffle will be held on November 21, 2020 at the MHRC lot. Tickets will not be sold after November 15, 2020. The drawing will be open to the public. The winners need not be present to win.The chances of winning are based on the number of tickets sold, which is limited to a maximum of 1,500 tickets. By entering this Raffle, entrants accept and agree (1) to be bound by all the rules, limitations and restrictions set forth herein, and (2) that their names and/or likenesses may be disclosed to and used by the news media; and may otherwise be used by MHRC for publicity purposes such as by posting names of winners in the MHRC website; and in lists of prize winners that may be published in area newspapers. By entering this Raffle, each participant releases MHRC, its pastor, vicar, employees and agents from any and all liability for injuries, losses or damages of any kind caused by participating in the raffle or winning any of the prizes, or resulting from acceptance, possession, use or misuse of the prize. The winner agrees to indemnify and hold MHRC harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of participating in the Raffle or the winner’s acceptance or use of any of the prizes.THE RAFFLE PRIZESThe 1st prize for the Raffle is a brand new 2020 Chevy Blazer RS (“Car”). The value of the Car is $50,000, which includes the cost of the Car, financing fees and all local and state taxes and fees that are required to be paid before the ownership/title to the 2020 Chevy Blazer RS can be transferred to the winner, have been fully paid by MHRC to the car dealer. However, the prize winner is responsible for any and all state and federal income taxes related to the Car. MHRC takes no responsibility for any income tax liabilities attributed to the prize. Only one method of payment, one name, and one mailing address are permitted on any ticket. Only one eligible person or entity name will be written on the raffle ticket. If a ticket contains the names of more than one person or entity, MHRC will reject and return the ticket to the purchaser, plus the refund of the amount paid (if any). Such rejected and returned ticket will not be included in the drawing of winners.A ticket can win only one (1) of the seven (7) raffle prizes. No one ticket can win more than one prize.MHRC will reject any entry form that is submitted with a payment that does not constitute “good funds”, which include but are not limited to (1) a payment by credit or debit card rejected by the company or, (2) a payment by check or direct debit not honored by the bank. All defective or physically altered raffle tickets will be immediately disqualified from the raffle drawing by MHRC and will be returned to the purchaser. Prior to the prize drawing, MHRC will make a reasonable effort to notify the individual or entity, using the information provided by the purchaser who submits such a defective entry form or buys a ticket paid from funds deemed not good, of the action taken by MHRC. In no event shall MHRC, its pastor, vicar, employees, agents or representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages.HOW TO PURCHASE THE RAFFLE TICKETSAn individual or entity can purchase as many raffle tickets as he/she/it may wish, subject to availability. Raffle tickets may be purchased through (1) the MHRC website or (2) personally through the MHRC Office with phone #(925) 757- 4020, and (3) at all Sunday masses.To purchase raffle tickets through the MHRC website, visit . Complete and submit the order form provided online. MHRC will then mail the raffle ticket/s to the purchaser. MHRC reserves the right to reject any entry form that is submitted with payment that does not constitute “good funds”, as explained further in Section III. No refunds will be made except under the following circumstances: any ticket order with payment received after November 15, 2020, will be returned. No other refunds are available except in the exclusive discretion of MHRC. MHRC assumes no responsibility for lost, late, misdirected, or any other failure to receive orders or deliver receipts prior to the drawing deadline.ELIGIBILITYAnyone 18 years of age or older at the time of purchasing the raffle ticket/s may participate in the Raffle. The Raffle participant must be a current resident of California.The MHRC pastor, vicar and staff members and immediate family members residing in the same household are excluded from participating in the Raffle and are not eligible to win a prize. MHRC will require the prize winners to submit an affidavit of eligibility.SELECTION OF WINNERS?The prize drawing will be held on November 21, 2020 from all eligible raffle tickets and will be open to the public. The winners need not be present to win. The winners will be notified using the contact information provided to MHRC at the time of the ticket purchase. MHRC will make reasonable attempts to contact/locate the prize winners. Any prize unclaimed by 5:00 pm on December 31, 2020 will be forfeited and another winner will not be selected.In order to collect his/her prize, the prize winner will be required to sign and deliver to MHRC:? (a) a sworn affidavit of eligibility in accordance with these Rules and Regulations, and any applicable laws, including without limitation that he/she is at least 18 years of age at the time he/she purchased the winning raffle ticket, and that he/she is a current resident of California; (b) a completed and signed IRS Form W-9, which is the Request for Taxpayer Identification Number that shows the prize winner’s Social Security Number or the Federal Identification Number; (c) proof of identity in forms satisfactory to MHRC showing that the person claiming the prize is the same person who is named on the winning raffle ticket; and (d) the winning raffle ticket stub. The winners’ names will be posted on the MHRC Raffle website. The winners’ names may also be obtained from the MHRC Office or by sending a self-addressed, stamped envelope to MHRC Raffle, 1313 A Street, Antioch, CA 94509 within one week of the drawing.TAX OBLIGATIONS:?The winner is responsible for paying all appropriate taxes resulting from winning a prize. For any prize valued at $600 or more, MHRC will submit to the IRS Form 1099 or W-2G noting the value of the prize to the winner. The IRS submission will be done on or before December 31, 2020.MHRC makes no guarantee that the IRS will accept that the value of the Car as would be indicated on the W-2G, for the purpose of determining any income tax liability that may be due from the winner. THE WINNING ODDSBased on achieving the targeted maximum ticket sales of 1,500, the odds of winning a prize is 7 out of 1500.?The odds will change depending on the actual number of tickets sold.GENERAL TERMS AND CONDITIONS?The brand new 2020 Chevy Blazer RS will be transferred to the winner “as is, where is, and with all faults”. MHRC does not make or provide any representation, guarantee or warranty, expressed or implied, in connection with the Car and accepts no liability or responsibility regarding the construction or condition of the Car. MHRC does not warrant that the Car is of mercantile quality or that it can be used for any particular purpose.? No express warranties are given and no affirmation of MHRC by words and/or actions will constitute a warranty.?However, the Car warranties (from the dealer and/or manufacturer) existing at the time of the prize drawing, carry over and are transferred to the prize winner.ANY CONTROVERSY OR CLAIM ARISING OUT OF OR RELATING TO THE CONTRACT, OR THE BREACH THEREOF, SHALL BE SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (PURSUANT TO ITS EXPEDITED PROCEDURES) UNDER ITS COMMERCIAL ARBITRATION RULES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. ................
