Leave Options for Federal Employees

on State Active Duty(SAD)

Employees performing SAD are required to take a full day of leave for each day of service. The only exception is when the employee first learns of the need to perform SAD during a workday. In this circumstance, the employee only needs to take leave for the hours absent for work. There is no need to take leave on non-workdays or holidays.

Leave options available: Dual status employees who are required to perform SAD may elect to use annual leave, compensatory time off, time off award, LWOP (KA) or 22 days (176 hours) law enforcement leave (LL).

Leave NOT authorized: Military leave (LM) or LWOP-Military (KG) are not authorized on SAD.

Law Enforcement Leave (LL): Law enforcement leave is a type of military leave that provides employees with 176 hours of leave when they are performing emergency duties, providing other assistance to civil authorities.

• Law enforcement leave is not “double dipping.” Civilian pay will be offset by the SAD pay.

• If an employee uses law enforcement leave, once SAD is completed the employee provides their SAD order and SAD pay voucher to finance. Their SAD pay is compared to their civilian pay to determine the indebtedness.

o If the SAD pay is greater than the civilian pay, then the gross civilian pay is collected.

o If the SAD pay is less than the civilian pay, then the difference between the two is paid to the employee and the remainder is offset and collected in DCPS

Annual leave, compensatory time off or time off award: If an employee uses one or a combination of these leave categories they will retain their civilian pay and SAD pay.
