The original developer planned to complete 18 additional units in 3 more buildings to bring the property to its planned size of 200 units. Since the developer was unsuccessful in completing these units, a Certificate of Amendment was filed in December 2001 dedicating the land described (unbuilt units) to all the owners as common elements. Because Montego Cove is governed and funded by the owners and is registered as an “over 55” community there is much attention paid to observing rules and procedures which will maintain these standards, promote maintenance of property values and the feeling of a shared community which exists today.The potential owner and/or occupant are to understand that purchasing or leasing binds the person to adherence to Rules and Regulations.The potential owner is to understand that the use of Montego Cove facilities is not personally available to the owner during the period of occupancy by a lessee.Is the lease agreement clear as to responsibility for payment of the quarterly maintenance assessment? In order to show a unit listed with realtors the sales staff needs to adhere to these restrictions:No signs are to be posted anywhere on the property.General open houses are not permitted due to limited parking and to security concerns.Broker’s open houses will be permitted only if approved by the Association. As to the age provisions, an owner may qualify after being approved by the Interview Committee if at least one occupant in residence is 55 or older. Should a unit be leased for the minimum time of three (3) months or more, the leasing party must include one occupant 55 or older. While children under 16 are not allowed in permanent residency they are allowed to reside for up to sixty (60) days in a twelve (12) month period so long as occupancies are not consecutive.
