UAE Kimberley Process Policies & Procedures

1. Principles and Purpose

PRINCIPLES:

Under the Kimberley Process Scheme, rough diamond shipments can only be exported and imported between participant member countries of the Kimberley Process. No uncertified shipments of rough diamonds will be permitted to enter or leave a participant’s country.

PURPOSE:

The Kimberley process scheme acts as a ring that fences conflict diamonds and as such ensures they are unable to enter the legitimate diamonds supply chain and therefore, cannot be used to fund wars against legitimate governments. In other words, to identify the origin of the diamonds and not to let conflict diamonds enter the legitimate diamond market.

2. Trading with Rough Diamonds in the UAE

UAE licensed companies, free zones and local establishments, who are involved in jewellery related trade, can freely import and export rough diamonds after registering with the UAE KP Office. 

Individuals who don’t have a trade license in the UAE are only allowed one time to import and export.  The individuals will require to obtain a trade license in the UAE to enable them to trade in rough diamonds on their next import or export in the UAE.

3. UAE KP Membership Process

Upon the implementation of the Kimberley Process in January 2003, the UAE KP Office has implemented a formal membership scheme, to which all importers and exporters, whether companies or individuals must register with UAE KP Office. Note that individuals are only permitted to import or export once on their personal name. If the individual wishes to continue importing or exporting, they must form a company and arrange for that company to become a member of the UAE KP Office membership scheme. 

3.1. Membership Requirements 

All new memberships or renewals are requested to submit the following: 

Stock Declaration (submitted online:). Annual membership Fees of AED 2020 is applicable for all companies. Yearly membership fees is mandatory whether trade activates are under gone for the current or previous years.

Clients who are registered with UAE KP office in 2015 and have not paid membership fees and if they would like to renew their membership in 2016, they are require to pay 2015 an 2016 membership fees to be able to retain their membership with UAE KP.

Clients will be due to pay their membership only after completing 1 years from the submission of their last stocks.

Payment can be accepted by credit card or debit card. Cash, Cheque and bank transfer payment will not be accepted.

Membership fees will be same as for new/ renewal AED-2020.

UAE KP is retaining all KP clients’ names on their website and clients can use it as a reference of being member of UAE KP.

Traders must submit their import/export trade activity report dating from 1st January up to 31 December of every year.

This includes carat weight and USD value of imports, exports, local sales and purchases. 

Please note that Cash payments in respect of the sale and purchase of rough diamonds are not permitted. All sales and purchases of rough diamonds must be routed through official banking channels. Evidence verifying payment by banking methods are to be made available to UAE KP Office on application for certification or otherwise on request.

 Valid trade license copy 

Authorisation letter confirming the name of the staff representative to clear the rough diamond shipment. 

Passport copy of the staff representative authorised to clear the rough diamond shipment

 Authorisation letter towards the Clearing Agent 

Agreement to adhere to the UAE KP Policies and Procedures, including report any instances of attempts or actual import or export of illegitimate rough diamonds 

A signed declaration, which reads as follows:

 “I hereby confirm that the Stocks Declared on this form and the Local Market Transactions are true and can be supported by relevant documentation. I agree to keep for a period of five years daily buying, selling or exporting records listing the names of buying or selling clients, their number and the amount and value of diamonds sold, exported or purchased.”

Acknowledgement to abide by the UAE KP Office policies and procedures.

3.2. Import Procedure

3.2.1. Hand-Carry:

Rough diamond shipment arriving at any airport in the UAE must be declared to Customs Authority at the airport.

Hand-carried rough diamond shipments along with the Original KP Certificates must be submitted to the Customs Authorities at the Airport. The passenger (carrying the rough diamond shipment) will be given a Copy of the ‘Passenger Baggage Receipt by the Customs Authority’. 

The passenger will have to contact the Customs office on +971 4 2183244 and ask them to transfer the goods to the KP Office.

All the documents pertaining to the rough diamond shipment (Original KPC along with the rough diamond, Passenger`s passport, Passenger`s ticket and boarding pass copy) to be submitted to the U.A.E. KP office in order to clear the hand-carried rough diamond shipment. 

3.2.2. Clearing agent:

Original KP certificate along with the rough diamond shipment and the supporting documents should be submitted to the UAE KP office in order to clear the import rough diamond shipment.

3.3. Export Procedure 

3.3.1. Hand-carry: (Passenger/Clearing agent)

The rough diamond shipment along with the supporting documents (Copy of the import KP Certificate, export invoice, Copy of the Bill of Entry, Copy of the passenger’s passport & ticket- in case hand carry) should be submitted to the UAE KP Office at the time of export.

3.3.2 UAE Local Market:

The Kimberley Process Certificate number must be noted on the selling invoice.

A copy of the sale invoice must be faxed to the UAE KP Office on +971 4 2996396 (Dafza) and 04-3751900(Almas)

3.3.4 System Of Warranties

In accordance with the System of Warranties for Diamonds, each invoice must contain the following statement:

“The diamonds herein invoiced have been purchased from legitimate sources not involved in funding conflict and in compliance with United Nations resolutions. The seller hereby guarantees that these diamonds are conflict free, based on personal knowledge and/or written guarantees provided by the supplier of these diamonds."

In accordance with the System of Warranties for Diamonds, each invoice must also contain one of the following statements:

ADDITIONAL NOTES

Part 1: Administrative Decision on the Central African Republic (Temporary Suspension):

The UAE Kimberley Process Office acknowledge the KP Chairs Administrative Decision on the Temporary Suspension of Central African Republic. 

Rough diamond traders in the UAE:

UAE KP Members are hereby informed that any shipments received from Central African Republic will be considered as a violation of the KPCS.
