Effective July 1, 2015, review of applications for a proposed project requiring a County permit on an existing privately-owned, single-family detached dwelling unit or townhouse will only be subject to State Historic Preservation Division (SHPD) review requirements of Hawaii Revised Statutes (HRS) Chapter 6E-42 if the single-family, detached dwelling unit or townhouse is:Listed on the Hawaii and or national register of historic places; orNominated for inclusion on the Hawaii and or national register of historic places; orLocated in a historic district.Act 224 exempts all other projects for renovations or improvements to privately-owned, single-family detached dwelling unit or townhouse that requires a County permit from SHPD review. The intent of Act 224 is to limit SHPD review under Chapter 6E-42 HRS to the projects most likely to affect historic homes. But it does not amend any other section of chapter 6E HRS. In particular, chapter 6E-43 HRS is not affected in any way by Act 224. Accordingly, Counties should submit permits that involve excavation outside of the footprint of privately-owned, single-family detached dwelling unit or townhouses to SHPD for review under existing county policies and guidelines. As Act 224 has direct impact on the type of projects that are submitted to SHPD for review under chapter 6E-42, SHPD staff will be available for education and training during the transition to best ensure timely reviews. In order to better assist the review process, SHPD has posted a list of all privately-owned, single-family detached dwelling units or townhouses currently listed in the Hawaii or National registers of historic places on the SHPD website.
