Copies of any requested information or documents related to your service request may be made in writing at any time and furnished upon request through digital transmission (e-mail). In the event hard copies are required, an additional service fee may be imposed for administrative processing and printing of any archived documents.Service Guarantee – Service on any entity or individual is NOT GUARANTEED. On commencement of your service, S&R Services, though its network of Independent Contractors of Registered Process Servers, will make all diligent efforts at delivering your legal documents to the intended individual or entity. However, in many instances, delivery of your legal documents may not be completed for any number of possible reasons which are detailed in the status reports provided throughout the period your service is active. This includes, but is not limited to, Bad Addresses, Closed or vacant properties and/or Businesses (i.e., no longer in business), Evasion of Services, Exhausted Service Attempts (Maximum Attempts have been made without successfully making contact with the individual, entity or agent for service), etc. On advisement of any concluded service where all attempts have been exhausted and service was not successful, it is the client’s responsibility to provide follow-up advisement or instructions on whether to proceed with another set or “round” of service attempts or to conclude the service request, close out the service and provide a final Due Diligence Report to be filed with the court. In the event another set, or “round” of service is requested, in writing, the client must understand and agree to any additional and/or applicable service fees regardless of the outcome in munication and Instructions – S&R Services welcomes any inquiries or requests for status by telephone communication during its normal hours of operation. However, because of the delicate nature of services S&R Services provides, it is strongly encouraged all clients to provide any follow-up service instructions, information, updates, changes or cancellations in writing via e-mail. S&R Services will not accept or be responsible for any service request information updates, instructions, changes or cancellations by verbal means (i.e., phone calls). Any such communication related to your service must always be in writing . S&R Services will provide, through its systems, continuous status reports via e-mail through to the conclusion of any current or active service request. In the event of an unsuccessful service or delivery of documents to the intended entity or individual where the client has been updated and advised as such through our system status report and there is no follow-up or response provided or communicated within a minimum of one week from the conclusion of an unsuccessful service, the client’s service request will be automatically concluded and closed out. Any pending original documents required as part of your service (“proof of service” or “due diligence”) will be completed and mailed out to the client.Errors and Omissions – S&R Services is not responsible for any errors or omissions of information as provided by the client. The client is fully responsible for providing accurate, current and reliable information as it relates to their service request. S&R Services will use and follow all available information provided by the client towards attempting and completing the requested service through all best efforts. Although S&R Services will examine the service address for accuracy and pricing factors utilizing public information sources (GOOGLE? or BING? Online Maps, for example), S&R Services DOES NOT fully rely in public sources of information and DOES NOT investigate, research or otherwise skip trace any entities or individuals for the general public nor will S&R Services be held responsible for the accuracy or inaccuracy of any information as provided by the client. In the event it is discovered the service information results in a Bad Address, additional service fees are applicable should the client proceed in providing an alternate service address to continue or resume with their current service request.Pre-Payment Requirement – Prior to commencement of any requested services, S&R Services requires pre-payment in full for all requested services by means of CASH, CHECK or CREDIT CARD without exception. By signing the credit card authorization section of the order form or credit card authorization form, the client agrees to all the terms and conditions of service as detailed therein and outlined underneath the signature line. At its sole discretion, S&R SERVICES will collect payment in the full balance for services and/or charge your credit card either on the date the service is executed or concluded. S&R SERVICES will provide all clients with a copy of their charge receipt(s).All Service Charges Are Final – Execution and/or commencement of your service request where all your documents have been furnished to an assigned Registered Process Server(s) constitutes the start of our services and will render all service fees valid and due. All routine service requests, both commercial and residential, are received and processed in the order they are received. All routine service requests are processed within 24-hours from the time the request has been confirmed to the client as having been received. On processing of your service request and assigning the service to a Registered Process Server, the Process Server will have three business days to make the first of five total attempts within a 7-to-10-day period, including weekends when applicable. After the initial or first attempt is made, all subsequent attempts are made within 48-to-72 hours thereafter through the completion of the service or until all five attempts have been exhausted. Status reports are entered as they are received from the Process Server and submitted to the client via the e-mail address provided to S&R SERVICES.24-HOUR RUSH SERVICE – All 24-HOUR Rush service requests are processed and executed the same day they are received. The first or initial attempt is made within 24-hours from the time the service is executed with the subsequent attempts made once daily through the completion of service or until all five attempts have been exhausted. Status reports are entered as they are received from the Process Server and submitted to the client via the e-mail address provided to S&R SERVICES.DO TODAY SERVICE (also referred to as “Same Day” service.) All DO TODAY service requests are processed and executed immediately upon confirmation of receipt. The first or initial attempt is made on the same day the service is immediately assigned to the Process Server. Status reports are entered as they are received from the Process Server and submitted to the client via the e-mail address provided to S&R SERVICES.SERVICE RESTRICTIONS – All ROUTINE service requests received after 4PM on Friday’s will be processed the following business day.All 24-HOUR and DO TODAY serves not received before 3:00 PM (PST) are processed and executed the following business day and may be subject to availability of a Registered Process Server within the specified service area. For example, a Process Server will not disguise himself as a delivery agent (FedEx, UPS, USPS, Amazon, etc.) in order to deceptively gain entry into any facility or property – commercial or residential – as this is both unethical and forbidden by law. Process Servers will also not misrepresent or use deception in communicating the service of process in order to accomplish delivery of any legal documents to its intended recipient(s).S&R SERVICES utilizes a network of REGISTERED and INDEPENDENT PROCESS SERVERS, which are not direct employees of S&R SERVICES. While an appointment serve can be executed for an applicable fee, S&R SERVICES cannot and does not oversee or control the Independent Process Servers’ overall schedule, route, or manor in which service is executed beyond informational or general instructions as well as court required diligence for proper service. With a high volume of work assigned to any individual process server, they are provided with a three-day period within which to make their initial attempt to serve the assigned documents.Q: Why is it more expensive to serve FAMILY LAW and TEMPORARY RESTRAINING ORDERS (TRO)?A: Due to the volatile nature of the documents, these types of serves are regarded as HIGH RISK and can – at times – become difficult to execute.Q: Why are business serves less expensive than residential serves?A: Legal documents being delivered to commercial or business entities/agents are generally less complicated to deliver and can often be completed on the first attempt.Q: When can I expect status of my service request?A: For routine service, status can generally be expected by the fourth or fifth day from the day service is processed and assigned to the server. Servers generally submit status information the day after an attempt is made. This information is entered and submitted to the client via e-mail as it is received from the server.
