O R D E R

The Delhi Medical Council examined a complaint of Shri Ramesh Khattri Nambardar, r/o Ward No.-30, Garhi Bhramanan, Sonepat, Haryana, forwarded by Medical Council of India, against doctors of Saxena Multispecialty Hospital, 112-113, T.P. Scheme, Delhi Road, Sonepat, Haryana and Sir Ganga Ram Hospital, Rajinder Nagar, Delhi.

The Delhi Medical Council observes that since Medical Council of India has referred this complaint to Delhi Medical Council and Haryana State Dental & Medical Council, as the subject mater of complaint also falls with the jurisdiction of Haryana State Dental & Medical Council, the Delhi Medical Council has confined the scope of its inquiry into issue of negligence, if any committed in the treatment of the patient late Smt. Anita at Sir Ganga Ram Hospital.

The Delhi Medical Council perused the complaint, copy of medical records of Sir Ganga Ram Hospital and other documents on record.

The Delhi Medical Council notes that Smt. Anita, 42 years old (referred hereinafter as the patient) is a known case of Fibroid Uterus, underwent post lap hysterectomy on 22nd December, 2010 at Saxena Hospital, Sonepat. The patient developed sudden breathlessness followed by unconsciousness ? cardiac arrest on 23rd December, 2010 for which CPR was given there, intubated and ventilated, received and shifted to Sir Ganga Ram Hospital for

evaluation and further management. The patient was diagnosed to have acute pulmonary thromboembolism, confirmed with 2D echo/ECG; given initial treatment at Sonepat. On admission to Sir Ganga Ram Hospital, the patient was unconscious, had myoclonic jerks, on ventilatory support, on ionotropic support, pupils bilateral dilated and reacting. The patient was put on conservative treatment with heparin infusion, anti-platelets, antibiotics, IV fluids and other supportive treatment. The patient’s 2D ECHO showed dilated RA/RV, severe PAH, mild LV dysfunction suggestive of pulmonary embolism. The patient was further evaluated, CT Pulmonary Angio was done which showed bilateral pulmonary thromboembolism with extension into the lobar and segmental branches. In view of the persistent unconsciousness EEC and MRI brain were done which revealed diffuse anoxic brain injury. Neurologist’s consultation was taken and treatment managed accordingly. About the general condition of the patient, poor prognosis and nature of disease was explained in details to relatives time to time. The patient’s general condition gradually deteriorated and developed LRTI, sepsis, hypernatremia deranged RFT (acute renal failure) and septic shock. On 29th December, 2010 at around 10.40 a.m., the patient had episode of VT/VF followed by cardiac arrest. Adequate CPR measures were given and continued for about one hour, but the patient could not be revived and declared clinically dead at 11.40 a.m. on 29th December, 2010.

In light of the above, the Delhi Medical Council observes that the patient late Smt. Anita was shifted to Sir Ganga Ram Hospital in unconscious stage, intubated and on ventilatory support. A diagnosis of acute pulmonary embolism had already been made at Sonepat Hospital. The patient was investigated and managed in Sir Ganga Ram Hospital according to standard guidelines and norms. The patient died due to her poor general

condition and the nature of the disease. Prima facie, no case of medical negligence is made out in the treatment administered to late Smt. Anita at Sir Ganga Ram Hospital.

Complaint stands disposed.
