C. JUDGMENT HEARING(S):

1. Administrative Hearing - Consider an alleged violation by Ace Plumbing and Heating, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, The Contractors’ Licensing Law, and in particular Section 2158, Paragraph A (9), and consideration of applicable penalties therein. This hearing is being called based on information that there is a judgment which was rendered by the 14th Judicial District Court, 2010-2442, Parish of Calcasieu, State of Louisiana, on the 8th day of September, 2010, in which Mr. Deculus, as the only member and qualifying party for Ace Plumbing and Heating, Inc., holder of Commercial Contractor’s License number 33658, were ordered to “pay in the principal amount of NINE THOUSAND TWO HUNDRED FORTY-FIVE DOLLARS AND 33/100 ($9,245.33) plus attorney’s fees equal to 25% of the principal award, service charges on each invoice at the per annum rate of 18% commencing twenty-five days from the date of the invoice until paid, and all costs of the proceedings in favor of LCR-M Limited Partnership.”

2. Administrative Hearing - Consider an alleged violation by Celebrity Contractors, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called based on information that there is a judgment which was rendered by the 7th Justice of the Peace Court, Parish of Jefferson, State of Louisiana, on the 23rd day of March, 2010, in which Celebrity Contractors, Inc., holder of Commercial Contractor’s License number 40333 was ordered to “pay in the sum of FIVE THOUSAND DOLLARS AND 00/100 ($5,000.00), with 0% percent per annum interest thereon from the 23rd day of March, 2010 until paid and all costs of the suit in favor of Ms. Betty Landix.”

3. Administrative Hearing - Consider an alleged violation by Kings Air & Heat, “LLC” of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called based on information that there is a judgment which was rendered by the 14th Judicial District Court, No. 2010-004212, Parish of Calcasieu, State of Louisiana, on the 30th day of September, 2010, in which William Clayton King and King’s Air & Heat, “LLC”, holder of Commercial Contractor’s License number 51151, were ordered to “pay jointly, severally, and in solido in the principal amount of EIGHT THOUSAND ONE HUNDRED NINETY-SEVEN DOLLARS AND 19/100 ($8,197.19), plus attorney’s fees of $3,000.00, interest on each invoice at the per annum rate of 12% commencing from the thirtieth day of the month following the month of the invoice, and all costs of court in favor of Southern Pipe & Supply Company, Inc.”

4. Administrative Hearing - Consider an alleged violation by Malnar Electric, L.L.C. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called based on information that there is a judgment which was rendered by the 21st Judicial District Court, No. 2010-0000352, Division “H”, Parish of Tangipahoa, State of Louisiana, on the 27th day of September, 2010, in which Malnar Electric, L.L.C., holder of Commercial Contractor’s License number 40429, was ordered to “pay in the principal amount of TWENTY-NINE THOUSAND TWO HUNDRED NINETY-EIGHT DOLLARS AND 81/100 ($29,298.81) plus attorney’s fees of $1,500.00, service charges at the per annum rate of 18% on each invoice commencing thirty days from the date of the associated statement until paid, and all costs of court” in favor of Teche Electric Supply, L.L.C.

5. Administrative Hearing - Consider an alleged violation by Tammany Home Builders, Inc. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called based on information that there is a judgment which was rendered by the 22nd Judicial District Court, No. 2009-16847, Division “I”, Parish of St. Tammany, State of Louisiana, on the 4th day of May, 2010, in which Alberto Casteneda, Jr., Holly Egleson Casteneda, and Tammany Home Builders, Inc., holder of Commercial Contractor’s License number 47338, were ordered to “pay in the principal amount of FIVE THOUSAND SEVENTY-EIGHT DOLLARS AND 08/100, ($5,078.08) plus interest at the per annum rate of 18% on each unpaid invoice commencing from the twenty-fifth day of the month following the month of the invoice, attorney’s fees equal to 35% of the total of principal and interest, and all costs of the court in favor of Jackson Supply Company.”

6. Administrative Hearing - Consider an alleged violation by American Electrical Contractors, LLC of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called based on information that there is a judgment which was rendered by the 19th Judicial District Court, No. 541043, Section 24, Parish of East Baton Rouge, State of Louisiana, on the 12th day of July, 2010, in which American Electrical Contractors, L.L.C., holder of inactive Commercial Contractor’s License number 24005 (which can still be renewed), was ordered to pay in favor Mr. Bob Christian.

D. Compliance Hearing(s):

1. Administrative Hearing – Consider an alleged violation by J. S. Rugg Construction, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief J. S. Rugg Construction, Inc. contracted with multiple unlicensed contractors to perform a scope of work where the labor and materials combined to complete the work exceeded $50,000 on the J. R. Searcy Memorial Library project in West Monroe, Louisiana.

2. Administrative Hearing – Consider an alleged violation by Jerry Myers Construction, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Jerry Myers Construction, Inc. acted as a contractor to perform a scope of work on the J. R. Searcy Memorial Library project in West Monroe, Louisiana, where the cost of labor and materials combined is in an amount in excess of $50,000 without possessing a Louisiana State contractor’s license.

3. Administrative Hearing – Consider an alleged violation by West Monroe Cement Finishers, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, West Monroe Cement Finishers, Inc. acted as a contractor to perform a scope of work on the J. R. Searcy Memorial Library project in West Monroe, Louisiana, where the cost of labor and materials combined is in an amount in excess of $50,000 without possessing a Louisiana State contractor’s license.

4. Administrative Hearing – Consider an alleged violation by LANDRY’S PLUMBING of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Landry's Plumbing acted as a contractor to perform plumbing work at 6602 General Diaz in New Orleans, Louisiana, in the amount of $16,500.00 without possessing a Louisiana State contractor’s license.

5. Administrative Hearing – Consider an alleged violation by Sam Taylor Plumbing Co. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Sam Taylor Plumbing Co. acted as a contractor to perform work on the Community School Addition - Buildings E & F project in Baton Rouge, Louisiana in the amount of $30,000.00 without possessing a Louisiana State contractor’s license.

6. Administrative Hearing – Consider an alleged violation by Kevin Allen Tarver of the provisions of Louisiana R.S. 37:2158 (A,5) of the State of Louisiana Contractors’ Licensing Law, in that Kevin Allen Tarver has permitted the use of Louisiana State Contractor’s license 47550 to be used by another when the other contractor does not hold a license for the classification of work for which the contract is entered, on the Winnsboro Community Center Renovation project located in Winnsboro, Louisiana.

7. Administrative Hearing – Consider an alleged violation by Kevin L. Allen of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Kevin L. Allen acted as a contractor to perform $58,639.00 worth of electrical work on the Winnsboro Community Center Renovation project located in Winnsboro, Louisiana without possessing a Louisiana State contractor’s license.

8. Administrative Hearing – Consider an alleged violation by Ronald Lynn Stinson of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that Ronald Lynn Stinson acted as a contractor to perform $58,639.00 worth of electrical work on the Winnsboro Community Center Renovation project located in Winnsboro, Louisiana without possessing a Louisiana State contractor’s license.

9. This hearing is being called for reason that on information and belief, Kevin L. Allen acted as a contractor to perform $18,500.00 worth of electrical work on the Spivey Law Firm project located in West Monroe, Louisiana without possessing a Louisiana State contractor’s license.

11. Administrative Hearing – Consider an alleged violation by Ronald Lynn Stinson of the provisions of Louisiana R. 13. Administrative Hearing – Consider an alleged violation by Kevin L. Allen of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Kevin L. Allen acted as a contractor to perform $130,000.00 worth of electrical work on the Ouachita Parish Junior High Renovations project located in Monroe, Louisiana without possessing a Louisiana State contractor’s license.

14. Administrative Hearing – Consider an alleged violation by Ronald Lynn Stinson of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Ronald Lynn Stinson acted as a contractor to perform $130,000.00 worth of electrical work on the Ouachita Parish Junior High Renovations project located in Monroe, Louisiana without possessing a Louisiana State contractor’s license.

2. Administrative Hearing – Consider an alleged violation by JLB, LLC of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. F. REQUEST FOR RECONSIDERATION OF PENALTY:

1. Request for Reconsideration of Penalty – On December 16, 2010, the Commercial Board considered a violation by Alberes Contractors, LLC of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Alberes Contractors, LLC, acted as a contractor to perform work on the Taiko Japanese Restaurant project in Baton Rouge, Louisiana in an amount in excess of $50,000 without possessing a Louisiana State contractor’s license.

Decision & Civil Penalty Assessed at the December 16, 2010 Commercial Board Meeting: A MOTION was made by Mr. Clouatre and seconded by Mr. Stuart to accept the Guilty plea of ALBERES CONTRACTORS, LLC. The Motion passed. A MOTION was made by Mr. Weston and seconded by Mr. Clouatre to assess ALBERES CONTRACTORS, LLC a fine of $10,000.00 plus Administrative Fees associated with these proceedings. The Motion passed.
