Members of the Arizona Acupuncture Board of Examiners met at 1:00 p.m. on Wednesday, August 26, 2015, at 1400 West Washington, Conference Room B-1, Phoenix, Arizona.

Complaints/Investigations
Complaint #2015-02—John Tesi
The Board reviewed the response provided by Mr. John Tesi regarding the allegation that he practicing acupuncture without a state license. Mr. Tesi states he has made an effort to have advertisements removed from the web that show Mr. Tesi as an acupuncturist.
Board Member Sandoval shared her efforts on how Mr. Tesi could make a better effort in removing his name from a number of websites. The Board asked staff to contact Mr. Tesi and provide him with this information to resolve this issue.
No action was taken on this agenda item.

Overview of the State of Arizona Open Meeting Law (Board Member Training)
The Board was provided a thorough overview of the State of Arizona open meeting law by Assistant Attorney Seth T. Hargraves as part of board member training requirements.
The training also included information on the posting of board meeting agenda, executive sessions, public access to meetings and call to the public requirements.
Board members had a number of questions on the topic of quorum, conflicts of interest, and executive sessions.
Update on Dry Needling Rules as adopted by the Arizona Physical Therapy Board. (Information Only)
Theresa Ulmer, representing the Aarons Company, provided the Board with an update on the dry needling rules as adopted. Discussions with legislators are continuing to make sure they are keep apprised of the dry needling rules as they directed the Arizona Physical Therapy Board.
The Board is still concerned the general public will not have access to information on whether a physical therapist, providing dry needling treatments, has complied with the new dry needling rules.
Review and discussion to replace and upgrade current office software system as presented by GL Solutions. (Information Only)
Executive Director Gonzalez shared the proposal as prepared by GL Solutions which is a tool for a regulatory board. The Arizona Board of Chiropractic Examiners, Arizona Medical Board, and the Arizona State Board of Dental Examiners are already using some version of the product.
This product can customize web-based regulatory software and provides:
--comprehensive tracking of applications, licensees, compliance and case management activities
--online applications, renewals and verifications
--paperless office operation, document management and storage of electronic records and files
--automation of correspondence, letters, notices and reports
--an “all-in-one” database system hosed in a secure, state of the art Tier III data center.
The Board has a number of questions regarding this proposal, but the most important concern was the cost of the program. The proposal calls for a $2,000/month fee. The Board would like to find out what the board current costs are versus the proposed fees will determine if the Board should proceed with this proposal.
Review of draft 5 year review report. (Information Only)
The Board reviewed the draft of the Board’s 5 year review report as required by the Governor’s Regulatory Review Council. This report will be submitted after this review.

Board Office Information/Activities:
▪ Pursuant to Arizona Revised Statutes §32-3925 (B), license and certificate renewal notices for October 2015 licensees were prepared and sent. In addition, expired license and certificate letters for the month of July 2015 were sent.
▪ Completed and submitted the 2015, Quarter 2, Lobbyist Expenditure Report to the Secretary of State’s office.
▪ Completed and submitted General Survey and Checklist to the General Accounting Office (GAO). This is part of the State’s Comprehensive Annual Financial Report (CAFR). The CAFR provides information to the bond rating agencies to determine the State’s credit ratings.
▪ Completed and submitted the Capital Leases and Installment Purchases report to the GAO. This report is also part of the CAFR.
▪ Completed and submitted the annual procurement compliance Risk Assessment for the State Procurement Office (SPO) and the Arizona State Auditor General’s Office.
▪ Met with Katie Simmons, budget analyst with the Governor’s Office of Strategic Planning and Budgeting, to discuss the Board’s budget for fiscal year 2017.
▪ Completed the annual survey for the Arizona Legislative Council regarding their services to state agencies and boards.
▪ Completed and submitted annual Certificate of $10,000 Limited Delegated Procurement Authority to the Arizona Department of Administration.
▪ Participated in presentation by GL Solutions on technology options for regulatory boards.
▪ Submitted and received approval from the Governor’s Office on July 30, 2015 to move forward with rulemaking regarding fingerprint requirement of license applicants beginning July 1, 2016.
▪ Letters to auricular acupuncturist supervisors sent on annual review of oversight procedures.

▪ The Governor’s Regulatory Review Council (GRRC) has approved the request for extension of time to submit the Five-Year Review Report.
