Rules and Regulations

It is the intent and purpose of Barcroft Management Company, (“Barcroft” or “Management”) to operate Barcroft Apartments (the “Community”) as an outstanding apartment development. To this end we shall strive, at all times to render prompt and efficient service and to maintain the property in the best possible condition.

The following rules effective April 1, 2017 have been prescribed, in a sincere effort, to promote the comfort and security of all. We, therefore, respectfully request the whole-hearted cooperation of each resident.

MAINTENANCE SERVICE:

Regular Maintenance Service is available between the hours of 8:00 a.m. and 4:00 p.m., Monday through Friday. Emergency Service only is available after these hours. Regular service may be obtained by dialing (703) 521-3000, an early call will, in most cases, assure prompt repairs. In the event of an emergency after the hours specified, dial (703) 521-3000 to reach the emergency maintenance engineer. Listen to the prompts then press #4. Only such repairs as are deemed by Management to be of an emergency nature will be handled other than between 8:00 a.m. and 4:00 p.m. Monday through Friday.

Tenant will give Landlord immediate notice of water or gas leaks and will promptly report defects or breakage to any of the structure, equipment, appliances or fixtures in or about the demised premises.

Tenant will not make any alterations or additions to the structure, equipment or fixtures of the demised premises or do any redecorating or repainting without the prior written consent of Landlord.

After the initial delivery of the leased premises by Landlord to Tenant, Tenant shall be responsible to furnish replacements for all lightbulbs except fluorescent lights, and for the replacement of any batteries in any smoke detectors within the leased premises. Landlord will provide the Tenant with not more than two (2) replacement batteries for the smoke detector per year. Please contact the maintenance department immediately to change the batteries if the smoke detector begins to make a chirping noise.

RENT PAYMENTS:

Rent payments may be left in our drop box after office hours. NO CASH is accepted at the office. Please use check or money order. Please note on payment all pertinent information, such as name of Tenant, address, Barcroft account number, and phone number, in order for us to correctly credit your rent account. Rent is due on the first (1st) of every month and must be paid by the fifth (5th).

It is our policy to apply payments received to the oldest charges first. Balances remaining from the previous month including but not limited to rent, late fees, returned check fees, legal fees, lock change fees, lock out charges and duplicate key charges will be cleared up first before the payment will be applied to the current month’s rent.

LATE CHARGES:

Rents are due on the first day of each month. A late charge will be assessed on all outstanding balances including rents, miscellaneous charges and previous unpaid late fees received after the fifth (5th) day of each month. No such late charge shall exceed the lesser of 10% of the monthly rent or 10% of the remaining balance due and owed by Tenant. Any previous unpaid charges will be deducted from the next payment received from the Tenant before such payment is applied to any current month’s rent or miscellaneous charge balances. Under Virginia Code A separate late charge will be assessed on outstanding garage rental fees and storage room rental fees. The late charges are as follows:

$50.00 from the 6th to the 20th of the month

Additional $50.00 from the 20th of each month

MISCELLANEOUS CHARGES:

Tenant will be charged additional fees for each service listed below. Once incurred, these charges will be deducted from the next payment received from the Tenant before the payment is applied to any outstanding rent balance.

$325.00 Administrative Collection Fee

$ 50.00 Front door lock change.

$ 50.00 Security Chain Lock.

$ 50.00 Mailbox lock change.

$ 25.00 Return check fee.

$ 25.00 Lock out charge after office hours payable to maintenance person at time of lockout.

$ 5.00 Per each additional house key and/or laundry room key requested.

TRANSFER FEES:

If any tenant wishes to transfer from one apartment to another within the Barcroft Community within the first three years of occupancy, Landlord shall impose a one-time nonrefundable fee. Landlord will inspect the apartment currently occupied by the Tenant prior to granting any transfer requests. Landlord reserves the right to refuse any transfer to any Tenant for any reason. The transfer fees are as follows:

First year of occupancy $1,000.00

Second year of occupancy $ 500.00

Third year of occupancy $ 300.00

After 3 years No Fee

NOTICE FEES:

In the event Tenant does not pay the rent owed on the leased premises by the fifth (5th) day of the month and Landlord is forced to issue a legal notice to the Tenant, Tenant will be charged an admistrative/court cost fee(s). Some fee(s) will be determined by the judge overseeing the court case in addition to the Administrative Collection Fee. This fee(s) will be deducted from the next rent payment received from the Tenant.

EXTERMINATING PROCEDURES:

The exterminator is in the community on a weekly basis. If you are experiencing a pest problem in your unit contact the rental office immediately. When requesting an exterminator, Tenant must sign a release form. Each Tenant requesting exterminating services is expected to comply with all the pre-exterminating procedures as outlined in the extermination release form. Please call the office at (703) 521-3000 or come by for details. You can visit our website at to obtain the exterminator request form that would be needed. Submit the completed form to the rental office to be added to the rotation schedule.

Be advised that a $250.00 fee will be incurred by those who do not report any pest infestations during tenancy up to the time Tenant vacates the premises.

QUIET HOURS:

Noise should not be heard outside your apartment between the hours of 11:00 pm - 7:00 am.

TRASH & GARBAGE:

Dumpsters and recycling stations are located throughout the community and can be used by Tenants. Dumpsters should be used for the removal of regular household garbage. Recycling guidelines should be followed when depositing items in the recycling container. Refer to the recycling guidelines provided to you in your move in packet. We require that all trash and garbage be stored in plastic bags and tied securely. Any hazardous materials (hypodermic needles, etc.) must be property packaged for disposal. Under no circumstances may trash or garbage be placed in the hallways, common ground areas, laundry rooms, parking lots, or any other place within the community other than the dumpsters. DO NOT place bags of garbage beside the dumpsters. Please be advised that a $100.00 fee will be charged to all violators. There is no exception to this rule.

NOISE:

Residents are entitled to peace and quiet within their apartment. Excessive noise such as a loud TV or music is discouraged at any time of the day or night. If you are experiencing a noise issue and you are able to identify where the noise is coming from, you may notify the offender of the problem. If direct communication is not possible, or you are uncomfortable with the situation you may contact the rental office with your concern. If your noise issue is outside normal business hours, you may contact Arlington County Police at the police non-emergency number at (703) 558-2222.

ENTRANCES, WALKS AND LAWNS:

Adults and children are requested not to make a practice of congregating around, or sitting on the front and rear entrance steps. Children are not permitted to play around the entrances nor in the hallways and corridors.

The storage of baby carriages, play pens, bicycles, sleds and the like, in the hallways or upon the walks and lawns is positively prohibited, and the Management reserves the right to remove and discard any such articles found in or upon these spaces.

Kindly use the concrete walks provided, so that creating unsightly paths around building corners may be avoided. Lawn chairs are permissible, provided they are taken in at night and moved from time to time to avoid damage to the lawns.

Immediately adjacent to Barcroft (South George Mason Drive and South Four Mile Run Drive) are two shaded picnic areas available to those desiring a cookout. The use of charcoal grills and other cookout apparatus is not permitted within the Barcroft development.

GARAGES:

Garage doors must be kept closed at all times. In consideration of other garage Tenants, and for the sake of uniformity and appearance, occupants failing to keep the doors closed will be asked to vacate their garage. We accept no responsibility whatsoever for the care or custody of automobiles or other articles stored in the garages. Flammable materials may not be stored in these spaces. Should an employee of Barcroft take part in storing, parking, handling or moving of any vehicle into or from any garage, then such employee is the agent of the owner of the vehicle, and no responsibility whatsoever will be accepted by the Management. No vehicle repairs or other businesses are permitted in garages or parking areas.

LAUNDRY FACILITIES:

Laundry rooms are located throughout the community for the convenience of residents who are intended to have the exclusive use of the facilities provided therein. The washing machines and dryers are operated by paying the meter charges established for their use. They may be used between the hours of 7:30 a.m. and 10:00 p.m. daily. All laundry rooms will be locked and all electrical power will be turned off between the hours of 10:00 p.m. and 7:30 a.m. Please make sure all laundry is removed from the machines by 10:00 p.m. nightly. Maintenance Service (washer and dryers) is provided between the hours of 8:00 a.m. and 4:00 p.m. Monday through Friday only. Use of the machines will be at the risk of the operator. Management accepts no responsibility for lost or damaged items.

• Individual lines and drying racks are not permitted within the community.

• These rooms have been set-aside as laundries and may be used only for that purpose.

• Children are not allowed to play in these rooms.

• These rooms are locked for your protection and the Management insists that they remain locked at all times.

• Keys to the laundry rooms are available at the Leasing Office (for a charge).

• Management reserves the right to prohibit the use of the laundry room to any individual failing to comply with the normal procedures and or posted rules.

ELECTRICAL AND MECHANICAL EQUIPMENT:

The installation and operation of privately owned dishwashers, washing machines or dryers within the apartments, or in the laundry rooms, is strictly prohibited. Violators will be required to remove the machines immediately. Air conditioners and other electrical appliances are installed at the risk of the owner of said appliances, and the Management assumes no responsibility whatsoever in the event of insufficient electric power to operate them. The usual household appliances, including window exhaust fans may be operated without approval. Tenant will not install nor permit or allow anyone to install any antennas or dish type receivers on the roof, in the attic, in the windows or upon the exterior of said premises. Ceiling fans are not to be installed in the premises.

AIR CONDITIONER CHARGES:

One air conditioner not to exceed 7.5 amps in addition to one provided through Barcroft Management may be installed by the Tenant with written permission from the Management. Regulations relative to the specifications, the electrical charge, installation and operation of these machines must be strictly observed. Failure to comply will result in a request from the Office to remove said machines. Tenant will be charged a one time electrical fee per season for such air conditioner. The air conditioning season runs from June 1 to September 30 of each year. The current air conditioning electrical fee is as follows:

$250.00 per season effective January 1, 2007.

The Tenant will be billed accordingly during the season. Payment is due upon receipt of the bill. Tenant is responsible for removing any air conditioning unit, which is not in use from the window, otherwise full payment will be due regardless of how often or little the unit is used during the season. Barcroft is not responsible for removing, installing or repairing a Tenant’s air conditioning unit.

UTILITIES (Columbia Pike Residents only):

Tenant shall pay for the following utilities: electricity, cable, and telephone. During the months of cold weather, Tenant will see that the electricity is not turned off and the thermostat not be set lower than 50 degrees Fahrenheit. Tenant shall take any of the necessary steps to prevent bursting of water pipes serving the apartment. Tenant shall be liable for any and all damage caused by failure to take such reasonable precautions, including damage to personal property of others. Tenant must keep utilities (electricity) turned on throughout the term of the Lease to maintain appliances in operating order and provide heat in cold months. During vacations, DO NOT TURN OFF POWER, power affects refrigerator – food spoilage, heat & water pipes. Any damages from utilities being turned off until Landlord gains possession shall be paid by Tenant. If Tenant chooses not to live in the apartment at any time during the term of the Lease, Tenant is still responsible for his/her portion of the utility.

POWER FAILURE:

In the event of a power failure Tenant(s) shall check the circuit breaker inside the Apartment before contacting Dominion Virginia Power @ 1-866-DOM-HELP (1-866-366-4357).

PARKING:

Tenant will not park any boats, trailers, R.V.’s, buses or commercial vehicles of any kind on the parking areas of the demised premises without the prior written consent of Landlord. In addition, Tenant shall not park any vehicles on the parking areas of the demised premises that are not operative and duly licensed to operate on the highways of the Commonwealth of Virginia. It is expressly understood and agreed that any car or any other vehicle left in the parking lots of the demised premises with expired tags or a Virginia Inspection Sticker, which is not current, may be towed away at the owner’s expense. Also, any vehicle that is not parked in a marked parking space will be subject to being towed. In consideration of other Tenants, please do not park inoperative or infrequently used vehicles in the parking spaces located near entranceways.

Residents and guests may, at their own risk, park their cars on the streets or in the various parking areas of the Community if permits are displayed. Residents who DO NOT have a parking permit displayed in their vehicles after 11pm daily will be subject to being towed. Residents are encouraged to register their vehicle at the time they move in. Entrances, crosswalks, driveways and garages must not be obstructed. Any automobile parked in violation of the parking rules established will be reported to the police department or towed away at the owner’s expense. For additional requirements concerning parking, see Parking Rules and Regulations form.

Do not park on the lawns and walkways for any reason as damage to the grass, turf, or walkway could occur. Moving is no exception. Anyone observed parking on the lawns or walkways will be charged for the resulting damages.

Trucks may not park on any of the streets more than four (4) hours, (Arlington County Motor Vehicle Ordinance, Section 65) and likewise may not park on privately owned streets and parking areas for periods of excess of four (4) hours.

SNOW EMERGENCY:

During winter months, snow will be plowed from the parking lots. Common area walks will be shoveled and sanded when necessary. After a heavy snowfall, it is our goal is to have all main entrance sidewalks shoveled within 24 hours. Secondary sidewalks will be shoveled on an as needed basis.

In the case of townhouse style apartment, each resident will be responsible for shoveling snow and ice from their door to the main sidewalk.

WASHING AND REPAIR OF VEHICLES:

Tenant shall not be permitted to make car repairs of any kind on the common areas of the leased premises nor shall Tenant be permitted to wash any motor vehicle or use water for washing any motor vehicle on the common areas serving the leased premises.

PETS:

Tenants may have not more than two (2) cats in each apartment provided the cat is litter box trained. Dogs are positively not permitted within the community. There will be no exceptions to this rule and the Management will take prompt action against anyone in violation thereof, including all legal remedies available.

SMOKE DETECTOR BATTERIES:

Landlord will provide the Tenant with not more than two (2) replacement batteries for the smoke detector per year. Please contact the maintenance department immediately to change the batteries if the smoke detector begins to make a chirping noise. If during routine service calls or at any other time, Landlord notices dead batteries in a smoke detector, there will be a charge of $10.00 for a replacement.

CARE OF FLOORS:

RESILIENT TILE FLOORS:

DO NOT use oil base waxes on resilient tile floors. The use of such waxes is harmful to resilient tile floors and may result in a damage for which Tenant shall be charged. Any water based liquid wax such as Bruce, Aero, Old English or Johnson’s is highly recommended.

WOOD FLOORS:

DO NOT use water base, silicone base, or liquid waxes on wood floors. Wooden floors are likewise susceptible to damage resulting from use of improper waxes. The aforementioned varieties (Bruce, Johnson, etc.) in paste form only are recommended. Wood floors are best maintained with a damp mop.

CARPETING:

Unless carpeting is installed by Landlord, Tenant shall install rugs or carpeting covering not less than 50% of the floor area of the demised premises in order to eliminate noise caused or occasioned by the walking on uncarpeted floors. Tenant will be charged for excessive stains and/or damage beyond reasonable wear and tear to carpets furnished by Landlord.

MOVING DAMAGE:

The Resident(s) will be responsible for all damage done as a direct or proximate result of the Resident(s) moving into or out of his/her apartment unit. This liability will extend not only to the apartment unit itself, but also to any damage done to any external or exterior portions of the apartment community.

NEWSPAPER & PARCELS:

Newspapers and small parcels may be delivered, at the Tenant’s own risk, to the front door of each apartment. These articles may not, however, be left in the hallways overnight. The personnel at the rental office will not sign for any packages.

MAIL DELIVERY:

The Postman delivers mail directly to the mail box assigned to each apartment. These boxes are located just inside the front door of every entrance. The official post office address of the Barcroft Apartments is 1130 South George Mason Drive Arlington, Virginia 22204.

NIGHT CHAINS:

Night chains are permissible if furnished and installed by our maintenance department and not removed upon vacancy. A reasonable fee is charged for the lock and installation (see Miscellaneous Charges). Residents are not permitted to install private locks of any kind or to change the lock provided by the Landlord.

ADMITTANCE:

Lessee should provide written authorization to Management if he or she wishes admittance to the apartment to be allowed to any person not named on the lease.

WINDOW BOXES, WINDOW AWNINGS, DUSTING:

Window boxes, potted plants and similar articles are not permitted on the exterior sills of windows. Awnings are not provided for the windows and are not, under any circumstances, to be installed. All drapes or curtains visible from the exterior of the demised premises shall be lined with a material which is either off-white or beige in color.

The shaking of dust mops, rugs, etc., out of the windows and doors is not permitted. Clothing, bedspreads, etc., may not be hung out of windows or doors, or upon the lawns, railings, etc.

FIXTURES AND GARBAGE DISPOSALS:

Water closets (toilets) and other water and sewer apparatus and fixtures shall not be used for any purpose other than the purpose for which they are designed. No sweepings, matches, rugs, sanitary napkins, disposable diapers, or other improper articles shall be thrown in the toilet or sink. The cost of repairing damage resulting from misuse of any of the apparatus and fixtures shall be borne by the Tenant.

Garbage disposals located in each apartment should be used properly. Do not grind bones, shells of any kind, grease, rice, extremely fibrous materials, citrus or banana peels, melon rinds, coffee grounds or popcorn kernels in garbage disposal. Please use a strong flow of cold water when operating the disposal. Never put nonfood items in the garbage disposal. If it is determined that continuous (more than three times in six months) misuse of the garbage disposal by Tenant is causing clogged sinks or damaged garbage disposals, management will charge Tenant a fee of $50.00 for each repair. In the event that Tenant damages the garbage disposal beyond repair, Tenant will be charged $100.00 for the replacement of the garbage disposal.

PERSONAL PROPERTY:

Any personal property left in an apartment after lease termination will be considered abandoned property. Landlord will dispose of such property without liability of any kind to Landlord. A drayage fee will be incurred for removal of items left in the apartment.

KEYS:

Failure to turn in keys upon move out will result in a fifteen (15) day rental charge and a $50.00 lost key charge. It is the tenant’s responsibility to contact the rental office to ensure that keys were received upon move out.

STORAGE ROOMS (CAGES):

These facilities are to be used as a private storeroom to store excess belongings. No hazardous materials are allowed. Landlord accepts no responsibility for lost or damaged items stored in these areas.
