RESOLUTION

WHEREAS, on or about October 31, 2020, Karla Linarez, (hereinafter sometimes referred to as the “Applicant”) filed an application (Calendar No. 04-20-DRC) with the Community Design Commission, sitting as a Design Review Commission, for the Village of Oak Park, seeking a sign variance from Section 7-7-15 (D) (1) (a) of the Village of Oak Park Sign Code, to permit installation of one (1) wall sign (Tacos ’76) on the east elevation of the newly constructed mixed-use building where there is no street frontage at the premises commonly known as 838 Madison Street, Oak Park, IL, (hereinafter sometimes referred to as the “Subject Property”) Property Index Number 16-07-326-021-0000 in the MS Madison Street Sign Overlay District

WHEREAS, notice of a public hearing was published in the Wednesday Journal on the 4th day of November, 2020, a newspaper of general circulation in the Village of Oak Park; and

WHEREAS, on November 25, 2020, the public hearing was held as scheduled at 6:00 pm remotely with live audio available and optional video. The meeting was streamed live and archived online for on-demand viewing at oak-park.us/commissiontv as well as cablecast on VOP-TV, which is available to Comcast subscribers on channel 6 and ATT U-Verse subscribers on channel 99.

WHEREAS, this Design Review Commission of the Village of Oak Park, having fully considered the testimony of those present during the hearing who wished to testify and being fully advised in the premises, does hereby find the evidence establishes the following:

1. That the Subject Property is located at 838 Madison Street on the north side of Madison Street between Kenilworth Avenue to the west and Grove Avenue to the east.

2. That the Premises is improved with a two-story mixed-use building currently under construction featuring two (2) commercial spaces planned for the ground floor and three (3) apartments planned for the second floor. There would be 3,554 square feet of commercial space and 3,150 square feet of residential space. The eastern portion of the ground floor will be devoted to a restaurant use.

3. That the Applicant proposes to install a sign (TACO ’76) on the east elevation of the building to advertise said restaurant.

4. The Subject Property is located in the Corridor Commercial Sign Overlay District. The purpose of this Sign Overlay District is to ensure that signs located along major arterials provide an effective means of identifying their premises and the goods and/or services sold on the premises, as well as presenting a positive and coordinated appearance along the roadway. Signs within the corridor commercial areas are to be primarily oriented toward the automobile.

5. That the Applicant is requesting a variance from the Sign Code of the Village of Oak Park to permit the installation of a wall sign located on the east elevation of the building where there is no street frontage.

6. That Staff is not opposed to the variance request since the proposed signage along Madison Street will have reduced visibility for eastbound traffic due to the required placement of the building three (3’) feet from the lot line which is behind all the other buildings on the block to the west.

7. That the Applicant’s plans are substantially consistent with the design criteria of this Sign Code. The evidence indicated that the wall sign has good scale and proportion in its design and in its visual relationship to the façade of the building, and is not distracting or hazardous to vehicular and pedestrian traffic.

8. That the Applicant’s proposed exterior design features of the sign is suitable and compatible with the character of neighboring buildings and structures existing or under construction and with the applicable zoning district, and enhance the environment of the Village. The evidence indicated that the wall sign will be located adjacent to a parking lot and would be appropriate and compatible with the character of neighboring buildings and effectively displayed on the side of the building to identify the restaurant.

9. That the Applicant’s exterior design features of the wall sign will not be detrimental to the harmonious and orderly growth of the Village. The evidence indicated that the wall sign is appropriate in size, shape and its locations is appropriate to ensure adequate identification of the restaurant.

10. That the Applicant’s exterior design features of the wall sign will not cause a substantial depreciation in the property values in the neighborhood. The evidence indicated that the wall sign is visually appealing, and the sign’s materials, size, color, lettering, location and arrangement is an integral part of the site and will not cause a substantial depreciation in property values in the neighborhood.

NOW, THEREFORE, BE IT RESOLVED, by the Design Review Commission of the Village of Oak Park, acting under and by the authority conferred on it by the ordinances of the Village of Oak Park, does hereby approve a variance from Section 7-7-15 (D) (1) (a) of the Village of Oak Park Sign Code, which regulate the location of wall signage to permit the installation of a wall sign along the east elevation of the building at the premises commonly known as 838 Madison Street, Oak Park, Illinois (“Subject Property”), SUBJECT TO the following conditions and restrictions:

1. That the layout and image of the wall sign shall be in substantial conformity with the plans and specifications submitted with the application.

2. That the Applicant or their agents, assignees or successors shall maintain the wall sign as designed and keep it in good working condition.

3. That in the event that any of these conditions and restrictions shall not be fulfilled at any time in the future, said events shall be deemed a violation(s) of the Sign Code and the Zoning Administrator of the Village of Oak Park is instructed to bring whatever ordinance enforcement actions that may be necessary to bring said signage within the limitations set forth in the Sign Code of the Village of Oak Park.
