In the event of a conflict between the Declaration, the Bylaws and these Rules and Regulations, the Declaration and the Bylaws shall govern in that order. Also, in the event of a conflict between the Declaration, the Bylaws, these Rules and Regulations, and Richland Township governing documents, Morgan Creek Community Association Declaration, Bylaws and Rules and Regulations shall govern. Common Area or Common Areas – Portions of RMC property that contain no structures and are managed by the Association. This includes walkways, streets, retention basins, clubhouse parking lot, and “open space” areas throughout the community. Common Facilities – Portions of RMC community property other than the Units. This includes but is not limited to the club house, the fitness center, the swimming pool, and other structures within the community. Community Manager (CM) – A person or company contracted by the Executive Board to assist in managing the Association, Declaration – Governing document creating and controlling the “Planned Unit Community” known as Renaissance of Morgan Creek.Executive Board (EB) – A group of five representatives (Unit Owners) elected by and from the community to oversee and manage community business matters.Lot – A residential lot (Unit) within the RMC.Morgan Creek Community Association (MCCA) – See Unit Owners Association below.Property – See Unit below.Rules and Regulations (R&R) – A set of guidelines developed by the Executive Board and adopted by Unit Owners for managing and maintaining Common Facilities, Common Areas and Units within RMC.Renaissance at Morgan Creek (RMC) – Property established as a residential community for persons over 55 years in age located in Richland Township, Bucks County, PA.Resident – An individual who occupies a Unit in Renaissance at Morgan Creek Community, located in Richland Township, Bucks County, PA.Township – Richland Township, Bucks County, a municipal corporation within the Commonwealth of Pennsylvania.Unit – A piece of property (Lot) with a residential dwelling constructed thereon.Unit Owner – A person (or persons), who owns a piece of property (Unit) within the RMC. Unit Owner’s Association – The composition of community members (Unit Owners) organized to govern the "Morgan Creek Community."Morgan Creek Community Association Rules and Regulations A GUIDE FOR THE RESIDENTS OF RENAISSANCE AT MORGAN CREEK INTRODUCTION As described in the Declaration, Article VII, Architectural Control, these Rules and Regulations (R&R) are as promulgated by the Executive Board (EB) of the Morgan Creek Community Association (MCCA), with regard to various details of the use of all or any portions of the Property known as Renaissance at Morgan Creek, either supplementing or elaborating upon the provisions in the Declaration and Bylaws. In the event of a conflict between the Declaration and these Rules and Regulations, the Declaration shall prevail. All of the terms used herein, unless specifically defined herein, shall have the same meanings as are set forth in the Declaration. These Rules and Regulations apply to all Unit Owners, Residents and Guests, and will be administered by the Morgan Creek Community Association with the assistance of the Community Manager (CM). Capitalized terms not otherwise defined herein shall have the specific meanings as defined in Section 1.3 of the Declaration, Defined Terms. Abbreviations in this document are defined here as, Morgan Creek Community Association (MCCA), Rules and Regulations (R&R), Executive Board (EB), Architectural Committee (AC) or Architectural Review Committee (ARC), Renaissance at Morgan Creek (RMC). This document defines Guests as those persons temporarily visiting the Unit Owner or a Resident of a Unit. Unless otherwise provided herein, all requests pertaining to exterior property changes, including but not limited to constructing additions, remodeling, landscaping, painting (color change only), lighting, decorating, property maintenance, and so forth, must be approved by the Architectural Committee before any such change or alteration begins. A copy of the Architectural Review Committee Request Form (AKA ARC Form) is available on the RMC Website, . Select “Resources”, enter password, select “Residents Guidance and Request”, select “ARC Form”, then print. The request form must be completed by the Unit Owner and copies must be submitted to the Community Manager, the ARC Chairperson and the EB liaison to the ARC. Construction or landscaping changes may not begin until the Unit Owner has received written approval from the ARC, the EB or the Community Manager. The ARC and / or the EB may approve “start date” waivers from time to time upon written request, with detailed justification, from the Unit Owner. Failure to plan ahead for normal requests does not constitute an emergency whereby the contractor begins a project prior to approval. For additions and changes, accurate / detailed drawings, to scale, must be submitted on a separate piece of paper, no smaller than 8 ? X 11 inches. All dimensions must be noted including property lines and related measurements. If changing exterior colors (including doors and Bilco entrances), paint chips or siding samples, must be submitted. Photos and sales brochures may be submitted but may not be returned. ARC Forms will be approved (or disapproved) within 30 days of receipt unless additional information is required. Also, many construction projects require Richland Township approval. Architectural Committee approval is required before applying for township permits. Copies of approved township permits must be forwarded to the Community Manager’s office. All requests for action regarding infractions of the Rules & Regulations shall be submitted to the Community Manager for action and resolution. These requests originate from three sources, (1) a written complaint by a Unit Owner; (2) a request for action originated, discussed and agreed upon by the EB; or (3) an infraction or violation discovered by the Community Manager during a walkthrough inspection of the community. Determination of the need for an enforcement action will be accomplished by the Community Manager and if necessary by the EB. Rules compliance enforcement and the procedures for all enforcement are outlined in MCCA Administrative Resolution #2: Compliance Procedure. Reference RMC Website, , select Resources, select Administrative Procedures, select Admin Res 2 – Rules and Reg Compliance. Unit Owners who fail to submit a request to modify the exterior of a Unit, fail to comply with the ARC process, or proceed with a project without receiving the appropriate EB or ARC approval, will be subject to one or more warning letters, and a fine of not less than fifty dollars, ($50.00), per period or per occurrence, at the Executive Board’s discretion. Advisory Statement. The Association accepts no responsibility for lost or stolen personal items from any area in the community including, but not limited to, the clubhouse parking lot, Clubhouse, patio and pool area, or any Common Area. The Clubhouse and its central facilities (e.g., pool, main rooms, exercise equipment) are provided first for the enjoyment of Residents and, secondly, for their Guests. Rules are listed herein and are posted in the Clubhouse and Pool area. Allowance of Guests is a privilege and is subject to change if the total number of visitors to the Clubhouse begins to exceed the clubhouse capacity or if there is abuse of these Rules and Regulations. All clubhouse guests and their activities are to be supervised by the hosting resident. Guests under 18 years of age are not permitted in the exercise room. RULES AND REGULATIONS General Information Clubhouse Capacity. The Clubhouse capacity is defined as the maximum capacity of people allowed in the building as listed by the Architect in the approved facility plans. This capacity limit (104 persons) is posted in the Clubhouse. The number of people occupying the interior of the Clubhouse shall not exceed that posted limit. Community social activities may limit Clubhouse occupancy to fewer persons. Any future approved revisions to the capacity limits will be communicated and posted. Township Compliance. All Units within the community must comply with the Richland Township Municipal Regulations and Richland Township Zoning and Building Ordinances. Architectural Review Committee 3.Architectural Review Committee. The Executive Board may, at its discretion, appoint an Architectural Review Committee (ARC) which shall be comprised of no fewer than three (3) and no more than five (5) Unit Owners, plus one (1) Executive Board member who shall serve as the committee’s liaison to the Board. Using predetermined guidelines and related documents including the Declaration and these Rules and Regulations, the purpose of this committee is to review and approve, or disapprove, resident requests to modify the exterior of any Unit or Lot. Committee review and approval may be by electronic mail (email), virtual media (teleconference) or at a scheduled face to face / in person meeting. The Executive Board and the Community Manager shall be notified in writing of ARC decisions. The Community Manager will facilitate the ARC process by receiving and categorizing ARC requests (forms available on the community Website), approving requests as may be authorized by the EB, forwarding requests to the ARC, and notifying residents in writing of the approval or disapproval of their requests (approved or disapproved by either CM or ARC) based on the process and / or the Committee’s or EB's decision. ARC requests disapproved by the Committee may be appealed to the Executive Board. The appeal must be in writing and must be submitted to the EB through the Community Manager. Approval or disapproval of an appeal by the EB shall be final.Note well. EB and ARC members may discuss or clarify requests and / or appeals with Unit Owners only, not contractors. Specific Rules and Regulations Common Area Alteration Restrictions. No individual Unit Owner may alter the Common Area for any reason. Common Area alterations, including tree and shrub plantings or removal of the same, must be requested using the ARC request process and must be approved by the Executive Board. Single Family Residences. All Units shall be used as single-family residences subject to the restrictions and permitted uses defined in Section 6.1.l of the Declaration. No commercial, industrial, recreational or professional activity not permitted by the current zoning, laws or ordinances shall be pursued in any Unit at any time. Alteration to Common Facility Restrictions. Except for work done by the Declarant in connection with the construction and marketing of Units, nothing shall be built, caused to be built or modified within or outside of any part of the Property which will alter or cause any alteration to the Common Facilities or the exterior appearance of any Unit without the prior written approval of the Executive Board. Clean and Sanitary Unit Maintenance. Unit Owners shall maintain their Units in a safe, clean and sanitary manner and condition, in good order and repair and in accordance with all applicable restrictions, conditions, ordinances, codes, these Rules and Regulations and any other applicable governing documents. Building Material Storage. No building materials, including but not limited to lumber, brick, stone, cinder block, landscape materials or the like shall be stored outside upon the Property for more than 30 days or until construction is complete, whichever comes first. All damage to the Lot or turf must be repaired within 30 days of damage or, dependent on the season, as soon as weather permits. Flammable Material Storage. No Unit Owner shall store any flammable oils or liquids (including, but not limited to gasoline, kerosene, carbon tetrachloride, naphtha, or benzene) or any liquid gases (including, but not limited to propane) on any Common Facilities or anywhere on the Property except in approved containers in connection with customary and ordinary household use. Common Facilities Obstruction. Unit Owners may not obstruct the Common Facilities in any way including, but not limited to, interfering with any storm water drainage or any sump pump discharges. Unit Owners may not store anything in or on the Common Facilities. Grills. Outdoor grills must be stored in the garage or in the rear of the house on decks, on patios or on pavers just off the deck. Grills may not be placed in grass areas or in areas beyond planting beds. Accessory Structures. Sheds, play equipment, freestanding fences, invisible fences, swimming pools, hot tubs or other accessory structures are not permitted. Kiddie pools (24" or less in height) are permitted but must be on the Unit Owner's Lot only and emptied and stored daily in such a way as to not to cause damage to any Lot or Common Area. Allowable fences are addressed in below “Fences”.Temporary Structures. Temporary structures, including, but not limited to trailers, outbuildings, temporary shelters or gazebo tents shall not be built or maintained on any Lot or Common Area at any time. Tents and canopies are permitted on a Unit Owner's property for a special event only and must be taken down within 72 hours of event closing. The ARC request process must be followed to identify the specific location and duration. Unit Owner is responsible for any damages or accidents that may occur resulting from the use of the tent or canopy. The Association may allow use of an event tent or canopy in a Common Area for Community Activities. ARC approval is required. Firewood Storage. Firewood shall be neatly stacked on one metal rack no more than two feet wide by four feet high by eight feet long in a location in the rear of the Unit. Stacked wood shall not extend more than three (3) feet maximum from the foundation wall with a six inch (6”) minimum space from the foundation wall, Flags. Freestanding flagpoles are not permitted. One wall bracket may be securely attached to the Unit for displaying a flag. Small American flags may be placed in mulch beds. Seasonal flags and decorative banners may be displayed in mulched beds, but are limited to two in number that are each no taller than three feet and no more than three-square feet in area. Basketball Backboards. Permanent basketball backboards are not permitted. Temporary basketball backboards are permitted and must be stored in the garage when not in use. Outdoor Recreational Equipment and Clotheslines. Permanent outdoor recreational equipment (swing sets, jungle gyms, etc.) are not permitted. Clotheslines and other outdoor clothes drying devices are not permitted. No laundry shall be visible from the exterior of the Unit. Address Numbers. Address numbers may be on a sign that is one square foot or less. Number should be no greater than five inches in height. Unit Owners are only permitted to have two additional address signs, one in the mulch bed and one on the front of the house where they are plainly visible. Foundation Painting. Foundation wall painting is permitted with an ARC request using the suitable colors only. The approved paint types are any top quality (Behr, Valspar, Sherwin Williams or equal) concrete stain or semitransparent concrete based coating. Painted foundation colors should be matched to the color of the house siding or earth neutral, as opposed to a contrasting color. Any coated foundation must be maintained and renewed at the first sign of chipping, cracking or paint wearing off. ARC approval is required. Bilco Door Painting. Bilco doors may be painted in a neutral color or a color that matches the house siding. ARC approval is required. Window Air Conditioners. Window air conditioners are not permitted. Radon Remediation. Radon is an EPA as well as an individual health concern. Installation of radon remediation units does not require ARC or EB approval. However, the radon exhaust pipe (tube or conduit) must match the current downspouts (usually white), or be painted to match the siding. Additionally, the exhaust pipe must be located in the rear of the house or, the farthest possible distance from the front of the house if located on the side of the building. Landscape Lights. Landscape lights may not exceed eighteen inches in height and must be installed in mulched or stone beds, approximately five (5) feet apart. Black, antiqued black or chrome lights are permitted. The Association and/or the snow and landscape contractors are not responsible for any damage to objects located in mulch or landscape stone beds, along sidewalks or driveways during mulching, snow removal or grass cutting. ARC approval is required for landscape lights. Light Fixtures and Spotlights. Light fixtures and spotlights on porches, decks, garages and patios may be replaced provided they are similar in size and shape to those being replaced. ARC approval is required. Additional deck rail and stairway lights are also permitted with ARC approval of wattage, style and location. Any exterior light installed on a Unit shall be indirect or of such controlled focus and intensity as not to disturb the Residents of adjoining Units. Attic Fans. Low profile attic fans may be installed on back roofs but must not extend above the ridgeline of the roof. ARC approval is required.Awnings. Retractable awnings may be installed over patios and decks per the following guidelines. Fabric color should complement the house or shutter colors. It shall be a retractable awning, with or without a motor. The frame color may be anodized aluminum, black, white or beige only. There shall be no exposed wires. The awning may not exceed the size of rear patio. Pipe frame awnings (non-retractable), window awnings or "Vario-Valance" awnings are not permitted. A brochure from the awning manufacturer and a sample of material or full color photo of fabric and design must be included with the ARC request. Awnings may be extended only when residence is occupied and must be retracted at sundown. ARC approval is required. Decks, Deck Extension and Paver Patios. Decks and deck extensions must be constructed with composite material (equal to or better grade than developer's options) and have white railings. Deck color may be Trex Gray, Timbertech Cedar, or a competing brand's similar colors. Paver patios and sitting walls are permitted provided color, or colors, match or complement house walls.? Color sample must be submitted with the ARC request. Deck and patio design and size must not exceed the width of house sidewalls nor exceed a depth of 50 % of the distance between the foundation wall and the rear Lot line. This applies to all decks and patios, regardless of construction materials (composite, pavers, concrete, stones, and so forth). Decks and patios may not extend into or above storm sewer easement areas. ? ARC approval is required.Additionally, the installation must conform to Richland Township Zoning and Building Codes.Enclosed Decks and Porches. Enclosed decks and porches (roofs and screens or windows) require ARC approval. Copies of Richland Township approved permits must be provided to the ARC through the Community Manager. The materials and colors must match the existing house materials and colors where possible. ARC approval is required.Fences. Fences are permitted and shall be Privacy or Picket fences, or a low enclosure fence and require ARC approval. Approved fences are limited to four (4) feet maximum height. The fence is limited on two sides by the outside rear house corners. The rear fence boundary is limited to a maximum depth of 20 feet from the rear wall of the house or one-half the distance from that point to the rear Lot line, whichever is less. ARC approval is required.Mowing Within Fenced Areas. Residents with fenced areas are responsible for maintaining such areas on a regular schedule equal to the RMC contracted lawn maintenance service provider. This includes mowing grass, fertilizing, weeding and other related tasks. RMC mowing contractor may be contracted for this service and resident is responsible for payment. Front Doors. Front door nameplates, knockers, kick plates and replacement door knob/handles are permitted with ARC approval. Decorative glass is permitted in front door sidelights and over the door. A sample of design and colors must be submitted. ARC approval is required. Standby Generators. Permanent Standby Emergency Electric Generators are permitted subject to size and location restrictions. Since it is available and permanently piped to each Unit, natural gas is the only acceptable fuel. There are Generator Guidelines provided in the Resident Guidance section of the Website. All pertinent data should be on the ARC request form including model #, manufacturers name, size in Kw, and confirmation that gas and electrical components will be installed by qualified and licensed individuals. ARC approval is required. Gutter Guards. Gutter Guards are permitted. Unit Owners are responsible for the maintenance of their gutters. ARC approval is required. Lampposts. Lampposts are permitted at the end of the walkway in a mulched bed only. The only approved lamppost pole is black aluminum with no crossbeam. A description of the style and location must be identified on the ARC request. ARC approval is required. Solar Panels. No solar panel (or similar) installations may be made unless specifically authorized by the EB. If authorized, the installation must follow the approved ARC process. EB approval required. Storm Doors. Storm doors must be full-view white, black, bronze or match the front door color. ARC approval is required. Window Well Covers. Window well covers are permitted. Unit owner must submit description of the specific well cover that will be used. ARC approval is required. Wishing Wells/Waterfalls/Container Ponds. One decorative wishing well, waterfall or container pond is permitted in the rear or side mulch bed. The size is limited to 36 inch height and 40 gallons. Any such item should be maintained to prevent contamination or insect breeding and must be emptied and put away during winter months. Landscaping contractor shall not be responsible for inadvertent grass clipping entering the water display. ARC approval is required. Decorative Shutters. Decorative shutters are permitted with ARC approval. Colors must complement the house siding. Shutters shall be painted or repainted as needed and ARC approval is required if changing colors. Ground Improvements Grading and Regrading. No digging, construction of retaining wall, earth moving or re-grading operations, except lawn reseeding, replanting or replacing with sod, can commence on any Lot or Unit. ARC approval is required.Underground Utilities. Unit Owners are responsible for verifying locations of all underground utilities and existing easements and bear total responsibility for all service interruptions directly attributable to work performed on their property by contractors or directly by residents. Unit Owners can contact Pennsylvania One Call free of charge at 1-800-242-1776 to verify underground utility locations. There is a fee for contractor requests.Landscaping, Trees, Shrubs, Mulch & Flower Beds.Mulch Beds. Mulch beds are allowed at the sides and rear of the house. These beds are not to extend more than four (4) feet maximum from the house foundation wall, nor more than four (4) feet from outside edge of patio or deck, with the exception of profile bump outs for utility company enclosures, shrubs and appropriately sized trees. The mulch used in extra beds must match the mulch put in the front beds by the Association. ARC approval is not required.Mulch and Flower Bed Edging. Mulched beds may be edged with natural stone and/or pavers providing that only one neutral color per house is permitted. Black or neutral earth tone colored plastic edging is also allowed. All edging should be a maximum of six inches in height. Mowing contractor is not responsible for edging that is damaged if it exceeds mowing height. ARC approval is not required.Stone Landscape Beds and Stone Borders. Natural colored landscape stone beds (instead of mulch) are allowed along the side and rear foundation walls of the Units. However, the stone beds shall not exceed 24 inches from the foundation wall. Stone border walls for mulch and landscape stone beds using decorative stones, pavers or similar products are permitted. Border walls may not be used to extend mulch and stone beds beyond the four and two-foot limits previously mentioned. ARC approval is required.Freestanding Mulch and Landscape Stone Beds. Freestanding mulch and landscape stone beds are allowed, subject to ARC approval on a case by case basis. Such beds to be located in the rear of a Unit must be positioned within the house sidewalls, may be up to six by six feet in size (including required boarder walls) dependent on lot dimensions and must be placed a minimum of fifteen feet from rear property line. Beds to be located on the side of a Unit must be positioned in line with or behind front wall of house, may be up to six by six feet in size (including edging or boarder walls) and must be a minimum of five feet from side property line. These beds may be used for, but not limited to, plantings such as trees, shrubs, flowers, and so forth, but not vegetable gardens. ARC approval is required. Mulch and Stone Landscape Bed Maintenance. All mulch and landscape beds, including associated borders, must be properly maintained and kept weed free. Trees and Shrubs. Trees suitable for a small yard and shrubs are permitted outside mulch beds, but such plantings are subject to ARC approval of their location, species, and final size. Trees and shrubs must not interfere with Unit walls, Unit and Common utilities, future landscaping, all underground utilities, lot lines, driveways, sidewalks, curbing, water flow or storm sewers and extend onto or over neighboring properties. Plants such as Bamboo or other high and fast-growing invasive grasses are not permitted. ARC approval is required. Tree and Shrub Pruning. Shrubs must be pruned to the window ledge height or five feet, whichever is greater. Trees should be regularly pruned to be aesthetically proportioned and appropriately sized for the space. That is, trees should be trimmed or pruned to a height of thirty (30) feet, or less. Tree and Shrub Maintenance. Unit Owners are responsible for removing dead bushes, trees and shrubs from their property promptly. Replacement is to occur during the next appropriate planting season. All trees, shrubs, patio pots, and plantings are included in this rule. Replacement Trees and Shrubs. Planting replacement trees and shrubs in existing mulch beds does not require ARC approval. Builder is not responsible if at final grading the trees need to be removed, in which case removal and replacement of trees and shrubs will be at Unit Owner expense. ARC approval is not required. Tree and Shrub Removal. Trees and shrubs may be removed from Unit Owner’s property without ARC approval. When planting new or replacement trees and shrubs, it is strongly recommended that the location, species and height be appropriate for location. Trees and shrubs located in Common Areas may not be removed without EB approval. Fruit Bearing Trees. Fruit bearing trees are not permitted. Decorative trees such as Bradford Pear, Japanese Cherry or other decorative species are permitted. Tree species must be included on or with ARC Request form plus a plot plan or detailed drawing showing planting location(s). ARC approval is required. Flowerpots and Hanging Baskets. Flowerpots and hanging baskets are permitted on the front porch or as planters under garage sidelights without ARC approval. All dead plants must be removed promptly. Two post hangers (no higher than six feet) are permitted in both front and back mulched beds for hanging baskets. Vegetable Gardens. Separate freestanding vegetable gardens are not permitted. Individual garden plants may be planted and managed inside rear (or rear side) mulch beds or in patio pots, but they must be kept neat and orderly and removed at the end of the growing season. Care must be taken to control insects and other pests. Lawn Maintenance. The EB of the MCCA contracts for lawn maintenance services such as mowing, fertilizing, spraying insecticides, pesticides, herbicides, and other similar tasks for Unit Owners. In order to maintain a consistent appearance within the community, Unit Owners may not “opt out” of these services without prior written approval from the Executive Board. To opt out, each year the Unit Owner must submit a detailed ARC Request form to the Executive Board showing that the Unit Owner, or his or her contracted “service provider”, will perform these services equal to the MCCA contracted provider.? Unit Owners who opt out of MCCA contracted lawn maintenance and / or other services will not receive a reduction in their Annual Assessment.? (As previously mentioned, Unit Owners with fenced areas are responsible for maintaining the enclosed areas consistent with the community, i.e., such residents are responsible for mowing, applying fertilizer and other lawn chemicals inside fenced areas, through either contracted service providers or personally.) Lawn Reseeding and Replacing. Unit Owners may reseed, replant, or replace existing lawns with sod, limited to their properties, without ARC approval. Unit owners are responsible for removing trash, debris, and supplies related to such work, and repairing damage to neighboring property, or neighboring properties, and Common Areas associated with such work. Unit owners may not reseed, replant or sod Common Areas without EB approval. Lawn Ornaments, Lawn Furniture, Bird Feeders and Hoses Lawn Ornaments. Up to six small (under 12 inches) or two larger (no greater than 30 inches in height or 30 inches in length, not both) ornament display items are permitted in front or side mulch or stone beds or on patios or decks. No more than two such ornaments are permitted in front mulch beds. Ornamental items include but are not limited to mobiles, pinwheels, windsocks and rotating weather vanes, etc.? Decorations. No decorations may be affixed or placed upon the front exterior walls, garage doors or roofs without an approved ARC request. Small decorations or objects may be placed on rear walls or in mulch beds with request and approval. Birdfeeders and Birdhouses. Birdfeeders and birdhouses are limited to six in number. They can be located on post hangers in mulch beds or on trees but only in such a manner as not to attract other animals. If rodents, squirrels, raccoons or feral cats become a problem in the community due to a large number of birdfeeders, this rule will be modified or eliminated immediately. Outdoor Furniture. Outdoor furniture, such as tables or chairs, or both, may be placed on front porches, back patios and decks, but may not be placed in side mulch beds or on lawns. Picnic tables and chairs may be placed on decks or patios only. Decorative park style benches measuring 24" deep, by 48" long and 36" high, or smaller size, and garden style concrete or marble benches with similar dimensions, may be placed in front mulch beds and in free standing mulch beds in rear of dwelling. All such furniture must be kept in good condition. Unobstructed Walkways. All walkways shall be kept unobstructed so that a person or persons can pass or gain access. Hoses. Lawn hoses must be on or inside a hose holder or hung on a hose holder attached to the house. Hoses must always be coiled when not in use. Loose hoses on the ground or outside of mulched beds are not permitted. Yard Maintenance. There shall be no debris in yards, and yards shall be maintained in a neat and orderly manner. Unsightly Storage. Storage of any unsightly items in yards is prohibited.Wind chimes are permitted but may not exceed three in number and may not interfere with the peace and quiet of the neighboring Unit.Holiday DecoratingSeasonal Decorations. Unit Owners may decorate for seasonal holidays. Decorations that produce excessive glare or noise are not permitted. Holiday decorations are intended to be temporary for that particular holiday (two weeks before and one week after the holiday period). Holiday Lights. Outdoor holiday lights associated with the December holiday season shall not be installed or illuminated before Thanksgiving and must be removed by January 15th. Floodlights. Front door floodlights are permitted during the December holiday season only, for the period listed in above “Seasonal Decorations”. Duration of Displaying Decorations. Holiday decorations associated with Halloween, Thanksgiving, Valentines' Day, Memorial Day, Independence Day, etc. should be displayed for no longer than two weeks before and one week after the holiday. Antennas, Satellite Dishes and Signal ReceptorsAntennas, Satellite Dishes and Other Signal Receptors. External antennas of any kind are prohibited unless approved by the Executive Board using the ARC process. This includes, but is not limited to antennas for radio stations (amateur (ham), short wave, citizens band (CB) base units, and other similar devices). One satellite dish per unit is permitted with ARC approval, but it may not exceed thirty-nine inches (39”) in diameter. It must be installed on the roof and only in the rear of the dwelling. Wires (or cables) for any exterior signal receptor must be concealed and may not be exposed outside the Unit except at the point of entry. Interior HDTV antennas are permitted and do not require ARC approval. (For additional information see Declaration of Renaissance at Morgan Creek Planned Community, Article VI, Section 6.1.11.)SignsSigns, Posters, Advertising. No sign, poster, display, billboard, or other advertising device of any kind shall be displayed to the public view on any portion of the property or on any unit. Real Estate For Sale. Real Estate For Sale signs may be displayed but are limited to one in the front window and one in a side window. Election Signs. One “Election” sign may be placed on the front lawn one week prior to a major election and must be removed the day after the election. Decorative Signs. One decorative sign may be placed in a mulch bed but the size may not exceed one square foot. Security and alarm signs of the same size are permitted in the front and rear windows, on front facing porches, rear facing patios or mulch beds only.Family Signs. No permanent signs on front doors, garage doors, or Unit exteriors (with the exception of Family Name and house numbers) are permitted. One family name sign is permitted, and is limited to one square foot in size. Trash Containers, Dumpsters, Trash Removal and Storage PodsTrash. No trash, garbage, recyclables or other waste material shall be kept or permitted upon any Unit (or Lot) unless placed in an appropriate container. The Community's duly licensed hauler shall dispose of all rubbish, refuse and garbage on a regular basis (using the supplied trash and recycle containers). No refuse or any personal effects are to be stored on the front side of the house, i.e., facing the street, or in the front yard. Residents are not permitted to use a contractors dumpster for any reason without a contractor’s permission. Trash Containers. Trash containers and recycle containers must be stored in the garage until 5:00 pm or dusk the evening before pickup. All trash and recycle containers, and other refuse containers, must be removed from the street after pickup on the day of pickup. Trash Removal. It is the responsibility of Unit Owners to immediately remove any refuse that has spilled or been missed by the trash hauler or has been distributed by animals, wind, or other methods on their Lots. It is also recommended that all residents retrieve items from any Common Area or Areas where trash has been blown or deposited. Bulk Trash Items. It is the responsibility of the Unit Owner to schedule with the trash hauler the removal of bulk items, defined but not limited to mattresses, carpet, furniture, construction debris, etc. It is the responsibility of the Unit Owner to remove from the curb items not removed by the trash hauler, within one full day of missed pickup. Trash Dumpsters. Dumpsters may be placed in a Unit Owner's driveway with prior ARC approval using the ARC request process. The dumpster should not be placed in the street or on any Common Area. The Unit Owner is responsible to repair any damage caused by the dumpster. In the case of a major renovation, the Unit Owner may request relief from this restriction using the ARC request process. Residents are not permitted to use another resident’s contracted dumpster without such resident’s permission. ARC approval is required.Storage Pods or Trailers. Storage PODS or trailers used for a resident’s relocation (moving) process may be placed in a Unit Owner’s driveway. ARC approval is required. Such Pods or trailers may be placed in the driveway one week prior to a resident’s move out date. Incoming residents must have Pods or trailers removed within three days of move in date.Vehicles and Parking Vehicle Parking. Unit Owners shall park vehicles in the garage or driveways located on the Unit property. All vehicles shall be fully operable and properly inspected and registered. Four wheel passenger vehicles, two-wheel motorized cycles and standard bicycles only are permitted to be parked on the driveway. Other specialized vehicles including three and four wheel utility vehicles and golf carts are to be kept garaged. Commercial Vehicles. No Unit Owner shall park, store, or keep within the Property any commercial type vehicle including, but not limited to dump trucks, cement mixer trucks, oil or gas trucks, delivery trucks or any other vehicular equipment, mobile or otherwise, deemed to be a nuisance. No Unit Owner shall park any recreational vehicle (camper, motor home, truck trailer, boat, mobile home, or other similar vehicle), upon any uncovered parking space, so as to be visible from anywhere on the Property. Any such vehicle must be parked in the garage. The exception is that such vehicles may be parked in front of Units for a temporary period not to exceed 24 hours while loading or preparing for a trip.Non-Commercial Trucks. The above restrictions exclude non-commercial personal use trucks up to and including one ton when used for everyday transportation, (e.g., no ladder racks, equipment, toolboxes or commercial signs.) Examples of one ton vehicles include, but are not limited to, Ram 3500, GMC Sierra 3500, Ford E-350, Ford F-350, Hummer H1 and others.Major Vehicle Repairs. No Unit Owner shall conduct major repairs or restorations of any motor vehicle, boat, trailer, aircraft, or other vehicle upon any portion of the Unit property or Common Facilities. Minor Vehicle Maintenance. Minor vehicle repairs are permitted, but must be done only inside the garage. Noisy or smoky vehicles or unlicensed off road motor vehicles shall not be located, used or placed on any portion of the Property. Clubhouse Parking. The four spaces in front of the general mailboxes are to be used only for pickup of mail and temporary parking between the hours of 8:00 AM and 5:00 PM. The exceptions are when there is an event at the Clubhouse requiring use of all the spaces. Pool users should try to avoid blocking mail pick up spaces. The Clubhouse parking lot is not to be used for vehicle storage beyond any 24-hour period without EB permission. Vehicle Operation. All vehicles shall be operated safely throughout the community roadways on the right side of the pavement. Vehicles shall not exceed the posted speed limit, 15 MPH. Drivers must obey STOP signs and other safety signs as posted. Drivers who chose not to follow the rules in this paragraph will be notified, and possibly fined. Drivers must be aware of residents walking within the community.Pets. Pet Supervision. All pets, when outdoors, shall be supervised by a responsible adult person and on a leash at all times. No pets are to be staked out unattended. Pets must be walked on the roadways, Common Grass Areas, wetlands areas, walkways or the pet Unit Owner's private yard only. Respect other Unit Owners property. Pet owners must pick up dog waste immediately.Obnoxious / Noisy Pets. If any Unit Owner's pet becomes obnoxious to other Unit Owners by emitting continuous noise (barking, howling, crying), or by attacking or otherwise interfering with the freedom of movement of persons and other pets, the pet owner is responsible to correct the problem. The Unit Owner is also responsible for property damage, injury or disturbances caused or inflicted by the pet living in the Unit or the pet of Guests of the Unit. No pet shall be permitted to disturb a neighbor's rest or peaceful enjoyment of his or her property. Continuously noisy animals must be kept inside or the situation otherwise rectified. Pet Waste. All animal (pet) fecal waste within Common Facilities and Unit Owner property shall be removed immediately and properly disposed. Pet Limitation. No animals, livestock, reptiles or poultry of any kind shall be raised, bred, or kept on any Lot, except usual and ordinary dogs, cats, fish, birds, and other household pets, which may be kept in the units if they are not kept, bred, or maintained for commercial purposes or in unreasonable quantities, which shall ordinarily mean 2 dogs or cats per household, provided that the EB (or the ARC) may determine that a reasonable number may be more or less. Wild Animals. Feeding or placing food on resident’s property or on Common Areas, attracting or maintaining feral cats or other wild animals (except small birds), are prohibited and violations will be strictly enforced. Pet Enclosures and Fences. No exterior dog enclosures or invisible fences shall be permitted. Service AnimalsService Animals. Service animals shall be permitted access to the Clubhouse, the Pool Deck (but not the Swimming Pool) and other Common Facilities for residents with disabilities or who may otherwise require assistance from such certified, trained or licensed animals. The resident must be able to provide proof of documentation showing the animal’s certification, training or licensing as a service animal. The animal must be supervised and be on a leash, or a related / or a similar restraint, at all times.Service Animal Removal from Common Facility. Residents with service animals may be required to remove the animal from any Common Facility if it becomes uncontrollable, displays aggressive or intolerant behavior, is inadequately housebroken, or another resident complains, or exhibits an allergic reaction (sneezing, coughing, or other), to such animal. If the animal is not removed upon oral request at the time of the incident (or infraction), the resident who owns the service animal may be restricted from the Common Facility as determined by the Executive Board.Public Nuisance Respect for Private Property. Unit Owner's Lots are considered private property. No access shall be granted to private outside property without the consent of the Unit Owner other than by the developer, EB, AC members, Association contractors or the Community Management Company. Residents using public walkways shall respect the privacy and rights of those Units along the walkway area. Nuisances and Offensive Activity. No noxious or offensive activity shall be conducted upon any Lot or Common Area, nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood. A nuisance is an activity that disturbs or annoys persons of reasonable sensibilities. The definition of nuisance also includes, but is not limited to, harassment by any means (verbal, letters, emails, public gathering areas, meetings or other contacts). The determination as to whether any activity constitutes a nuisance will be decided by the Community Manager and EB utilizing these rules, the Harassment Policy, and the facts submitted. Administrative Resolution #2 shall be used to process any complaints. Noise Control and Safety Offensive Noise. No loud or offensive noise activity shall be conducted in or upon any Lot or Common Facilities, nor shall anything be done therein which may be, or may become, an unreasonable annoyance or a nuisance to any other Unit Owner. Personal Conduct. Unit Owners shall not practice, nor permit practice of any activities which unreasonably interferes with the quiet enjoyment and proper use of another Unit or the Common Facilities by any other Unit Owner, or which creates or results in a hazard or nuisance on the property.Garage, Yard and Estate SalesGarage and Yard Sales. Individual (resident) garage or yard sales are not permitted. Residents are encouraged to participate in the RMC community yard sale to dispose of personal items. Such yard (and bake) sale is usually held annually in the RMC clubhouse parking lot in September or October. Estate Sales. Estate sales may be held with ARC approval. See Estate Sale Policy and Procedure and Estate Sale Request form available on the RMC Website (RMCHOA). KeysClubhouse and Postal Box Keys. At time of property settlement for a Unit resale, residents are required to return all Clubhouse and Postal Box Keys to the incoming resident, the realtor (if any), or the Community Manager (or designee). Failure to turnover such keys will result in a fee to the outgoing resident (or such resident’s designee). ................
