No: __________________An ordinance amendING THE SLAUGHTER BEACH ZONING ORDINANCE TO CLARIFY REGULATIONS regarding THE USE OF accessory buildingsWHEREAS, the Town Council of the Town of Slaughter Beach has enacted zoning regulations in the Town of Slaughter Beach as authorized pursuant to 22 Del. C. Chapter 3 and Section 6.2.27 of the Town Charter;WHEREAS, the Town Council held a public hearing on _____________, notice for which was published in the ___________________ newspaper on _____________ and posted at the Town bulletin board and on the Town’s website on ______________, at which hearing all interested members of the public were given an opportunity to comment on this ordinance; andWHEREAS, the Town Council finds that it is in the best interest of the public health, safety, and welfare to clarify the regulations regarding the use of accessory buildings.NOW THEREFORE, BE IT HEREBY ENACTED by the Town Council of the Town of Slaughter Beach, a majority thereof concurring in Council duly met, that the Slaughter Beach Zoning Ordinance be and hereby is amended as follows:Section 1. Amend Section 2.3 (Specific Definitions) by making insertions as shown by underline and deletions as shown by strikethrough as follows:Specific Definitions.* * *Building, Accessory. A separate, subordinate building on the same lot as the principal building and used for a purpose that is incidental and subordinate to the principal building’s use. Such buildings include, but are not limited to, garages, storage sheds, and doghouses. Accessory buildings may not be used for human habitation.Section 2. Amend Section 5.6 (Accessory Buildings) by making insertions as shown by underline and deletions as shown by strikethrough as follows:5.6 Accessory Buildings.5.6.1 Accessory buildings shall be placed in accordance with the following requirements:All accessory buildings shall only be permitted to be located on the a lot on which a principal building is erected or is being erected as evidenced by an active building permit for the principal building and the commencement of construction. Section 3. Severability. The provisions of this Ordinance shall be severable. If any provisions of this Ordinance are found by any court of competent jurisdiction to be unconstitutional or void, the remaining provisions of this Ordinance shall remain valid unless the court finds that the valid provisions of this Ordinance are so essentially and inseparably connected with, and so dependent upon, the unconstitutional or void provision that it cannot be presumed that the Town Council would have enacted the remaining valid provisions without the unconstitutional or void provision; or unless the court finds that the remaining valid provisions, standing alone, are incomplete and incapable of being executed in accordance with the Town Council’s intent. Section 4. Effective Date. This Ordinance shall become effective immediately upon its adoption by the Town Council.SynopsisThis ordinance amends the Zoning Ordinance of the Town of Slaughter Beach to clarify that accessory buildings may not be used for human habitation and that accessory buildings cannot be situated on a property that does not have primary building in existence or under construction.
