Supporters of a major tax increase say that the Highway Trust Fund will go broke within a year if new monies are not raised. Proposals are being circulated to raise the Federal motor fuel tax rate to between 36¢ to $1.00 per gallon.
Supporters to raise the Federal motor fuel tax rate significantly include the nation’s governors, state highway transportation officials, and the powerful highway lobby.
On the Federal level, numerous reports assert that the Nation’s roads, bridges, and infrastructure are in serious need of repairs. They argue that we have not made the investment over the years that was needed. And while the nation faces
a challenged economy, many are calling for a huge investment in our transportation system.
While the diversion of fuel tax revenues on the Federal level is not as great as it is in the state level, we are approaching
25% of the money from the Highway Trust Fund now going for non-highway purposes.
As well-oiled lobby groups and political leaders push for motor fuel tax increases, there are too many groups that need to become more vocal to block the hikes. The trucking industry has been especially hurt by the economy. Most goods are delivered by trucks.
The impact on the trucking industry has increased the price of most services and goods. Rising gasoline prices have hurt the average family. Is this really the right time to increase the cost of gasoline? And what about distributors and service

Marathon Petroleum Reports Strong Q3 Profits
As Marathon Petroleum cuts costs, fuel prices continue to climb, resulting in high Q3 profits.
Marathon Petroleum Corp., which split from Marathon Oil Corp. earlier this year, reported soaring third quarter profits this week, according to Bloomberg Businessweek.
Earnings totaled $1.13 billion, for the three months ended Sept. 30, more than four times the $277 million, it earned for the same part of 2010. Revenue increased 30% to $20.65 billion in the quarter. The increase came as Marathon’s refineries used relatively cheap oil while prices rose for the fuel it sold. Retail gasoline prices increased 33%, diesel prices rose 32% and jet fuel prices grew 46% in the quarter.
Murphy Oil Q3 Earnings
Murphy Oil Corp.’s net income in the third quarter of 2011 totaled $406.1 million, which was double the net income of $202.8 million in the third quarter of 2010.
Wholesale Gasoline Costs Tumbling on Weak Demand
Even as the U.S. crude price benchmark comes within pennies of $100 barrel, wholesale gasoline costs moved sharply lower, down by double digits in numerous major metropolitan markets across the country during the second full week of November. Partly explaining the disconnect is weak demand for gasoline, which recently sunk to near an eight-year low when considering weekly data from the Energy Information Administration.
Gasoline costs are tumbling just as costs for diesel fuel are surging amid what analysts call a tight global market for distillates. Also in contrast to gasoline, demand for diesel fuel has surged recently while exports from the U.S. hover near one million barrels per day.
Meantime, EIA anticipates on-highway diesel fuel retail prices will average $3.84 gallon this year, four cents higher than October’s estimate and 85 cents higher than the 2010 average of $2.99 gallon.
The wholesale gasoline price changed up or down 19 times in November.

Feds: Group stole card numbers with 'skimmers'
Federal authorities have accused owners of an Orlando mobile-phone business of using stolen credit-card numbers — obtained via "skimming" devices implanted at gas stations — to buy hundreds of thousands of dollars of merchandise at area stores.
Robin Miguel Corrales Castro, 35, and Silvio Leon, 38, co-owners of Simple Mobile, were arrested Tuesday on charges of conspiring to produce, use or traffic in one or more counterfeit devices, following a several month U.S. Secret Service investigation. Three others are also accused of participating in the credit-card scheme, according to a criminal complaint filed in Orlando federal court this week: Ivan Malagon, Lazaro J. Corrales Castro and Federico Martinez.
Agents say the group obtained credit-card numbers from skimming devices that were installed on Central Florida gas-station pumps, and then used equipment to manufacture credit cards, debit cards and gift cards with the stolen numbers.
A confidential source told authorities he saw Robin Corrales use a card reader/encoder to re-encode cards with stolen credit-card numbers. The source also told authorities he saw about 1,000 Target gift cards on a single visit to Corrales' house. Those fraudulent cards were then sold at Simple Mobile, the source told authorities.
Throughout their investigation, agents identified hundreds of thousands of dollars in fraudulent credit card purchases made at Target, Best Buy, Home Depot and other stores. The group was already on the radar of Target asset-protection investigators when the Secret Service started its inquiry. Target's investigators documented the fraudulent charges and
identified the vehicles the suspects drove during their visits to the stores through surveillance video.
American Express identified about $125,565 worth of fraudulent charges at Target related to the case, and Discover identified about $30,220, court documents said. American Express said the credit-card numbers were stolen at a Hess gas station in Winter Springs. The Secret Service accuses the group of using more than 175 fraudulent credit cards between January and October.
On Oct. 19, a U.S. Customs officer intercepted a package en route to Simple Mobile, which contained an embossing machine, which are often used to manufacture credit cards. Corrales and Leon are being held at the Seminole County Jail. A detention hearing will be held in their case.
Big Banks Bail on Debit Card Fees
SunTrust, Wells Fargo, Chase undoing "swipe recouping" plans in wake of BofA backlash
ATLANTA -- SunTrust Banks Inc. said on Monday that it will stop charging a $5-per-month fee for using debit cards and return the fees that it has collected since June to its customers. The bank followed larger rivals such as Chase and Wells Fargo in backing off the fees, reported the Associated Press.
Last month, Charlotte, N.C.-based Bank of America announced plans to charge $5 per month for using debit cards for purchases. Large financial institutions threatened such fee increases in the wake of interchange fee reform created by the Durbin Amendment to the Dodd-Frank Wall Street Reform & Consumer Protection Act that went into effect October 1 as a way to recoup their losses.
The retail banking division of New York City-based JPMorgan Chase & Co. let news leak that it will not expand the $3 monthly fees it is charging in tests in Wisconsin and Georgia when they end in November. Wells Fargo & Co. followed with an official announcement that it is ending tests, begun October 14, of a $3 fee in five states.
While not ending the fees, Bank of America also said it plans to offer ways to avoid the fees through use of services like direct deposit and or maintaining certain balances, but the bank has not officially laid out its policy.
Atlanta-based SunTrust announced that it has eliminated the monthly check card fee on its Everyday Checking account. The fee will no longer be charged beginning Wednesday, November 2, 2011, but all clients who incur--or have previously incurred the fee prior to that date will receive a full refund, it said.
Wawa To Enter Florida
Some 100 Wawa c-stores are planned for Florida over the next five years.
Wawa, which operates more than 580 c-stores in New Jersey, Pennsylvania, Delaware, Maryland and Virginia, is set to begin construction on its first Florida convenience store across from SeaWorld at International Drive and Central Florida Parkway, in Orlando, Fla., the Orlando Sentinel reported.
The 5,000-square-foot store is expected to open in July, and was designed by Cuhaci & Peterson Architects of Orlando. After the first Florida Wawa opens its doors, four more locations are expected to follow.
The new stores are planned for the following locations:
• Hoffner Avenue and South Goldenrod Road in Orlando,
• John Young Parkway and Silver Star Road in Orlando,
• U.S. Highway 192 and Simpson Road in Kissimmee
• Orange Blossom Trail and on East Donegan Avenue in Kissimmee
Wawa aims to open 100 Orlando-area stores in the next five years. Orlando Mayor Buddy Dyer is expected to attend a groundbreaking event.
ATM Council Files Antitrust Lawsuit
Visa and MasterCard to face litigation on antitrust charges.
The National ATM Council, a group representing operators of automated teller machines (ATMs), filed a lawsuit against Visa and MasterCard accusing the credit and debit card issuers of violating antitrust laws by fixing the price of ATM access fees, the Huffington Post reported.
The lawsuit was filed on Wednesday in the U.S. District Court for the District of Columbia on behalf of the National ATM Council and independent ATM operators. Its allegations include restraint of trade, and that Visa and MasterCard network rules prohibit ATM operators from offering lower prices for transactions over PIN-debit networks that are not affiliated with Visa or MasterCard.
The lawsuit also claims the price fixing artificially raises the price consumers pay for ATM services, limits ATM operator revenue, and violates antitrust laws, and that rules by card issuers prevent an operator from offering consumers a discount for ATM transactions not completed over Visa or MasterCard networks, according to the Huffington Post.
“Visa and MasterCard are the ringleaders, organizers, and enforcers of a conspiracy among U.S. banks to fix the price of ATM access fees in order to keep the competition at bay,” Jonathan Rubin, of the Rubin PLLC law firm which represents the plaintiffs, said in a statement.
If the case be granted class action status, the plaintiffs would be comprised of independent operators of some 200,000 ATMs in the U.S., according to Rubin.
Royal Dutch Will Not Create a 'Shell' Company
THE HAGUE, Netherlands -- Royal Dutch Shell plc has no intention of splitting into two separate companies, its CEO, Peter Voser, told the Wall Street Journal.
Spinning off the refineries part of the business has been a popular approach taken by several of its competitors, including ConocoPhillips and Marathon Oil Corp. However, as Convenience Store News previously reported, Chevron also resisted the temptation to make such a move.
As for Shell, Voser told the newspaper he values the company's refineries as part of its overall business. He added that it gives Shell a leg up in developing its Canadian oil sands. If Shell were to split into two companies, "you have the risk that others will optimize the value chain," said Voser.
He told the Journal there is another benefit to remaining a single company: Shell has an advantage when courting government-owned oil companies, which experts say have strong access to oil reserves but little ability to extract it from the ground or market the products.
"For us to be the right partner to national oil companies, we have to be integrated," Voser said.
ExxonMobil Offers Image Incentive Bonus to Marketers
Company executives are also advising its marketers not to rush to sign brand conversion agreements with dealers whose performance is already sub-par.
IRVING, TEXAS -- ExxonMobil will offer its marketers cash bonuses in the form of a cafeteria-style image incentive program next year. The initiative, now in the final planning stages, is part of an effort by the major to upgrade the appearance of retailer-operated retail outlets and encourage the construction of more.
Traditionally, major oil companies reward retailers who meet their image standards with cents-per-gallon payments, usually spread over three or more years. The new bonus offers from ExxonMobil will be in addition to the company’s existing incentives, sources say. Currently, ExxonMobil pays 1 to 2 cents per gallon for image work at retail, depending on the type of projects and length of payout time.
ExxonMobil executives outlined their plan at the company’s national marketer meeting in New Orleans earlier this month. The program, to be formally introduced early next year, will allow marketers to choose one payment from a menu of three additional offers for each station they operate:
• A $5,000 payment for high-rise sign repairs or upgrades,
• $5,000 for LED canopy lighting, or
• $500 per dispenser for new decals, which may be capped per station.
Additionally, the company will pay marketers a $10,000 bonus if they bring a new store online by January 31, a payment that will increase to $12,000 per store for three or Retailer comments related to the new program were largely positive.
ExxonMobil executives also reassured attendees that the company does not plan to spin off its retail marketing business, as ConocoPhillips has done. It is in the process of selling its retail real estate and supply business to jobbers and expects that its stores will be 100% jobber-operated by year-end 2012.
Executives also offered marketers looking to grow their business a piece of advice: Don’t rush to sign brand conversion agreements with dealers whose performance is already sub-par. They said it’s one of the top mistakes they see with marketers: “Jobbers tend to jump at any new business they’re offered, even to their own detriment. They said we have to learn to walk away from new business if the dealer who is offering it cannot take care of the business he has already.”
Nearly 50% of Small Merchants Not PCI Compliant
Forty-eight percent of small businesses reported they were either “unsure” of or “not at all familiar” with PCI and its data security standards.
IRVINE, CA – A new survey reveals a large security gap between how small and mid- to large-sized businesses approach PCI compliance, Bank Systems & Technology reports.
Conducted by PCI security services firm ControlScan and payment processing firm Merchant Warehouse, the survey results show 48 percent of merchants with 10 or fewer employees were either “unsure” of or “not at all familiar” with the Payment Card Industry Data Security Standard.
By contrast, 77 percent of level 4 merchants (those employing 51 or more employees) said they were “very” or “somewhat” familiar with the PCI DSS, with 79 percent saying data security is a high priority and 82 percent understanding that PCI compliance is mandatory.
"For many smaller merchants, PCI compliance is not something they are aware of," said Heather Foster, VP of marketing for ControlScan, adding that when it comes to data security, small business has the mentality that "somebody else should be worrying about this."
Foster added that while the compliance level of level 4 merchants is much higher than it was three years ago when it conducted its first survey, "the level of awareness for level 4 merchants is still not as high as we would like."
“Many merchants think PCI compliance is a one-time event and then they're done, but there is a lot of ongoing education that has to take place."
U.S. Beer Consumption Continues to Decline
Overall the total beer industry is down, while craft brews and imports continue resonating with consumers.
NORWALK, CT – According to the Beverage Information Group’s (BIG) 2011 Beer Handbook, the U.S. beer industry suffered its fourth-consecutive annual sales decline, losing 1.9% to total 2.8 billion cases.
BIG attributed the loss to continued declines in the light beer segment, which weighed heavily on the final numbers.
On the positive side, craft beers registered strong gains, while imports were up slightly by 0.9%, though still 11.1% lower than pre-recessionary levels
“Consumers are gravitating toward premium products with exciting and new flavors something the craft segment has done well in providing,” said Eric Schmidt, BIG’s manager of information services.
The handbook predicts a dim short-term future for the beer industry, with rising fuel costs and high unemployment rates among its core consumer’s two primary factors in its decline. However, BIG expects the super premium, craft/specialty and flavored malt beverage segments to show positive growth in the next five years, while premium, light, popular, ice and the malt liquor segments are likely to decline.
New Hampshire Tax Cut Effect
Four months in, a state cigarette tax reduction hasn't produced the desired results

CONCORD, N.H. --A 10-cent reduction in New Hampshire cigarette taxes hasn't boosted revenue in the first four months of the financial year, but more information about the results is anticipated in December.
Through the first four months of the financial year, the tax brought in $77.5 million, which was $3.5 million or 4.3% less than legislative budget writers predicted, according to the Nashua Telegraph. The state took in $84 million during the first four months last year.
The New Hampshire Legislature cut the tax to $1.58 a pack after economists working for the New Hampshire Grocers Association predicted the tax cut would lead to $13 million more in cigarette tax revenue. (Anti-tobacco groups hired economic experts who argued the cut would cause a $9 million decline in tobacco taxes this year.)
7-Eleven Hits Growth Spurt
DALLAS -- 7-Eleven Inc. will open about 650 U.S. stores this year, more than double the number of new stores it opened in 2010, according to a published report.
The Dallas-based company saw an increase in acquisition opportunities, while also having organic store growth, Sean Duffy, senior vice president of development, told the Dallas Business Journal. "We had opportunities with the ExxonMobil stores that were for sale and lot of the older companies selling their assets," Duffy said.
In August, 7-Eleven acquired 51 north Texas ExxonMobil On the Run stores. Duffy said those stores will be converted in January. The company also acquired 183 ExxonMobil stores in Florida and 188 Wilson Farms locations in June.
The remaining Wilson Farms stores are expected to be converted in 2012.
According to the 2011 Convenience Store News Top 100 report, 7-Eleven was the fastest-growing convenience store chain in the United States during the one-year period that ended April 30, 2011.
7-Eleven's expansion goals include Canada, as well; also reported last month that the retailer plans to open up to 200 new stores in Ontario from 2012 to 2016, with the bulk of this growth focused on the Toronto area.
The expansion would significantly boost 7-Eleven's presence in Toronto. It currently operates 467 locations in Canada
A Mysterious Connection
A U.K. gasoline station appears to strand some vehicles that stop to fill up.
CLIFTON MOOR, England – Some motorists at a Tesco store in Clifton Moor have found themselves stranded not because of they’ve run out of gas, but because their cars won’t restart, the Yorkshire Post reports.
The electrical problem appears to be mysteriously fixed when the vehicles are pushed away from the gasoline pumps and onto the Drivers with cars that have keyless entry systems are the ones affected by the problem, which has been happening for six weeks. Martyn Lamb has run into problems since September when gassing up his Ford Focus at the station. “This is the only place I am having this problem. It lets me in, but then I get a display on the dashboard saying ‘key not detected,’” said Lamb.
A deliveryman had witnessed at least eight vehicles incapacitated last week, which blocked the pumps and station. “I had to push one woman's car off the forecourt and clear of the canopy and then it worked fine,” he said.
A Tesco spokesman said they were looking into the problem and checking equipment, but no obvious cause was immediately apparent. He added that the machinery had not been changed recently, too. The mystery continues to baffle motorists and Tesco alike.
Seattle Considers Ban on Plastic Bags
The proposal would prohibit plastic carryout bags and would charge a nickel for paper bags.
SEATTLE – Seattle is poised to become the latest locality to ban plastic bags at retailers, the Seattle Times reports. On Monday, Councilman Mike O’Brien introduced the measure, which has seven of the nine members already on board.
Hilex Poly, the biggest maker of plastic bags in the country, called the plan “simplistic. While we expect the proposed ban to unfortunately be approved, we strongly believe that punishing consumers is the wrong approach to reducing plastics litter. In your rush to pass a ban, Seattle is missing an opportunity to lead the way in reducing plastics litter and creating green jobs,” wrote Mark Daniels, Hilex Poly vice president for sustainability and environmental policy, in a letter to the council. The company would prefer a statewide proposal that would promote and enlarge recycling of plastics.
Two years ago, Seattle voters shot down a proposal that would have banned plastic bags. California has many cities that ban plastic bags, including Santa Cruz, Long Beach, Oakland, Palo Alto, San Francisco and Santa Monica. Portland, Ore., also now forbids plastic bags at retailers. Irish retailers are upset that a bag tax is harming their business.
California to Ban Styrofoam Containers?
Restaurant owners balk at proposal
SACRAMENTO, Calif. -- Restaurant owner Gary Honeycutt says a push in California's state Legislature to ban the plastic foam containers he uses to serve up takeout meals could cost him thousands of dollars in an industry where profit margins already are razor thin, according to a report from Associated Press.
BJ's Kountry Kitchen, in the heart of California's farm country, uses about 26,000 of the 9-inch foam clamshells a year, mostly for takeout by the customers who come in for the restaurant's popular breakfast omelets.
"We put cheese on those omelets. And when we put the cheese on, it's really hot and bubbly and it goes right through the biodegradable stuff," he told AP. He expects his costs would more than double if the state requires him to use only biodegradable cartons.
The bill by Democratic state Sen. Alan Lowenthal, would prohibit restaurants, grocery stores and other vendors from dispensing food in expanded polystyrene containers, commonly known as Styrofoam, beginning in 2016. If signed into law, the measure would make California the first to institute a statewide ban on such containers. More than 50 California cities and counties already have similar bans. Lowenthal said litter from the foam containers is one of the most abundant forms of debris found in city streets, sewers and beaches.
"It's not biodegradable, it's not compostable, and if it's in the water for a long time, it breaks up into small beads and lasts for thousands of years. It costs millions to clean up beaches," he said.
Opponents of the bill say it fails to address the root cause of litter: the litterers themselves. Litterbugs will toss out the containers whether they're made of polystyrene or biodegradable cardboard, said Michael Westerfield, corporate director of recycling for Dart Container. "At the end of the day, people that litter don't care what type of product they're littering," he said.

FinCEN Announces Launch of FinCEN Updates E-mail Subscription News Service
The Financial Crimes Enforcement Network (FinCEN) today announced the launch of FinCEN Updates – a new, free
e-mail subscription management service designed to keep the financial industry, the media and the public informed of news, rulemakings, advisories and other developments at FinCEN. This new secure e-mail subscription management service permits users to customize their updates, which enables them to receive e-mails related to the topics to which they have subscribed.
FinCEN Updates allows users to choose their subscription preferences. Subscription items include advisories, guidance, news releases, rulings, enforcement actions, and current career opportunities at FinCEN. Users can add or delete subscription items themselves, and have the option to password protects their accounts for increased security. Users can opt to have FinCEN Updates sent immediately, daily, weekly, or monthly to their e-mail accounts or directly to a wireless device.
FinCEN selected the GovDelivery® E-Mail Subscription Management service to monitor designated website content and to send an e-mail to alert subscribers when there is new information posted on FinCEN’s public websites. Subscribers will receive e-mails from the
Financial Crimes Enforcement Network at the address fincenupdates@.
