ALR-FCIL ASSIGNMENT 2:

Public International Law – Multilateral and Foreign Treaties

Please provide a research diary for each numbered question. Also please provide correct citations for all legal documents (consult Bluebook Rule 21 and Table 2)

1. Last week I gave you the definition of a “treaty” from the Vienna Convention on the Law of Treaties.

a. Provide the official citation to the specific article from which this definition came from

b. When did this treaty enter into force?

c. Did the US ratify this treaty? If so, when?

d. Which two countries did the US issue its objections on?

e. Do we have any background documents on the construction and implementation of this treaty in our collection?

2. You are working for an international human rights group who focuses on protecting the rights of children.

a. Locate a leading multilateral treaty on this topic and provide its official citation. [Hint: If you do not know which one would be considered “leading”, try looking to a secondary source]

b. Your current area of work is in Armenia. Is this treaty binding on this jurisdiction (i.e., have they ratified it?), and, if so, what type of ratification do they have?

i. Optional: Why did they ratify it this way? [Hint: consider the dates involved]

3. Locate the official full text source of the North American Free Trade Agreement for any one (or all, if you’re feeling brave) of the countries who are a party to it.

a. Provide the official citation for the country whose version you are consulting.

b. Which chapter within the treaty discusses the procedure for resolving disputes?

c. Does the Max Planck Encyclopedia of International Law have an entry on NAFTA? If so, provide a citation to it.

4. The TV series The Tudors is co-produced by a Canadian and an Irish studio: "Ardmore Studios Ireland needed massive exterior shots of Tudor buildings so [they] explored the possibility of using a top visual effects company in Canada….as an official Irish-Canadian co-production. As Ireland has a treaty with Canada [on the issue of film production], [they] went into partnership with Peace Arch Entertainment Group.”

a. Locate the text of that treaty and provide an official citation

b. Locate evidence of Canadian or Irish state practice that might explain why they chose to enter into a treaty on this topic with each other. If you are having difficulties finding any, you may list a source that is not in our collection which might be a good place to look.

5. Suppose you want to argue that applying the death penalty to juveniles or persons with mental retardation violates customary international law. Identify one example of an authority recognized under art. 38 of the ICJ statute that supports this claim. Be sure to detail your process, key words, and sources used in locating this answer.
