2016 BOSTON BRANCH RULES AND REGULATIONS(25 OCT 16) General. The Boston Branch Planned Unit Development is entirely private property. It includes individually owned lots, developed and undeveloped, and notably includes the power line lots; and areas and assets owned by all Boston Branch Association members in common, which includes the roads, the lake, the dock, the dam, and commonly owned lots, including but not limited to the lots on which the playground and adjacent dock are located, the lots on which the dam is located and drains, and the “overflow” lot, across the street and slightly up from the community dock area.1.1 Boston Branch Planned Unit Development is entirely private property. The only persons entitled to be within the development are the following: (a) Lot owners (b) members of the immediate families of the owners (c) tenants or guests occupying property with consent of the owner (d) guests of the foregoing, but only when accompanied by their authorized hosts (e) persons authorized to perform services within the scope of their employment, pursuant to public duty, including public safety personnel [police, fire and ambulance/EMT personnel], school bus drivers, and mail carriers; as well as other bona fide private delivery services [UPS, FedEx and the like]; public utility workers, for purposes of completing required repairs and/or authorized installation or removal of equipment; and/or individuals performing other services pursuant to contract or other express invitation of the Boston Branch Association, property owners, and/or other authorized individuals named in (a)-(c) or, in limited circumstances (d), such as contractors, subcontractors and/or and repairmen.”Section 2 Lake2.1 No minnows or fish, of any kind, shall be used as bait or deposited in Boston Branch Lake by anyone without the express written consent of the Association. This rule is intended to control the fish population of the lake, and prevent the introduction of rough or incompatible fish.2.2 No gas powered boats shall be allowed on the lake.2.3 No fertilizer or foreign matter of any nature shall be introduced into the lake without the express written consent of the Association's Board of Directors. This rule is intended to reserve exclusively to the Association the right to control the health and growth of the fish population, and the type and growth of plants and algae. This facilitates monitoring and preserving the health of the lake.2.4 No trotline or other device of a similar nature shall be used in the lake. Jug fishing is allowed, but the jugs have to be attended, and must be removed when those using them leave.2.5 Members and guests are welcome to enjoy swimming, fishing and non-powered boating on the lake at their own risk. Boats are not permitted to enter the roped-off wading/swimming area.2.6 Long term parking on lot 2 or the boat ramp is prohibited. ?Access to the boat ramp must be kept clear at all times. Section 2, Lake; of the 2016 Boston Branch Subdivision Rules and Regulations is continued: 2.7 Boats: Owners are allowed to keep boats near the lake as long as they are in compliance with the following rules: All boats will bear a decal bearing a registration number issued by the Board and this number will be kept by the Board along with owners’ names and a picture of the boat.The Board will issue numbers annually to those who need them during Spring Cleanup Day and on an individual basis after that time by request. Inventory of boats will be undertaken by the Board throughout the year.Boats must be stored in such a way that they do not block the boat ramp and in a way that does not cause them to retain rain water, which provides a breeding ground for mosquitoes.Boats which are not registered with the Board or which are not in compliance with the rules listed above are subject to removal by the Board after notice is served at least twice over a four-week period by email and/or USPS. Removed boats will be stored in lot 44 for two months. If they are not claimed and brought into compliance, they will be sold, with proceeds going into the Association’s funds.Section 3use of common areasGeneral: This Section is intended to clarify rules concerning the use of the common area lots, road ways and bridle path rights of way.Note: The Association currently owns lot 2 (the dock lot), lot 44 (the lot to the East at the intersection of Hixson Springs Road and Boston Branch Circle, lot 35 (the dam & spillway wooded area), and wooded lots 87, 88, 91, 92, & 94 off of planned Adams Ridge road). The association also owns the improved roads within the subdivision (the portion of Hixson Springs Road which is inside of the subdivision, as well as Boston Branch Circle and Little Bend Road). The Association owns a real right in the bridle path rights of way, as shown on the Planned Unit Development (PUD) maps, except to the extent of any duly approved revision. 3.1 No person shall discharge firearms within the Boston Branch PUD for purposes other than to protect life or property. Owners and guests are expected to be aware of and obey all Tennessee laws concerning firearms. 3.2 Exploding, igniting, or using fireworks in common areas between the hours of 10:00 PM and 8:00 AM is generally prohibited, with the exception of New Year’s Eve and July 4th on which days the hours of prohibition shall be 12:30 AM - 8:00 AMSection 3, Use of Common Areas; of the 2016 Boston Branch Subdivision Rules and Regulations is continued:3.3 No means of transportation, including but not restricted to motorcycles, motorbikes, automobiles, and ATVs without mufflers and/or safety equipment as required by state law shall be used within the Boston Branch PUD. 3.4 Owners of property, the members of their immediate families, and their guests or tenants occupying property shall be responsible for the activities of their guests, and any violation of the rules by such guests shall be attributed to such owners, members of their immediate families, and their guests or tenants. 3.5 There shall be no loud or disorderly conduct in common areas, including, without limitation, the use of loud profane language, nudity, or noise of such a character as to constitute a nuisance. 3.6 Vandalism or malicious mischief against Association owned property, in addition to constituting a potential violation of public laws, is a violation of these rules. This includes, without limitation, the defacing or destruction of property in the dock area, the entrance security gate or any signs or reflectors used along the roadway, at the gate, or within the development. 3.7 There shall be no littering of any type within the common areas by owners or their guests.3.8 The speed limit in the subdivision is 25 miles per hour unless posted otherwise. Operators of vehicles within the Boston Branch PUD shall obey all posted traffic control signs or devices, maintaining due regard for public safety. 3.9 There shall be no reserving of common areas by Association members. Common areas are not to be used for business or organizational purposes. 3.10 The dam's drainage system service platform shall not be used for any activity other than official maintenance, or service of the drainage system. Members are encouraged to warn apparent violators of this safety issue, and to inform the Board of visible hazards.3.11 Open burns are prohibited on Association common areas, unless prior coordination is made with the Board of Directors. ? 3.12 The Association will maintain the "bridle path" rights of way adjacent to the Boston Branch Planned Unit Development road network (in most cases 6 feet from the pavement on each side of the roadway). Signs, parking or permanent objects (other than the erection of a mail box), are not authorized within the “bridle path” rights of way.3.13 The State's leash law for dogs applies within the subdivision, and owners are responsible for complying with the State's leash law for dogs.3.14 Owners will coordinate with the board member managing the gate to obtain access for entrance into the community. All owners will be afforded the options of purchasing remotes and or prox cards for their personal and immediate family access to the subdivision. Gate directory remote access capabilities are a service offered to members who are current with their assessments or fees. Section 4Overall4.1 Violation of any rule by any owner of property, the members of the immediate families of such owner, or the guest or tenants of such owner or of the members of the immediate family shall terminate the right of such owner, members of his immediate family and his guests and tenants to the use of any common area in the Boston Branch Planned Unit Development for such period of time as may be determined by the Association. The board will deal with such cases in accordance with its Bylaws.4.2 The foregoing sanction for violation of a rule shall not be in lieu of but shall be in addition to any other remedies available to the Association, including, without limitation, application for civil or criminal remedies.4.3 A person violating any of these rules and any owner whose family members, service providers/contractors, guests or tenants violate any of these rules shall be liable for any damages caused by such violation.4.4 Reports of violations of these rules and regulations may be made to the Board of The Association, which may take action or refer the matter to a committee. Owners are encouraged to address violations with their fellow owner/association members before elevating an issue to the Board of Directors.4.5 Unknown or suspicious persons/activity should be reported to the Sheriff's 911 number for emergencies and the non-emergency number when requesting a patrol to investigate suspicious activity or individuals. The neighborhood watch team should also be notified. ................
