PURPOSE/MECHANICS

BR 121 creates a special Breast Cancer Awareness license plate to be issued by county clerks after the Kentucky Breast Cancer Association collects a minimum of 900 applications and a $38 fee from each applicant, and makes application to the Transportation Cabinet for its design and printing. If the 900 applications are not submitted within a year of the measure's effective date, Section 1. of the measure would expire.

County clerks would simultaneously collect and remit to the Transportation Cabinet a $25 state fee and a $10 fee which is forwarded to the Breast Cancer Research and Education Trust Fund, newly created under the measure. The measure appropriates the funds generated by the $10 fee to the Breast Cancer Research and Education Trust Fund for the purpose of supporting breast cancer research, treatment, education, screening, and awareness.

The fiscal impact of BR 121 on local governments is expected to be minimal to moderate. Increased administrative expenses would be incurred by the County Clerk in carrying out the activities required under the measure. However, the expenses would be offset in varying degrees by a $3 fee collected by the County Clerk at the time of issuance or renewal of the special license plate. County clerk offices issuing and renewing large numbers of the special license plates would be expected to collect sufficient fees to offset a major portion, if not all, of the additional expenses. Conversely, county clerk offices issuing and renewing small numbers of the special license plates would not be expected to collect sufficient fees to offset a sizable portion of the expenses.

It is not known as to how many residents will apply for the special Breast Cancer Awareness license plate. According to the federal Centers for Disease Control web site (), the American Cancer Society estimates 3,340 new cases of breast cancer will be diagnosed in 2004 among women in Kentucky, and 620 women will die of breast cancer in Kentucky.

The additional activities for which the County Clerk would be responsible in the initial issuance of the special Breast Cancer Awareness licensure plate include:

Storing that county's share of the special Breast Cancer Awareness license plates for the first 900 applicants;

Informing that county's share of applicants of the timetable and conditions for the issuance of the special plate; and

Collecting a $3 County Clerk fee when the applicant picks up the special plate.

Following issuance of the initial group of special license plates, the County Clerk would be

responsible for:

Issuing the special plate, collecting a $3 County Clerk fee, a state fee, and a fee for the Breast Cancer Research and Education Trust Fund;

Maintaining a special account for the Trust Fund fees and remitting the fees to the Transportation Cabinet;

Replacing free-of-charge any damaged, destroyed or stolen special license plates under specified conditions;

Storing special license plates returned by owners or lessees who sell or transfer or terminate a lease of a vehicle with the special plate;

Reissuing a regular license plate and certificate of registration upon payment of a $3 County Clerk fee for the current licensing period for any owner or lessee selling or transferring or terminating a lease of a vehicle with the special license plate;

Reissuing the special license plate free-of-charge for use on any other vehicle with a regular license plate and of the same classification and category owned by the person during the current licensing period;

Returning of the replaced regular license plates to the Transportation Cabinet.
