State Disability Insurance (SDI) established in 1946
SDI: Employees working in California must meet the following requirements:
? Earned at least $300 from which SDI deductions were withheld during their base period. The base period is the first four of the last five completed calendar quarters prior to the claim
? Be employed or actively looking for employment at the time of the claim
? Claims must be submitted no earlier than nine days after first day of disability begins, but no later than 49 days
SDI: Employers with payrolls in excess of $100 in a calendar quarter. There are few exceptions.
Paid Family Leave (PFL) effective July 1, 2004
PFL: Employees working in California must meet the following requirements:
? Earned at least $300 during their base period. The base period is the first four of the last five completed calendar quarters prior to the claim
? Be employed or actively looking for employment at the time paid family leave begins
? Claims may not be submitted prior to the first day family leave begins, but no later than 41 days after family leave begins
PFL: The PFL program applies to all California employers, regardless of size.
SDI and PFL: Employers do not pay for the California Disability Insurance (DI) and Paid Family Leave (PFL) benefits. Both are funded by workers through the State Disability Insurance (SDI) deduction from workers' paychecks.
SDI: ? Employees own disability (illness, injury, or pregnancy)
PFL: ? Care for a seriously ill family member ? Bonding with a newly born child, adopted minor child, or fostered minor child ? Military exigency
SDI: Provides an employee with up to 52 weeks of benefits. An employee's Weekly Benefit Amount (WBA) depends on annual earnings and is estimated as 60 to 70 percent of the wages earned 5-18 months before the claim start date and up to the maximum weekly benefit amount. Employees can estimate their WBA through benefit calculator.
PFL: Provides up to eight weeks of partial wage replacement for bonding with a new child or caring for a seriously ill family member every 12 months.

? 2022 Max Benefit Duration -- eight weeks
An employee's weekly benefit amount may be estimated using the state's PFL calculator.
SDI: On the eighth consecutive day of disability.
PFL: On the first day of leave.
SDI: 52 weeks
Exception: For employers and self-employed individuals who elect SDI coverage, the maximum benefit amount is 39 times the weekly rate.
PFL: Eight weeks in a 12-month period
SDI: An employer or a majority of their employees can apply to the Employment Development Department (EDD) if they want to use a Voluntary Plan (VP) instead of the mandatory SDI coverage. The employer must also post a security deposit with the EDD to guarantee they meet all obligations of the VP.
PFL: Instead of a state-run program, employers may elect to offer a private plan, referred to as a Voluntary Plan (VP). Employers must formally apply for voluntary plan approval with the Employment Development Department (EDD) before implementing the plan.
If an employer is subject to the provisions of the Family and Medical Leave Act (FMLA) and California Family Rights Act (CFRA), they may require an employee to take FMLA and CFRA leave at the same time as PFL. PFL provides benefit payments but not job protection. SDI contributions are paid by California workers through employee payroll deductions and do not provide job protection, only monetary benefits. Other laws such as the New Parent Leave Act (NPLA), Fair Employment and Housing Act (FEHA), and Pregnancy Disability Leave (PDL) may also apply and run concurrently when the leave is for the same qualifying reason.
