CA Paid Safe Sick & Kin Care Update Los Angeles Service Area, Southern CaliforniaFAQs for CaregiversEffective June 9, 2019What is the purpose of CA Paid Safe Sick & Kin Care laws? The intent of these laws is to enable caregivers to address health and safety needs without putting their own, or their families’ economic security at risk by allowing paid time off to address a variety of personal health and/or family member health related concerns. Changes to these two laws have resulted in the two laws essentially becoming the same, and the two laws running concurrent to one another. Effective June 9, 2019, in connection with these changes, PSJH Los Angeles Service Area (LASA) is also making some changes to our practice surrounding these two laws. Does CA Paid Safe Sick and Kin Care leave time apply to all caregivers in the LASA region? There are some exceptions based on benefit eligibility. Non PTO Earners: Caregivers (below .5 FTE) are eligible for CA Paid Safe Sick and have separate accrual banks for these paid hours. Accrual rates are not changing (see CA Paid Safe Sick Policy & CA Paid Safe Sick Policy for City of Santa Monica for details). Non PTO earners are not eligible for Kin Care (Kin Care guidelines require there be a PTO bank to pull from to cover requested time off).PTO Earners: Those earning PTO have CA Paid Safe Sick hours embedded in their PTO; they are not eligible for additional CA Paid Safe Sick time as our current PTO program satisfies the requirements under the law. PTO earners are eligible for Kin Care; it requires there be a PTO bank to pull from to cover requested time off. (See CA Kin Care Policy for additional details.)What were the changes to these laws?CA Paid Safe Sick applies to both PTO and non PTO earners. This has not changed.Kin Care applies only to PTO earners (non PTO earners are not eligible for Kin Care because the law requires that there be a PTO bank to pull from to provide the paid leave time). This has not changed.What has changed is that CA Paid Safe Sick and Kin Care leave time have essentially become the same leave time for PTO earners:Both laws now cover the same family membersBoth laws now cover the caregiver Both laws now cover the same kinds of reasons for time away from workBoth laws run concurrent to one another so when a PTO earner uses CA Paid Safe Sick time, they would also be using Kin Care for the same period of time off, and vice versa if the PTO earner has not used up all of the CA Paid Safe Sick time.Are there changes to Administration and Timekeeping of CA Paid Safe Sick or Kin Care?Yes there are some changes.CA Paid Safe Sick:Non PTO Earners:Continue to enter time in Kronos / use Safe Sick DayTime can be taken in 15 minute incrementsPTO Earners:Continue to enter time in Kronos / use PTO Safe Sick DayTime can be taken in 15 minute incrementsKIN Care:Non PTO EarnersNot eligible for Kin CarePTO EarnersRequest approval for time off requests through Sedgwick (this is a change). Sedgwick will approve (or deny) Kin Care requests and notify caregiver and their core leader after the request has been made.NOTE: Caregivers are also always expected to follow department call-in process to notify department of absences regardless of the kind of time off being requested.Is administration or timekeeping changing if I am exempt? No. For CA Paid Safe Sick, exempt caregivers (not on LTO program) continue to code time in Kronos as PTO Safe Sick CA EXPT. (Exempt caregivers should code time in full day increments only).For Kin Care, exempt caregivers (not on LTO program) can contact Sedgwick for additional information. Are CA Paid Safe Sick and Kin Care both protected leave time?Yes. Both CA Paid Safe Sick and Kin Care are protected leave time under California law. (Non PTO earners are not eligible for Kin Care). Approved time off needed for eligible reasons under these two laws is not subject to corrective action when the requested time off is 1) for a qualifying reason under Kin Care / CA Paid Safe/Sick; 2) the caregiver has the paid time to cover the full amount of whatever time off is taken; and, 3) the caregiver follows the required approval and/or documentation process. Corrective action will be administered in accordance with applicable policies and applicable CBAs. Why are changes being made to our practice surrounding these two laws?We are aligning our practice with changes to the law. The changes we are making to the administration of these two types of time off?will require that caregivers record CA Paid Safe/Sick time off using the proper code in Kronos in order to have the time counted as protected CA Paid Safe Sick time, and that those who are eligible for Kin Care call into Sedgwick to request and obtain approval for Kin Care time off. These changes will help us to?ensure we have an accurate record of protected time off taken by non-exempt caregivers under these two programs.How will core leaders track CA Paid Safe Sick and/or Kin Care to manage attendance? For CA Paid Safe Sick, core leaders will see hours taken in Kronos using a Genie located under the tab called TIMEKEEPING.? Caregivers can see CA Paid Safe Sick balances in ProvConnect under Leave Balances. (ProvConnect Lawson > Enhanced ESS > Pay > Leave Balances)For Kin Care, core leaders will see approved absences via emails from Sedgwick and per reports they can run on the new MY SEDGWICK website. Caregivers will also receive approval (or denial) emails from Sedgwick on Kin Care requests. They can also see Kin Care time taken on the new My Sedgwick website. Caregivers and core leaders can also call Sedgwick for information, or go to the HRPortal to check claim status or submit a leave request.Are caregivers required to give notice when they need to take CA Paid Safe Sick or Kin Care time off? Yes, if the need is foreseeable. If the need is unforeseeable, the caregiver should give notice as soon as practicable. Caregivers requesting time off under CA Paid Safe Sick and/or Kin Care are not responsible for finding a replacement to cover their missed shift(s).Can caregivers take protected time under CA Paid Safe Sick or Kin Care as unpaid time? Or are they required to take paid time?Non PTO earners (FTE below 0.5):? Not eligible for Kin CareMay choose to take CA Paid Safe Sick time as unpaid, but if CA Paid Safe Sick time is taken as unpaid time, the absence will be subject to the Attendance Policy as an occurrence. PTO Earners (FTE of 0.5 – 1.0)Required to use accrued PTO under our PTO Policy unless no PTO is available (PTO Policy requires that a caregiver use PTO for most absences, with a few exceptions)If time is taken as regular PTO and not documented in Kronos (for CA Paid Safe Sick), or called in to Sedgwick for approval (for Kin Care), the absence will be subject to the Attendance Policy as an occurrence. ??What if I have additional questions on these changes?Call local Human Resources or the HR Service Center at 888-687-3753, or submit your question via AskHR on the HR Portal. ................
