COMMISSIONER’S PROCEEDINGS
REGULAR SESSION
August 18, 2015
The Lyman County Commissioners met in regular session in the Conference Room in the Courthouse at Kennebec, South Dakota, August 18, 2015, at 8:30 a.m. with the following members present: Chairman Leroy Choal, Ryan Huffman, Steve Perry, Adam Ehlers, Kim Halverson and Auditor Pam Michalek.
CALL TO ORDER:
Chairman Choal called the meeting to order with the pledge to the flag.
APPROVE MINUTES:
Motion by Perry, seconded by Halverson to approve the minutes of August 4, 2015. All voting aye.

AUDITOR’S ACCOUNT, REGISTER OF DEEDS & CLERK OF COURTS FEES:
Motion by Halverson, seconded Ehlers to approve the Auditor’s Account with the County Treasurer, Register of Deeds fee report and Clerk of Courts fee report for July 2015. All voting aye.
AUDITOR’S ACCOUNT: Cash on hand: $1,759.67; Checks in Treasurer’s possession less than 3 days old: $13,470.15; BankWest Checking: $37,804.71; BankWest Savings: $2,493,635.79 Dakota Prairie CD’s: $653,171.33; 1st Dakota Bank CD’s: $107,651.88 for a total of $3,307,493.53. Of this amount the following entities received: State of SD: $77,230.36; School Districts: $33,311.02; Cities & Towns: $10,145.47; Townships: $6,238.92; WR/LJ Water District: $339.59; Vivian San District: $120.57; Lyman County Ambulance District: $1,272.26 for a total of $128,658.19.
REGISTER OF DEEDS FEES: $4,017.67 less $118.00 sent to SDACO for the Reg. of Deeds Modernization & Preservation Fund.
CLERK OF COURTS: $12,857.43 less $8,998.74 to Lyman School and $25.26 to Chamberlain School for fine money.
LAKE FRANCIS CASE DEVELOPMENT:
Lyman County’s Representative on Lake Francis Case Development Board Larry Larsen met with the Commission to provide information on proposed development projects.
MEDICINE CREEK RIDING CLUB:
Riding Club Representatives Charlie & Stacie Gran, Veronica Gerard, Jim Gilman and Skip Floyd met with the Commission to request 20 loads of sand for the arena and the possibility of receiving 5 loads annually. After discussion, motion by Halvorson, seconded by Perry to have the Highway Dept. provide trucking for one day, the riding club will pay for the sand and $1,500.00 will be added to the 4-H budget to provide sand/and or gravel at the arena annually. All voting aye.
SHERIFF MANGER:
Sheriff Manger provided information on two speed boards. No decision was made at this time. The Commission also gave Sheriff Manger permission to acquire a 4X4 HMMWV through the military 1033 program so the vehicle is free to the county.
HIGHWAY/WEED DEPT:
10:20 a.m. Supt. Long requested executive session. Motion by Perry, seconded by Ehlers to enter into executive session per SDCL 1-25-2. (1). All voting aye. 10:25 a.m. Chairman Choal declared the board out of executive session.
Motion by Perry, seconded by Huffman to accept a letter of resignation from Dave Fore and authorize Supt. Long to advertise for a full time highway department employee. All voting aye.
Board consensus is to keep two of the leased tractors from Noteboom for the winter months. Noteboom will add 250 hours to the contract at no cost to the county. The Commission reviewed a quote from Brad Hickey Construction for materials & labor to pour the Reliance Shop floor. Supt. Long will confirm various requirements before accepting the quote.
Supt. Long informed the Commission that Johnson Trucking will start grinding the asphalt September 14, 2015.
Motion by Huffman, seconded by Halverson to sign a sales agreement with Butler Machinery for a 2015 CAT 140M3AWDB Motor Grader for the purchase price of $279,799.00. All voting aye.
BUILDING PERMIT:
Motion by Huffman, seconded by Halverson to approve a building permit for Shay Littau, 115 2nd St, Vivian SD for placement of a 16 X 80 mobile home. All voting aye.
OPERATING TRANSFER:
Motion by Halverson, seconded by Ehlers to approve the following transfer done in April 2015: $204,085.00 from General Fund Operating Transfers to RB Fund Cash Balance. All voting aye.
2015 SUPPLEMENTAL BUDGET:
Motion by Perry, seconded by Halverson to authorize publication of the following 2015 Supplemental Budget. All voting aye.
Jail: $25,000.00, Court Appointed Attorney Fees: $50,000.00, Economic Development: $ 10,000.00 will be supplemented from General Fund Unassigned Cash Balance.
PRESHO CITY REQUEST:
Motion by Halverson, seconded by Ehlers to approve Presho City’s request for 100 ton of gravel at the airport. All voting aye.
EXTENSION:
The Lyman County Extension Office will no longer provide prairie dog bait. If you are in need of bait please call SD Dept. of Ag @ 605-773-3796.
ADJOURNMENT:
Motion by Ehlers, seconded by Huffman to adjourn until Tuesday, September 1, 2015 at 8:30 a.m. All voting aye.
