LYONS CITY COUNCIL MEETING

May 2, 2017

A regular meeting of the Mayor and Council of the City of Lyons was called to order by Mayor Andrew Fuston at 5:30 P.M., May 2, 2017, at the Lyons City Hall. Present were Council members Brink, Steinmeyer, and Wheaton. Housh Sr was absent. Also in attendance were City Attorney Smith, City Clerk Ritter and Utility Superintendent Daberkow.

Visitors at the meeting were Chad Brehmer, Jamie Horter of Lyons Mirror Sun, Mike Heavrin, and Terry Ueding.

The Mayor publicly stated to all in attendance that a current copy of the Nebraska Open Meetings Act was available for review and indicated the location of such copy posted in the room where the meeting was being held. Advance notice of said regular meeting was given to the Mayor and all members of the Council, and a copy of their receipt of such notice and the agenda is filed in the City Clerk’s office. Availability of the agenda was communicated by posting notices in three public places and in the notice to the Mayor and Council. All proceedings hereafter shown were taken while the convened meeting was open to the attendance of the public.

The meeting was called to order upon motion by Wheaton, second by Steinmeyer. All council members voted yes on roll call except Housh Sr who was absent.

Moved by Brink, seconded by Wheaton to approve the following consent agenda:

1. Dispense with reading of minutes of meetings held on April 4.

2. Claims as presented.

3. Treasurer report.

All council members voted YEA except Housh Sr who was absent.

Council Member Steinmeyer motioned to approve the Northeast Nebraska Economic Development District Agreement for services for $800 to update the Blight Study and attend council meetings, seconded by Brink. All voted yes on roll call except Housh Sr who was absent.

A short discussion was held on allowing chickens in city limits. The council voiced concerns about allowing chickens. The council was in agreement to not pursue changing the ordinance at this time.

Council Member Wheaton motioned to approve the Indirect Sales Agreement with Itron on new software for reading utility meters, seconded by Steinmeyer. All voted yes on roll call except Housh Sr who was absent.

Council Member Wheaton motioned to approve the Maintenance Agreement with Itron on the new software, seconded by Brink. All voted yes on roll call except Housh Sr who was absent.

The police report was handed out before the meeting. Council members voiced complaints received on police officers going too fast in the city limits in responding to calls.

Mike Heavrin presented the Library Report and Grants Report.

The City will install a 4 inch water line with curb stop from the City’s 6 inch water main on the City’s right of way for property owned by Dan Nielsen on North 5th Street. Mr Nielsen can then tap into the 4 inch water line with curb stop. Discussion was held on the electrical service for Brehmer Mfg expansion. Estimated preliminary costs are approximately $40,000 due to a larger 1500 KVA transformer for around $15,376, the material list needed to be changed for the increased load, and billing from Schmader Electric for this project. The City will have RVW engineers from Columbus Nebraska to go over the project before it is started. There were 5 dumpsters and 2 metal dumpsters filled at the City’s spring clean-up. The newly hired utility employee is working out great. Karr Tuckpointing has completed replacing bricks and tuck pointing on the east side of the Community Center. The Library’s caulking and tuck pointing was also completed. In late March, the Nebraska State Fire Marshall Office conducted a gas records inspection and recommended updates. These updates have been completed and were found to be satisfactory. The first annual discharge of the wastewater lagoons was completed by the City crew. Results of the two samples were found to be below the required limits.

City Clerk Ritter reported on the General, Utility, and Debt Service Income Statements for the month ending April 30, 2017. The General side had a month to date net loss of $18,619 and a year to date net loss of $64,342. The Utility side had a month to date net gain of $43,488 and a year to date net gain of $165,644. Debt Service had a month to date net gain of $10,712 and a year to date net loss of $52,520. Budget reports for the General and Utility side were as follows: General had expended 42.56% of its fiscal year budget in the first seven months. The Utility side had expended 46.28% of its fiscal year budget. Seven month average is 59%. The Council agreed to the request by the City Clerk to attend the League’s 2017 Municipal Accounting and Finance Conference in Kearney, June 14-16, 2017.

Council Member Wheaton motioned to approve increasing the rate of the pool season passes and pool party rates as follows: Family season pass at $110 with family definition as immediate family with all children living at home who are high school age and under, Single season pass at $60, 1 hour Pool Party at $100, and 1.5 hour Pool Party at $125, seconded by Steinmeyer. All voted yes on roll call except Housh Sr who was absent.

Council member Wheaton motioned to approve the recommendation from Mayor Fuston of hiring the following for the 2017 pool season - Pool Manager/Lifeguard: Kursta Rische; Assistant Managers/Lifeguards: Taylor Fuston and Brianna Wegner; Lifeguards: Dayne Wortman, Thomas Fuston, Hunter Ferguson, Joey O’Connor, Brandi Simonsen, Ella Whitaker, and Jacob Whitaker, seconded by Brink. All voted yes on roll call except Housh Sr who was absent. The Mayor stated as more applications come in, we need to be flexible to hire before the pool opens.

Council Member Steinmeyer motioned to approve the building permit to Brehmer Manufacturing for an addition to existing buildings at 825 Main St, Lyons, NE, seconded by Brink. All voted yes on roll call except Housh Sr who was absent.

Council Member Steinmeyer motioned to approve the building permit to Logan Valley Baptist Church for a new church construction at 265 S 4th St, Lyons, NE, seconded by Wheaton. All voted yes on roll call except Housh Sr who was absent.

Council Member Steinmeyer motioned to approve the building permit to Jon Ronnfeldt for an enclosed deck at 725 S 7th Ave, Lyons, NE, seconded by Wheaton. All voted yes on roll call except Housh Sr who was absent.

Council member Brink moved to enter into Executive Session, seconded by Wheaton at 6:39 p.m. to discuss personnel for the prevention of needless injury to the reputation of an individual(s). All present voted yes on roll call. The meeting returned to Regular session at 6:57 p.m.

Council member Steinmeyer motioned to approve increasing the rate of pay to $18.00 an hour for Will Dyer and increasing the rate of pay to $20.00 an hour for Terry Ueding, seconded by Wheaton. All voted yes on roll call except Housh Sr who was absent. Followup on wages for the Police and City Office personnel will be considered during the next budget process when salary surveys for the positions will be reviewed.

The meeting was adjourned at 7:00 P.M., upon motion by Brink, seconded by Wheaton. All council members present voted yes on roll call.
