How to Use This Chapter?

FOR LAND DIVISIONS

DEFINITIONS.

Partition – A land division resulting in 3 or fewer lots.

Subdivision – A land division resulting in 4 or more lots.

Lot consolidation – The reduction in lots by eliminating common lot boundaries.

Replat - Reconfiguring, increasing or decreasing lots in a platted subdivision or partition.

The land division process is basically the same in all zones with differences in dimensional and infrastructure standards.

Notes:

1. Creating a separate tax lot with the Assessors Office does not constitute a new legal lot. All standards in this chapter (lot size, setbacks, and use restrictions) are based on legal lots.

2. Deeding property without local planning approval or a plat map creates an illegal lot. All new lots shall be approved by the local jurisdiction and recorded on a plat.

Process:

• Look up the dimensional standards in the dimensional standards table for the appropriate zone. Standards include:

▪ Minimum lot size for residential zones

▪ Public Street frontage

▪ Setbacks

▪ Lot coverage

• Determine if public infrastructure is necessary. (The City has a “to and through” standard for streets, water and sewer meaning these utilities are required to be constructed not only to a development property but also across the entire width of the property).

▪ New streets

▪ Possible additional street right-of-way if existing does not meet standard.

▪ Water and sewer lines

▪ Other serving utilities

• Once lots are approved a final plat is required by a licensed surveyor.

• Prior to signing the final plat for recording with the County Clerk, all infrastructure required by the decision shall be constructed or bonded for.

FOR NEW CONSTRUCTION

Process:

• Determine Zone of development site.

• Verify that intended use is allowed within that zone.

• Determine whether the application would be processed as an outright use (administrative), type I conditional use (public hearing may be required) or type II conditional use (public hearing required).

• Determine whether a design review application is required.
