Section 46-37(a) of the Code of Ordinances lists the criteria to be considered in

determining a variance to zoning requirements. Please address the criteria below.

(c)

Variance criteria.

(1)

General.

a.

If, upon consideration of the variance criteria set out in this subsection

and (c)(2) below, it is determined that the case for approving a

variance clearly outweighs the case for denial, the variance may be

approved, providing that:

1.

The variance does not permit the establishment or enlargement

of any use or structure devoted to a use which is not permitted

in the district in which the variance is requested;

wall signage for the retail business and not for any change to the structure itself.

The variance will be consistent with the comprehensive plan.

It is our understanding that this particular site is under the standard sign code that no wall sign shall

exceed 80 square feet. We feel that we comply with the City's concern with the overall

________________________________________________________________________

appearance, design and its overall concept.

Specific.

a.

Prior to approving, approving with conditions or denying a variance,

city council shall consider and determine, based upon substantial

competent evidence, the following criteria:

1.

Whether the plight of the applicant is due to unique

circumstances not created by the applicant, an agent of the

applicant or a predecessor in title of the applicant;

Our primary concern is visibility. This particular location is a unique location due to its overall size and distance from US Highway 41 /

Tamiami Trail. The strict application of the code creates an unfair hardship in this case by only allowing 80 square feet of signage.

The signs that we are requesting in the variance are imperative to the overall visibility to this location and it's overall appearance.

Whether special conditions or circumstances exist which are

peculiar to the land or structure involved, and which are not

applicable to other lands or structures in the same

neighborhood or district;

The one special condition and circumstance that is existing, is the storefront from the property line . The store sites

________________________________________________________________________

back several hundred feet. We feel that smaller signs will not give the store the visibility needed. Visibility being the

________________________________________________________________________

key factor in our request for this variance, we feel that we would have an undo hardship with smaller signs.

Whether the failure to grant the variance would result in

unnecessary and undue hardship to the property;

This location is a newly rebuilt store in Publix's effort to upgrade its overall appearance. It became evident to Publix Inc., that

________________________________________________________________________

this particular location would greatly serve the general public of the City of Naples. Therefore, it was Publix's decision to upgrade

________________________________________________________________________

and rebuild this facility. Now it becomes imperative that we be allowed to properly identify this location with adequate signage.

Whether the failure to grant the variance would deprive the

owner of the reasonable use of the property;

No, this location has served the general public in the Naples area for several years and it became one of

________________________________________________________________________

the key locations in the Naples area. This is one of the reasons Publix decided to keep this store in

________________________________________________________________________

the family and proceed with the extensive rebuild.

________________________________________________________________________

5.

Whether the variance will promote, or will not be inimical to, the

health, safety and welfare of the community;

Publix health, safety and welfare are one of the key reasons why our request for signs that provide

________________________________________________________________________

greater visibility for the general public and/or visitors to locate this store. This will also serve to give

________________________________________________________________________

the general public safe and easy identification for safe access to the property.

6.

Whether the variance will be otherwise consistent with and in

harmony with the general intent and purpose of this land

development code;

The general intent of the land development code is to allow signage for each business that is architecturally pleasing to the eye, proportional to the

________________________________________________________________________

structure and provide the general public with safe access to the property. In our proposal, we feel we are complying with the general intent of the code with a

________________________________________________________________________

minimum request. The front elevation for this store is approximately 322' ft. long by 35' ft. tall. Our request is for less than 10% of the overall fascia of the building.

Whether the variance is the most practical or logical solution to

the need for relaxation of the literal requirements of this land

development code;

We feel that our request is the most practical and logical solution; our request is the minimum requirement

________________________________________________________________________

needed in order to satisfy our hardship of adequate signage for this location. The land development code is

________________________________________________________________________

concerned with design, visibility and overall appearance. We feel that our request satisfies all three areas.

neighborhood or adjacent properties.

Yes, the overall face lift and remodel of this location will more than adequately add to the

overall ambiance of the surrounding neighborhood and properties.
