The regular monthly meeting of the Board was called to order by the Chairman at 9:30 a.m. in the Conference Room of the Board’s offices, Baton Rouge, Louisiana. Members of the Board present:

Finding a quorum present, the regular order of business began.

Also attending the meeting were: Michael B. McDuff, Executive Director; Judy Dupuy, Board Administrator; Judge Darrell White, Retired, Hearing Officer; Stephanie Laborde, Board Attorney; and from the staff, Bobbie Hughes, Brent Templet, Doug Traylor, Kris Fitch, Bertha Jenkins, Kellie Prudhomme, Deborah Irwin and Ms. Sharon Fabre; Compliance Investigator Todd Brady; Johnny Rogers, Tommy Mimnaugh and Ms. Keri Dupont, recording the minutes.

Mr. Victor Weston led the members and audience in the Pledge of Allegiance.

Judge Darrell White gave the invocation.

Judge Darrell White then introduced himself, and advised those present of his duties.

A Motion was made by Mr. Weston and seconded by Mr. Stuart to accept the Minutes of the April 21st, 2011 regular meeting. The Motion passed.

NEW BUSINESS

QUALIFYING PARTY HEARING(S):

Administrative Hearing – Consider suspending or revoking your Louisiana Contractor’s License number 47725, held by Flanigan Real Estate Resources, Inc., for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.

Ms. Fitch read the allegations and asked if a representative was present. No representative was present.

A Motion was made by Mr. Clouatre and seconded by Mr. Meredith to revoke License number 47725.

The Motion passed.

Administrative Hearing – Consider suspending or revoking your Louisiana Contractor’s License number 41090, held by Offshore Marine Contractors, Inc., for reason, that on information and belief the qualifying party for your firm has terminated employment with your firm and no other qualifying party has qualified despite sixty (60) days elapsing, all according to Section 2156.1 of the Contractors’ Licensing Law and Section 103 of the Rules and Regulations of the Board.

Ms. Fitch read the allegations and asked if a representative was present. No representative was present.

A Motion was made by Mr. Clouatre and seconded by Mr. Graham to revoke License number 41090.

The Motion passed.

JUDGMENT HEARING(S):

Administrative Hearing – Consider an alleged violation by Assured Plumbing, LLC of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the 1st Parish Court, Number 149-527, Division “I”, Parish of Jefferson, State of Louisiana, on the 10th day of December, 2009, in which you, Mr. Kennedy, and Assured Plumbing, LLC, holder of Commercial Contractor’s License number 49242 were ordered to pay in the amount of SIXTEEN THOUSAND EIGHT HUNDRED THIRTY-FIVE DOLLARS AND 67/100 ($16,835.67), plus attorney’s fees in the amount of twenty-five (25%) percent plus legal interest from the date of judicial demand, on August 28, 2009, until thereafter paid and for all costs of this proceeding in favor of Southland Plumbing Supply, Inc.

Ms. Laborde read the allegations and asked if a representative was present. Trey Lape, attorney, appeared on behalf of the Judgment Creditor, Southland Plumbing Supply. Mr. Lape informed the Board that the Judgment has not been satisfied. Mr., Gerry Kennedy, owner, of Assured Pluming, LLC. appeared, and was sworn in, and made a statement.

A Motion was made by Mr. Clouatre and seconded by Mr. Fenet to give Mr. Kennedy 6 months to resolve the outstanding matter with the Judgment Creditor. If the Judgment is not satisfied within that time, Assured Plumbing LLC.’s License will be immediately revoked. The Motion passed.

Administrative Hearing – Consider an alleged violation by Bullard Capital, L.L.C. of the provisions of Louisiana R.S. 37:2150 - 2192, the Contractors’ Licensing Law, and in particular Section 115, Paragraph C, of the Rules and Regulations of the Board and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief you have a judgment which was rendered by the Civil District Court, Docket Number 2010-11800, Division “K-5”, Parish of Orleans, State of Louisiana, on the 16th day of February, 2011, in which Bullard Capital, L.L.C., holder of Commercial Contractor’s License number 46768, was ORDERED, ADJUDGED AND DECREED that the Petition to Confirm Arbitration Award be GRANTED and they were ordered to pay in the amount of ONE HUNDRED THIRTY SIX THOUAND FOUR HUNDRED DOLLARS AND 00/100, ($136,400.00), plus judicial interest on $120,714.00 from July 14, 2009 until November 5, 2010, and then judicial interest on the full $136,400.00 from November 5, 2010 until paid. Further, a judgment is entered in favor of Dr. Chandan Prasad against Bullard Capital, L.L.C. for the arbitrator’s fees in the arbitration, also contained within the Arbitration Award being confirmed, in the additional amount of $8,300.00 in favor of Dr. Chandan Prasad.

Ms. Laborde read the allegations and asked if a representative was present. Bradley Aldrich, attorney, appeared on behalf of the Judgment Creditor, Dr. Chandan Prasad. Mr. Aldrich informed the Board that the Judgment has not been satisfied.

A Motion was made by Mr. Meredith and seconded by Mr. Graham to give Bullard Capital, LLC, 6o days to resolve the outstanding matter with the Judgment Creditor. If the Judgment is not satisfied within that time, Bullard Capital, LLC.’s License will be immediately revoked. The Motion passed.

Compliance Hearing(S):

Administrative Hearing – Consider an alleged violation by B. Richard Construction, L.L.C. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, B. Richard Construction, L.L.C., acted as a contractor to perform work on the Subway Sandwich Shop project at 422 Highway 30, Gonzales, Louisiana in the amount of $74,966.00 without possessing a Louisiana State contractor’s license.

Ms. Bobbie Hughes read the allegations against B. Richard Construction. Mr. Quinn “Bubba” Richard, Owner of B. Richard Construction, appeared and was sworn in. Mr. Richard entered a No Contest plea.

A Motion was made by Mr. Dupuy and seconded by Mr. Clouatre to accept the plea of No Contest. The Motion passed.

A Motion was made by Mr. Dupuy and seconded by Mr. Weston to impose a fine of $1000.00 plus Court Costs. The Motion passed.

A Motion was made by Mr. Gallo and was seconded by Mr. Clouatre to allow the completion of the project if an application is submitted to the Board within 7 days of the Hearing. The Motion passed.

Administrative Hearing – Consider an alleged violation by Bayou Electrical Services, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Bayou Electrical Services, Inc. entered into a contract with an unlicensed contractor to perform work on the Subway Sandwich Shop project at 422 Highway 30, Gonzales, Louisiana in the amount of $16,000.00.

Ms. Bobbie Hughes read the allegations against Bayou Electrical Services, Inc. Mr. Anthony Austin, Jr., Co-Owner of Bayou Electrical Services, Inc., appeared and was sworn in. Mr. Austin admitted the allegations.

A Motion was made by Mr. Dupuy and seconded by Mr. Clouatre to accept the admission. The Motion passed.

A Motion was made by Mr. Dupuy which was seconded by Mr. Gallo to dismiss. The Motion passed.

Administrative Hearing – Consider an alleged violation by Austin Heating and Air, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Austin Heating and Air, Inc. entered into a contract with an unlicensed contractor to perform work on the Subway Sandwich Shop project at 422 Highway 30, Gonzales, Louisiana, in the amount of $11,645.00.

Ms. Bobbie Hughes read the allegations against Austin Heating and Air, Inc. Mr. Anthony Austin Jr., Owner of Austin Heating and Air, Inc., appeared and was sworn in. Mr. Austin admitted the allegations.

A Motion was made by Mr. Dupuy and seconded by Mr. Clouatre to accept the admission. The Motion passed.

A Motion was made by Mr. Dupuy which was seconded by Mr. Gallo to dismiss. The Motion passed.

Administrative Hearing – Consider an alleged violation by Case Services L.L.C. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Case Services L.L.C. acted as a contractor to perform work on the Tulane Avenue Apartments project in Lafayette, Louisiana, in the amount of $70,718.94 without possessing a Louisiana State contractor’s license.

Ms. Bobbie Hughes read the allegations against Case Services, LLC. Oneil Cormier, Owner, Case Services, LLC, appeared and was sworn in. Mr. Cormier entered a No Contest Plea.

A Motion was made by Mr. Meredith and seconded by Mr. Weston to accept the plea. The Motion passed.

A Motion was made by Mr. Weston which was seconded by Mr. Fenet to impose a fine of $1000.00 plus Court Costs. The Motion passed.

Administrative Hearing – Consider an alleged violation by Vigoureux Construction, L.L.C. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Vigoureux Construction, L.L.C. entered into a contract with an unlicensed contractor to perform work on the Tulane Avenue Apartments project in Lafayette, Louisiana, in the amount of $70,718.94.

Ms. Bobbie Hughes read the allegations against Vigoureux Construction, LLC. Amanda Dominique, Owner, Vigoureux Construction, LLC, appeared and was sworn in. Ms. Dominique admitted the allegations.

A Motion was made by Mr. Meredith and seconded by Mr. Weston to accept the admission. The Motion passed.

A Motion was made by Mr. Weston which was seconded by Mr. Fenet to impose a fine of $1000.00 plus Court Costs. The Motion passed.

Administrative Hearing – Consider an alleged violation by Vela’s Coating, Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Vela’s Coating, Inc. acted as a contractor to perform work on the Water Towers Re-painting project on Lincoln Road in Ville Platte, Louisiana in the amount of $226,885.00 without possessing a Louisiana State contractor’s license.

Ms. Bobbie Hughes read the allegations against Vela’s Coating, Inc. John Andrishok, Attorney, appeared. Mr. Andrishok presented a settlement offer to the Board consisting of a No Contest plea and a fine of $1500.00.

Mr. Mario Vela appeared and was sworn in.

Mr. Andrishok asked the Board for a continuance until the end of the Agenda. The continuance was granted.

Mr. Andrshok presented a second settlement offer to the Board consisting of a No Contest plea and a fine of $4000.00 plus Court Cost, and if Vela’s Coating, Inc. submits an application to the Board within 30 days, the fine will be reduced to $3000.00 plus Court Costs.

A Motion was made by Mr. Meredith and seconded by Mr. Lambert to accept the settlement offer. The Motion passed.

Administrative Hearing – Consider an alleged violation by Utility Service Co., Inc. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2158 (A,4), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Utility Service Co., Inc., entered into a contract with an unlicensed contractor to perform work on the Water Towers Re-painting project on Lincoln Road in Ville Platte, Louisiana, in an amount in excess of $50,000.00.

Ms. Bobbie Hughes read the allegations against Utility Service Company, Inc. John Andrishok, Attorney, appeared. Mr. Andrshok presented a settlement offer to the Board consisting of a No Contest plea, a fine of $1000.00 and $500.00 in Court Costs.

A Motion was made by Mr. Clouatre which was seconded by Mr. Lambert to accept the offer. The Motion passed.

Administrative Hearing – Consider an alleged violation by Trademark Homebuilders L.L.C. of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, Trademark Homebuilders L.L.C., acted as a contractor to perform work on the Renovations- Nazarene Baptist Church project in Baton Rouge, Louisiana in the amount of $188,000.00 without possessing a Louisiana state contractor’s license.

Ms. Bobbie Hughes read the allegations against Trademark Homebuilders, LLC, and asked if a representative was present. No representative was present. Ms. Laborde called Mr. Todd Brady to the stand and he was sworn in. Ms. Laborde asked Mr. Brady, Investigator, to review and identify the documents in the exhibit package. Ms. Laborde asked that the exhibit package be introduced into the record. Judge White admitted the package.

A Motion was made by Mr. Meredith and seconded by Mr. Weston to find Trademark Homebuilders, LLC. in violation. The Motion passed.

A Motion was made by Mr. Meredith and seconded by Mr. Weston and Mr. Fenet to fine Trademark Homebuilders, LLC, 10% of $188,000.00 plus Court Costs. The Motion passed.

old BUSINESS

COMPLIANCE HEARING– CONTINUANCE:

Administrative Hearing – Consider an alleged violation by Ron Clausing of the provisions of Louisiana R. S. 37:2150-2192, the Contractors’ Licensing Law, and in particular Section 2160 (A,1), and consideration of applicable penalties therein. This hearing is being called for reason that on information and belief, you acted as a contractor to perform work on the Clark Custom Co., Inc. Grain Bin System project in MerRouge, Louisiana in an amount in excess of $50,000.00 without possessing a Louisiana State contractor’s license.

Ms. Bobbie Hughes read the allegations against Ron Clausing. Mr. Todd Hebert, Attorney, appeared and made a settlement offer to the Board which included a plea of No Contest and a fine of $7500.00.

A Motion was made by Mr. Weston to impose a fine of $2500.00 which was seconded by Mr. Badeaux. The Motion did not pass.

Mr. Stuart made a substitute Motion to accept the original offer which was seconded by Mr. Meredith and Clouatre. The Motion passed.

Mr. Weston asked for a hand vote on Mr. Stuart’s Motion. The Motion passed.

COMMITTEE REPORTS:

Report from the Staff and Discussion

Mr. McDuff informed the Board that it has received Legislative authority to name the Louisiana State Licensing Board for Contractors Building after Mr. Preston Eggers and should have that prepared for later in the year.

Mr. McDuff also informed the Board of the status of the Home Lifting and Leveling clarification memorandum.

Mr. McDuff discussed the Conditional Licensing Agreement.

Mr. Badeaux made a Motion to accept and adopt the Conditional Licensing Agreement which was seconded by Mr. Gallo. The Motion passed.

Building Committee

Mr. Graham stated there was no additional report at this time.

Classification and Testing Committee

No Report.

Legislative/Rules and Regulations Committee

Mr. McDuff informed the Board of the Bills in the Legislature that are currently being tracked.

Act 725 Committee

Mr. Meredith had no report.

Finance Committee

Mr. Dupuy briefed the Board on the Financial Reports and the Audit status. Mr. Dupuy made a Motion to accept the Financial Reports as given, which was seconded by Mr. Gallo. The Motion passed.

Consideration of residential applications, home improvement registrations, and residential waivers as listed and attached to the agenda.

RESIDENTIAL WAIVER REQUESTS

NORRIS J. GREMILLION CONSTRUCTION, LLC, Covington, LA

The firm is applying for a license with the classification of Residential Building Construction.

This firm is requesting waiver of the Residential Building Contractor examination in order to allow Mr. Norris Jude Gremillion, Member, to be listed as qualifying party and the application be approved pending all requirements being met.
