Mott, Attorney for the College Park Association. Attorney Mott is affiliated with Mollica Gall Sloan & Sillery, Athens, Ohio 1. Call to order at 4:40 PM on August 28, 2017.2. Disposition of July 17, 2017 Board meeting minutes.3. David Mott’s Legal Advisement based on Ohio Revised Code and College Park Homeowners Association Bylaws a. According to the Bylaws, the current elected Board members organize and conduct a special meeting to elect a homeowner to serve for seven months to fill the vacancy on the Board. On May 20, 2017, Chuck Yeago was re-elected to serve one year, but resigned because he has sold all his properties at College Park. David Mott agreed to draft a letter to inform all homeowners about the schedule for the special meeting and include instructions for nominating and voting for a new Board member. The Board decided to conduct that special meeting at 10 AM on Saturday, November 11, 2017, at 5 Depot Street, Athens, Ohio 45701. Beside drafting the ballot for voting for a new Board member, David Mott would provide an additional ballot so homeowners could to vote on a revision to the College Park Homeowners Association Bylaws to change the procedure to fill a vacancy on the Board. Suzanne Ragg proposed that when a vacancy occurs the remaining members select a new Board member without holding a special meeting. David Mott summarized that a majority of the votes would be needed to elect a new member to the board. The names of the candidates need to be included on the ballot that is sent out. With thirteen or more proxy votes, a person could be selected as the replacement. However, in the case of changing/amending the Bylaws, seventy-five percent of the homeowners should agree (thirty-eight - fifty proxy votes ) to the revision. The special meeting documents will be printed and mailed along with a self-addressed envelop so homeowners return their ballots within the deadline prior to the November 11th special meeting. b. David Mott confirmed that Board members could conduct meetings via conference calls if they could not travel to the meeting venue. c. David Mott explained that one Board member could hold one or more executive positions, but the president should not also be the secretary. The required officers are: President, Vice President, Treasurer, and Secretary. Advisory committees or special committees can be organized on a needs basis. d. David Mott confirmed that Suzanne Ragg could send homeowners a letter to notify them that Athens Lock and Key would be scheduled to come to College Park to rekey locks for those units where the owners have not provided the College Park with a master key as per the terms of the Bylaws. Owners will be charged for the rekeying. In emergency cases, College Park officials need access to go into condos. If no master key is available, the owner will be financial responsible if their condo door needs to be damaged to get access. e. Regarding options to collect delinquent payments, David Mott specified: foreclosure procedures, file a lien, file for a judgment, or no action. He recommended foreclosure to relinquish College Park property ownership. David Mott advised the Board to take in consideration those options. He specified that Kara Cozort should cancel face-to-face meetings with homeowners. All future communication should be only in writing. Kara was instructed to apply any payment from that owner to pay the monthly condo fee first. David Mott agreed to review a letter that would be mailed out to a delinquent owner. No parking passes would be collected from the owner’s tenants at this time. He would provide updates about the delinquent owner. David Mott left the meeting.4. Treasurer’s Report from Kara Cozort, Manager Total amounts to date for the College Park Association funds at the Hocking Valley Bank: Checking $57, 388.22 Reserved: 42, 133.04 CD: 10, 227.35 TOTAL $109, 748.615. Grounds maintenance services. Mr. Marello weeds the area for approximately 20 hours weekly. Greenleaf Landscapes Inc. has been cutting the grass at College Park property and tending to the slopes. Their proposal for mulching, weekly services (mowing, trimming, edging, debris clearance, lawn fertilizing and weed control, Fall clean up total is $8640.00 for 2017. Pat Hendershott proposed the motion to accept the contract. Mark Snider seconded it. It was unanimously passed.6. Blacktopping and parking lot repairs Suzanne Ragg suggested that the proposal that was adopted during Board meeting on July 17, 2017 be reconsidered. She proposed that McKee Paving be contracted to fix the potholes for $2,950.00. Put off or collect other bids to asphalt and paint the parking stripes. Dorothy Esterle-Assadi moved to contract McKee Paving to fix the potholes. Mark Snider seconded the motion. It passed unanimously.7. Building C Plumbing Leak Suzanne Ragg reported that Rob Locke provided invaluable help locate a major leak on the second and ground floor level in Building C. The main water pipe had corroded and flooded adjacent condos with water. The owners of 201C were very cooperative so several repairs could be made. Rob Locke agreed to repair Building C water main pipe. He did not provide an estimate. He advises that remaining buildings have their water pipes evaluated/repaired. 8. Kara Cozort requested the contact information for a handy man who would be available to make dry wall repairs because of the wall areas in building C. Mark Snider recommended contacting Gary Cobb for his bid. Kara also mentioned that the owner reported that in 304D the door jam needs to be repaired. Pat Hendershott stated that owners are responsible for interior door jam repairs. 104B new owner requested patio repairs. The boards on that patio are rotting. Kara would inform the owner that the Board was informed. Replacement fee for a College Park hangtag is $150.00. Kara recommended that owners provide the names of their tenants not copies of their code office occupancy form. 9. Exterior Building Repairs Suzanne Ragg contacted Mike Meyers to find out his schedule for patching and caulking the building exteriors as per his proposal 2017. Mike Meyers informed Suzanne Ragg, he could have his men caulk on the weekends, but possibly by May 2018 is the earliest he could get over to patch the siding. Mike Meyers would be asked to submit his bid to side all the buildings.10. Pat Hendershott would provide his recommendation of which repairs in Ben Stolzfus’ list should be done this Fall 2017. He would include the total cost estimates for the next Board meeting.11. Next Board Meeting September 11, 2017 at 4:30 PM is the next Board meeting. 12. CP Executive Officers elected for 2017-2018 From the slate of elected College Park Homeowners Association Board members Approved on May 20, 2017, the following Board members accepted to serve as Executive Officers for 2017-2018: Suzanne Ragg, President (1 year term) Pat Henrshott, Vice President (2 year term) Mark Snider, Treasurer (2 year term) Mark Snider agreed to become the second signature for the College Park Association’s financial accounts at the Hocking Valley Bank, Athens, Ohio. Dorothy Esterle-Assadi, Secretary (2 year term)Adjourment at 6:28 PM Dorothy Esterle-Assadi proposed adjournment. Mark Snider seconded that motion. That motion passed unanimously. ................
