Health Regulations and Licensing Administration Pharmaceutical Control
Pursuant to the D.C. Law 3-98, D.C. Code Section 47-2885.01 and Title 22 DCMR Regulations, Chapter 19, anyone who operates a pharmacy within the District of Columbia (DC) must make application for a pharmacy license. Any pharmacy located outside of DC which dispenses, distributes, ships, mails, or delivers, in any manner, prescription drugs or prescription medical devices directly or indirectly to a patient in DC must register with the Department.
Each resident pharmacy license or nonresident pharmacy registration must apply only to the operation of the pharmacy at the location for which it is issued.
An applicant for a new license to operate a pharmacy must furnish proof of the following:
? A valid certificate of occupancy required by the Department of Consumer and Regulatory Affairs for the premises where the pharmacy will be located;
? If the pharmacy is owned by a corporation, that the corporation is in good standing with the District of Columbia or the state of incorporation, if the pharmacy is incorporated in a state other than the District of Columbia;
? That each person listed on the application (individuals, partners, or officers of the corporation) has not been convicted of a felony involving drugs; and
? Other information as necessary to properly evaluate the applicant and application.
The application for a pharmacy must include the name and license number of the pharmacist who will be known as the pharmacist-in-charge, who shall ensure that the pharmacy complies will all applicable laws and regulations pertaining to the operation of the pharmacy and practice of pharmacy.
The initial and biennial licensing fee for resident and nonresident pharmacy is nine-hundred dollars ($900.00). A check made payable to "D.C. Treasurer" should accompany all applications.
Pursuant to the D.C. Uniform Controlled Substances Law (D.C. Law4-29; D.C. Code ? 48-901.02 et. seq.) and regulations promulgated under (22 DCMR Chapters 10-15) every person and facility who manufacturers, distributes, dispenses, prescribes or who conducts research with any controlled substances in the District of Columbia must also be registered with the Department of Health (DOH). This registration is required in addition to the federal registration with the U.S. Drug Enforcement Administration (DEA).
