GENERAL

Financial Reports to the Board

1. The Board shall receive financial reports from the Executive Director at the regularly scheduled September and March meetings of the Board during each calendar year.

2. The reports to the Board shall consist of budgetary statements, financial projections, and other pertinent information concerning the fiscal status of the Board.

3. Budget Request forms that must be filed with the state's Executive Budget Office prior to November 1 of the calendar year will be presented to the Board for approval at the scheduled September meeting.

4. Other unscheduled financial reports to the Board shall be provided by the Executive Director based on the directives of the Board.

Requests Requiring Board Action

All non-application requests requiring Board action must be received in the Board office thirty (30) days prior to the Board meeting date. Re: 255-X-1-.06 Adopted: 3/19/2004, Amended: 3/11/2022

Procedure for Collecting Returned Checks

When the Board is notified by the State Treasurer's office that a check has been returned because of "Insufficient Funds" or for other reasons not honored by the bank on which the check is written, the following steps will be taken to collect the funds: 1. Licensee or applicant will be notified by telephone that the check has been returned and

instructed to send cashier check or money order within fourteen (14) working days to cover the amount of the outstanding check plus the returned check fee of $30.00. 2. If the licensee or applicant can't be contacted by telephone, a notice will be sent by certified mail with return receipt. 3. Replacement of funds must be with cashier check or money order.

4. After notice is served via certified mail, and the fourteen (14) days have passed without the ABEC's receipt of payment, the outstanding fees will be turned over to the proper authorities for criminal prosecution.

Sharing of Information Regarding Licensure Applications

ABEC considers licensure applications as confidential and will discuss the details of those applications only with the applicant themselves.

If the applicant wishes ABEC to communicate with a third-party regarding the status of their application, they must provide a notarized waiver and consent to share information.

Report of Ethical/Disciplinary Actions or Arrest/Convictions

Applicants and licensees are required to disclose to the Board any instance of censure, consent agreement, or disciplinary action; refused licensure or certification; voluntary surrender of licensure or certification; or license or certification suspension or revocation by any counseling or mental health related regulatory Board, or any counseling or mental health related professional organization within thirty (30) days of the action or disciplinary event.

Applicants and licensees are required to disclose to the Board any arrests or convictions resulting from the suspected violation of any Federal, State, Municipal, or Local laws and ordinances, including pleas of nolo contendere, within thirty (30) days of the arrest.

Renewal of Associate Licensed Counselor (ALC) or Licensed Professional Counselor (LPC) licensure through ABEC does not require the disclosure of past censure, disciplinary, licensure, or legal actions assuming that disclosure has been made, reviewed, and cleared in previous ABEC applications or renewals.
