Powder Ridge Condominium Association Rules and RegulationsThe following Rules & Regulations were adopted by the elected Board of Directors to benefit all Owners, Tenants, and Guests. Managing Agent is in charge of monitoring the property to ensure compliance. Please respect the rights of your neighbors.Violations to these Rules & Regulations will be charged to the Unit Owner’s account as defined by the “Resolution of the Powder Ridge Condominium Association to Enact Responsible Governance Policies”. The fines are summarized as follows (please request current copies of all governing documents from the Managing Agent if you do not have current copies): 1st Offense: Owner/Tenant will receive a written warning posted at the Unit and sent to Owners billing address. Owner will only be responsible for any expenses related ot the offense.2nd Offense:$50fine plus any additional expense related to the offense.Subsequent Offenses: $100 fine plus any additional expenses related to the offense.Each notice will include a timeframe to correct the offense and after that timeframe has expired it will be considered a separate offense if the violation has not been corrected. Some offense timeframes may not allow enough time to mail a notice before a second offense may occur. It is suggested that the Owner provide Managing Agent with an email address in order to expedite delivery of notices.1. Noise & NuisanceOwner/Tenant shall not make any excessive noise or create any nuisance such as will disturb the peace and quiet of neighbors. Owner shall pay fines assessed by both the Association and city if required.Association quiet hours are from 10:00 PM to 7:00 AM MST. Violations must be reported to Managing Agent.2. Parking Lot & VehiclesResidents must register their vehicle(s) with the Managing Agent when parking on the premises overnight (10:00 PM – 9:00 AM MST). Residents are entitled to register one vehicle per reserved parking spot and will receive a window sticker for each registeredvehicle. Each unit may purchase hanging tags for additional vehicles or guest vehicles equal to the number of bedrooms in the unit minus the number of reserved spots for the unit. The number of window stickers and hanging tags combined shall never exceed thenumber of bedrooms in a unit. A window sticker or hanging tag does NOT guarantee a parking spot. These window stickers and hanging tags must be placed in the vehicle. Managing Agent will attempt to contact owners of improperly parked vehicles registeredwith the Association prior to towing.Vehicles with expired license tags, missing plates, or vehicles which are determined by Managing Agent inoperable, abandoned, or improperly parked on premises will be towed at the vehicle owner ’s expense.Temporary parking of enclosed trailers for the purposes of moving and/or Unit repair/remodel is allowed in reserved spaces only. Trailers must be approved by Managing Agent (size & date dependant - Not to interfere with snow removal).Open trailers, boats, campers, camping trailers, trash and/or storage containers are not allowed on Association Property at any time. Vehicle repairs and maintenance are not allowed at any time on Association Property. This includes but is not limited to: washing, waxing, changing of fluids or tires, and/or replacing or maintaining any part (starter, battery, muffler, fender, door, window etc.).Reserved Spots: Reserved spots are designated by Unit number. Any vehicle parking in a reserved spot that does not reside in that Unit or is not a guest of someone residing in that Unit is subject to immediate tow. Vehicles in these spots are not required to bemoved daily, but must be moved frequently to facilitate snow removal.Unreserved Spots: Unreserved spots are first come, first served but all vehicles in these spots must be moved daily.Unregistered Vehicles: UnregisteredFailure to move an unregistered vehicle from an unreserved spot on a daily basis is subject to immediate tow and/or fine without warning.3. Pets/AnimalsAll pets must be registered by the Association by completing and submitting the “Pet Registration Form” to the Managing Agent for review. Only registered and approved pets are allowed on the Association PropertyNo Tenant is permitted to have any pet on the Association Property of any size, breed or weight.No Owner is permitted to have more than two (2) total domestic pets at one time, whether permanent or temporary, in his/her Unit without the prior written permission of the Managing Agent. Such permission in one instance shall not be deemed to institute blanket permission in any other instance and any such permission may be revoked at any time in the sole discretion of the Managing Agent.Owners who wish to have a pet reside in their Unit, must complete & submit the Pet Registration Form and receive approval from the Managing Agent prior to bringing the pet onto Association Property to avoid fines.Owners with pets already on the premises not in compliance with previous Rules & Regulations as of 3/30/2012 must complete and submit the Pet Registration Form (including photo and license) to Managing Agent within 30 days of this revision of the Rules & Regulations approval to avoid fines.4. Individual Unit, Over-the-Air Reception Devices (“OTARD” a.k.a. Satellite Dishes)It is suggested that Owners who wish to install OTARDs provide a request in writing to the Managing Agent(s) prior to installing the device to reduce the risk of violating the Association’s Rules & Regulations. This request should include an exact location and method off attachment (drawings showing the attachment detail may be required).An OTARD may be installed in, and only in, areas of “exclusive use or control” if there is not already a building wide system in place to provide that service to the Owner ’s building. And, such that the installation does not violate the following restrictions:Installations may NOT attach (drilling, bolting, screwing etc.) into or through common elements maintained by the Association for any part of the installation.Installations may NOT overhang or project outside an area of “exclusive use or control”.Installations are NEVER permitted on common elements (including but not limited to: roofs, hallways, walkways or exterior walls).5. TrashOnly household trash may be disposed of in the dumpster paid for by the Association. Items that are specifically prohibited are as follows: 1) Construction debris (drywall, paint, wood scraps, cabinets, fixtures, etc.); 2) Furniture (mattresses, tables, chairs, couches,shelves, dressers, etc.); 3) Anything that does not fit in a kitchen sized garbage bag. Do not leave trash or debris on decks, walkways, stairs, or in the parking lot at any time, for any amount of time. If you are unsure if the items you need to dispose of qualify as household trash, contact the Managing Agent to avoid fines.6. Storage of Personal ItemsItems stored outside an Owner’s Unit is limited to areas of “exclusive use or control” such as decks and patios. With the exception of a propane grill, exterior furniture and bicycles, all other items must be approved in writing by the Managing Agent. Bicycles may also be parked in the Owners reserved spot(s) in the parking lot.Nothing shall be stored in common areas that are used to access a unit or crawl space (stairways, walkways, etc.) at any time, for any reason, and may be confiscated and/or disposed of without warning.7. GrillsPropane grills are allowed in exterior areas of “exclusive use or control” such as decks and patios. Charcoal grills are absolutely not allowed. Managing Agent will confiscate any charcoal grill that is on Association Property.8. Repairs & MaintenanceCommon Areas: Managing Agent is responsible for maintaining the common areas described in the Association’s documents (non- inclusive examples include: laundry room, parking lot and grounds, building exteriors, common utilities, building fire alarm). For items that require immediate assistance (any water related issue, loss of power or heat) you must call the related utilitity company and report the problem to the managing agent. For general maintenance, please take the time to notify the Managing Agent of any common area maintenance that needs to be done using the daytime number and email. Individual Units: Owners are responsible for the Unit interiors (non-inclusive examples include: toilets, water heaters, sinks, showers, dishwashers, garbage disposals, electrical fixtures, CO detectors). Managing Agent may be able to provide repair & maintenance services to the Owner or refer the Owner to qualified providers. These services are ALWAYS the financial responsibility of the Owner.9. Fire AlarmFor Fire and any life threatening emergencies, call 911 FIRST. Do not, under any circumstances, tamper with the fire alarm equipment. If the alarm is sounding, immediately call Managing Agent (see above for contact info). Let us know what Unit you are inand how you set off the alarm . . . DON’T TOUCH THE FIRE ALARM EQUIPMENT . . . follow these procedures and you will not be fined. You WILL be fined if you tamper with any of the fire alarm equipment or set off the alarm and don’t report it to Managing Agent immediately.10. LocksOwner must provide Managing Agent a way of accessing their unit for emergency purposes. If Owner does not provide Managing Agent with a way of accessing their Unit, Managing Agent may use force to enter and Association will not reimburse Owner for costs associated with the forced entry during emergencies. It is the Owner ’s responsibility to ensure compliance.11. Snow RemovalIt is inevitable that ice will build up on the parking lot and walkways - please be cautious to avoid accidents. Moving your vehicles frequently is mandatory (see 2. Parking Lot & Vehicles).12. RentalOwners choosing to rent their Unit shall provide Managing Agent with a copy of the required written lease including current Tenant contact info and term of lease. The lease must include a current copy of the Association’s Rules & Regulations.13. UtilitiesManaging Agent shall be responsible for the provision of and the payment of the following utilities and services: sewer, water, common areas electric, common areas gas, trash pick-up (as specified in 6.Trash) & TV (Standard package).Owners are responsible for the provision of and the payment of the following utilities and services:Required: individual unit electric &/or gas (required year round to maintain temperatures that prevent frozen pipes. Optional: phone, internet, gas (if main source of heat is electric) & Upgraded packages to standard TV packageThe party responsible for any particular utility or service shall not be liable for failure to furnish the utility or service when the cause of such failure is beyond that party’s control.14. Bedbugs and other pestsAttached is the formal Powder Ridge Condominium Association Bedbug Policy. The policy provides procedures for reporting, detecting, inspecting and treatment of bed bugs, as well as allocating the cost of detection, inspections and treatments. Other pests shall follow similar procedures specific to the pest based on accepted industry standards. 15. In-Unit Washers & DryersAll in-unit washers and dryers shall be permitted with the Routt County Building Department and installed to current codes. Dryers shall not be vented to areas of limited common element such a walkways or staircases. Units not in compliance with this rule have 60 days from the approval date to get into compliance or be removed. 16.
