Kirby, Jr. is a 62-year-old judge and student of divinity at Campbell University who resides in Clinton, NC. A native of Sampson County, Kirby talks about an upbringing as a star athlete who played first-string football at Wake Forest University. After attending law school, he started work as a prosecutor in Cumberland, Hoke, and Pitt Counties before returning to the Sampson County area. While in Pitt County, he taught at Eastern Carolina University. Kirby was elected to the Sampson County Commission for two terms and was appointed a Senior Resident Superior Court Judge by Roy Cooper. After Kirby was successful in the primary for county commission in 2010, he was sued by his opponent Malachi Faison for not residing within the district. An initial complaint was rejected by the local elections’ office, Faison pursued it in court. Prior to the 2010 election, the matter was dismissed after Kirby filed a motion for sanctions.Kirby never formally married, although he has an adult son (25 years old). He was not consistently in his son’s life, according to his son’s mother, Patricia Brewer of Wayne County. Brewer sued for full custody and child support in 2005, alleging that after paying some initial money toward their infant son, Kirby was uninvolved. After a paternity test confirmed that Kirby was Zachary’s father, he waived custody mediation, Brewer was given full custody, and Kirby was ordered to pay child support and given visitation.A few years later, Brewer attempted to get additional child support, and Kirby petitioned to pay less. No change was made to the financial arrangement. He also requested a decrease again (as well as for his child’s mother to pay for his legal fees) that was rejected. At the time, he was working as an attorney and as a county commissioner. It seems he continued to pay child support until Zachary turned 18 and graduated high school.Kirby was also the subject of at least five traffic cases in North Carolina dating back to the 1980s, including speeding cases, expired registration, and failing to notify the DMV of a change of address. In the late 1990s he sued following a traffic accident. The case was dismissed a few months later, following a counter-claim.A review of documents in Sampson County shows that Kirby frequently purchased property in the late 1990s and secured frequent, small-dollar loans, including one from the State of North Carolina totaling $1,500. As of 2009, it appears that all loans secured by Kirby were released. Kirby established his current campaign-finance committee with the North Carolina State Board of Elections in 2018, although electronic filings do not exist until 2019. He was sent a non-compliance letter in November 2019 for failing to file a first-half 2019 disclosure and penalized $500. He paid the penalty on December 10, 2019. After raising minimal money in the first quarter of 2020, Kirby disclosed raising more than $88,000 in the second quarter. This included $45,000 in a personal loan to the committee. He is the son of LuEllen Kirby and the late Albert D. Kirby, Sr. He was reared on a farm operated by his grandfather. There, he learned many of his values. Albert graduated from Clinton high school in 1976, where he was an all-state football player. He was selected to play in the Shrine bowl, an honor reserved for the top foot-ball players in the state of North Carolina. Albert earned a full football scholarship to Wake Forest University, where he was first string full-back for two seasons.After graduating from Wake Forest in 1980, Judge Kirby entered law school at Campbell University School of Law (Now Norman Adrian Wiggins School of Law), and graduated in 1986.Following his graduation from Law School, Mr. Kirby began work as an assistant district attorney in Prosecutorial District Twelve (Cumberland and Hoke Counties) and Prosecutorial District Three (Pitt County), respectively.While employed as an assistant district attorney in Greenville, North Carolina, Judge Kirby taught first as an Adjunct Professor and then as a full Professor of Criminal Justice at East Carolina University.After his work as a Professor at East Carolina University, Judge Kirby moved back to his home town in Clinton, North Carolina, and established the Kirby Law Firm. One of his primary clients was the Clinton City Schools Board of Education.
