24. Q: Is Java technology free? Where can I get information on licensing?

      A: Java SE continues to be available under the Sun Binary Code License (BCL) with no additional cost for its use in general purpose computing. The Java technology support and EOL roadmap provides more information. Java for Business binaries are provided under separate licensing terms.  A summary of the Java SE and Java for Business licensing terms is provided below:

Java SE 

Internal/In-house use: The Java SE platform binaries (JDK and JRE) are licensed under Sun's Binary Code License (BCL) with supplemental terms. For most developers and end-users, the binary JDK and binary JRE are all that's needed to experience the world of Java technology. USE: The binary JDK and JRE are available at no fee from Sun (per terms of the BCL) for use with desktop personal computers. JDK or JRE use for embedded devices and other computing environments may require a license fee from Sun. Read more about embedded use of Java SE, or contact your local Sun office to obtain a license.

Redistribution: Both the JDK and JRE can be freely redistributed with value-add (per terms of the BCL). In addition, personal computer manufacturers and distributors may become authorized to pre-install the JRE on Windows operating system-based personal computers. Read More

Source Code: The JDK source code is available for researchers and others interested in exploring the details of the JDK. Each release has its own license or set of licenses which frequently includes the Sun Community Source License (SCSL) terms. Sun has recently started offering simplified access to the JDK source code under the a new Java Research License (JRL). Note that in either case (SCSL or JRL), if you decide to use your project internally for productive use or distribute your product to others, you must sign a commercial agreement and meet the Java compatibility requirements. Contact your local Sun office to obtain an agreement.

Documentation: Generally, the Java SE documentation is not redistributable. Individuals can download the Java SE documentation for their own use or simply browse online. More information on documentation redistribution is available here.

 This Binary Code Java Platform, Standard Edition

This Binary Code Java Platform, Standard Edition, Runtime Environment OEM License Agreement (the "Agreement") is entered into by and between Sun Microsystems, Inc., ("Sun") with its principal place of business at 4150 Network Circle, Santa Clara, CA 95054, and the entity that is entered in the required fields of the "Java Environment Runtime License Registration" ("You" or "Your"), and is effective as of the date that Your application is submitted by You, all of which is evidenced by clicking on the "Submit" button of the "Java Environment Runtime License Registration" page. By clicking on the "I have read and accept the terms of the Binary Code Java Runtime Environment OEM License Agreement in applying for this Java Runtime Environment Licensing Program for Windows PC OEMs ("Program")" button on the "Java Runtime Environment Binary Code License and Support Agreement" page, You have agreed and agree to the terms of this Agreement regardless of whether or not You are accepted into the Program .

1. License Grant. Subject to the terms and conditions of this Agreement, Sun grants You a non-exclusive, non-transferable, royalty-free limited license to reproduce and distribute the Software in binary code form preinstalled only on Your Microsoft Windows Operating System based general purpose desktop computers and servers ("General Purpose Desktop Computers and Servers" or "GPDCS") that You manufacture, distribute, or take as a generic white box and rebrand as Your own provided that:(i) the Software and any proprietary legends or notices are complete and unmodified, (ii) You do not distribute additional software intended to replace any component(s) of the Software, (iii) you do not modify the Software end user license agreement or impede or prevent it from displaying and requiring acceptance and (iv) each distribution of the Software by You to an end user must be made pursuant to the unmodified terms and conditions of an end user license agreement with terms and condition is no less restrictive than the terms and conditions accompanying the Software, including the supplemental terms and conditions relating to the Software. It is expressly acknowledged and agreed by You that in the United States and in other jurisdictions where an enforceable copyright protection covering the Software exists, such end user license may be a written agreement on or accompanying the package containing the Software media that is fully visible to the end user before the package is opened, that the end user accepts by opening the package and that complies with applicable law relating to agreements of such type. For purposes of this Agreement, "Software" means the most current version in binary code form of Sun's Java Platform, Standard Edition, Runtime Environment (and accompanying documentation) as of the Effective Date, and any subsequent versions or releases, which may require additional terms and conditions as required by Sun, that Sun at its sole discretionmakes

available to You hereunder during the term of this Agreement. For purposes of this Agreement, "General Purpose Desktop Computers and Servers" or "GPDCS" means computers or servers used for personal computing functions or running application servers in IT infrastructure. Licensing for embedded or special purpose uses, such as cell phones, wireless devices, TV devices, kiosk type products, telematics devices, home gateways, routers, hubs, switches and industrial control systems is available under a separate agreement. If Your "Java Runtime Environment License Registration" is approved by Sun and You are accepted by Sun into the Program, You will be given a unique user name and password with instructions as how to access the Software at . You agree not to access any other software other than the Software.

2. RESTRICTIONS. Software is copyrighted and title to Software and all associated intellectual property rights is retained by Sun and/or its licensors. Unless enforcement is prohibited by applicable law, You may not modify, decompile, or reverse engineer Software.

3. Trademarks and Logos. No right, title or interest in or to any trademark, service mark, logo or trade name of Sun or its licensors is granted under this Agreement. You acknowledge and agree as between You and Sun that Sun owns the SUN and JAVA trademarks and all SUN and JAVA-related trademarks, service marks, logos and other brand designations ("Sun Marks"), and You agree to comply with the Sun Trademark and Logo Usage Requirements currently located at . Any use You make of the Sun Marks inures to Sun's benefit. You shall display the “Java Powered(tm)” logo (“Logo”): (i) on Your external GPDCS packaging and the accompanying documentation; (ii) on Your web pages featuring information about the GPDCS, in the form of graphic images that point to the current Sun page on Java Technologies () via hypertext link; (iii) on Your splash screens appearing upon launch of the GPDCS and on general GPDCS information screens (e.g., "About", "Help", "Info", and any menu for Java applications); (iv) on tangible marketing collateral featuring the GPDCS including advertisements, direct mail, web pages, retail store displays, brochures and datasheets; (v) when the GPDCS is a laptop or notebook: on a pad stamped on the back of the laptop or notebook and on a sticker that the consumer removes after purchase underneath the keyboard; and (vi) when the GPDCS is other than a laptop or notebook: prominently displayed on the front of the hardware and on a sticker that consumer removes after purchase.

4. LIMITED WARRANTY. Sun warrants to You that for a period of ninety (90) days from delivery to You, the media on which Software is furnished (if any) will be free of defects in materials and workmanship under normal use. Except for the foregoing, Software is provided "AS IS". Your exclusive remedy and Sun's entire liability under this limited warranty will be to replace the Software media.

5. DISCLAIMER OF WARRANTY. UNLESS SPECIFIED IN THIS AGREEMENT, ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT ARE DISCLAIMED, EXCEPT TO THE EXTENT THAT THESE DISCLAIMERS ARE HELD TO BE LEGALLY INVALID.

6. LIMITATION OF LIABILITY. Except for express undertakings to indemnify under this Agreement, violation of Sun's Intellectual Property Rights, or breach of Section 1: (a) each party's liability to the other for claims relating to this Agreement, whether for breach or in tort, shall be limited to $50,000; (b) IN NO EVENT WILL YOU, SUN OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES IN CONNECTION WITH OR ARISING OUT OF THIS AGREEMENT (INCLUDING LOSS OF PROFITS, USE, DATA, OR OTHER ECONOMIC ADVANTAGE), NO MATTER WHAT THEORY OF LIABILITY, EVEN IF EITHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OR PROBABILITY OF SUCH DAMAGES; and (c) LIABILITY SHALL BE SO LIMITED AND EXCLUDED, EVEN IF ANY REMEDIES PROVIDED FOR IN THIS AGREEMENT FAIL OF THEIR ESSENTIAL PURPOSE.

7. Indemnity.

A. Sun will defend, at its expense, any legal proceeding brought against You, to the extent it is based on a claim that authorized use of the Software is an infringement of a third party trade secret, patent or a copyright in a country that is a signatory to the Berne Convention, and will pay all damages awarded by a court of competent jurisdiction, or such settlement amount negotiated by Sun, attributable to such claim, provided that You: (a) provide written notice of the claim and any such threatened claim promptly to Sun; (b) give Sun sole control of the defense and settlement of the claim; (c) provide to Sun, at Sun's expense, all available information, assistance and authority to defend; and (d) have not compromised or settled such proceeding without Sun's prior written consent.

B. Should Software become, or in Sun's opinion be likely to become, the subject of a claim of infringement for which indemnity is provided above, Sun shall, in addition to the obligations specified in Section 7A, as Your sole and exclusive remedy, elect to: (a) obtain for You the right to use such Software; (b) replace or modify the Software to become non-infringing; or if alternatives (a) or (b) are not commercially practicable in Sun's discretion, (c) terminate Your license to the Software.

C. THIS SECTION 7 STATES THE ENTIRE LIABILITY OF SUN WITH RESPECT TO INFRINGEMENT OF ANY INTELLECTUAL PROPERTY RIGHTS BY THE SOFTWARE. SUN SHALL HAVE NO OTHER LIABILITY WITH RESPECT TO INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS OF ANY THIRD PARTY.

8. Termination. The Term of this Agreement shall begin on the Effective Date and shall continue for a period of one (1) year, or until earlier terminated pursuant to this section. Thereafter, the Agreement will automatically renew for up to two (2) successive one (1) year periods ("Renewal Periods") unless terminated by either party by giving thirty (30) days written notice to the other party in advance of the termination date, which may be set at any time during the Renewal Periods. Termination is permitted for breach of this Agreement, upon thirty (30) days written notice to the other party and an opportunity to cure within such thirty (30) day period. Upon termination, You must destroy all copies of Software.

9. Export Regulations. All Software and technical data delivered under this Agreement are subject to US export control laws and may be subject to export or import regulations in other countries. You agree to comply strictly with all such laws and regulations and acknowledge that You have the responsibility to obtain such licenses to export, re-export, or import as may be required after delivery to You.

10. PUBLICITY. You agree to work with Sun on press and marketing activities relating to this Agreement, and You retain final approval of all such activities, except that Sun at its discretion may discuss this Agreement with press and industry analysts. Further, You agree and are required to use the Java Powered Logo on all Your product marketing collateral and all the web pages associated with Your GPDCS that ship the Software. You may use the Java Powered Logo on Your other marketing collateral and other web pages that directly relate to the GPDCS containing Java technology.

11. STANDARD INSTALLATION IMAGE. You agree to install the Software using the included installer and command line options as described in the "Readme" file posted on the Web site associated with the Software, including insuring: (i) that the Software auto-update feature is enabled; (ii) that the Java WebStart feature is installed; and (iii) that the Software plug-in is installed and enabled for supported browsers. You also agree not to modify, decompile or reverse engineer the Software after installation is complete on any GPDCS .

12. LIMITED SOFTWARE SUPPORT. At Sun's sole discretion, Sun may provide the limited support for the Software licensed to You under this Agreement as located at . Sun reserves the right to change, modify or discontinue support for Your Software at any time during the period of this Agreement or during any Renewal Periods. Sun's Software support will be limited to technical support in the form of frequently asked questions and bug submission on the Website.

13. QUARTERLY REPORT. You shall provide to Sun quarterly reports, in the English language which shall include, at a minimum:(i) Your name and the name of Your GPDCS; (ii) the number of units of each type of Your GPDCS shipped with the Software; Quarterly reports should be sent by e-mail to JRE-OEM-Quarterly-Reports@ within 30 days of the end of each calendar quarter (ending March 31, June 30, September 30, and December 31) unless otherwise directed by Sun in writing.

14. CONFIDENTIALITY. You agree not to disclose the terms or conditions of this Agreement to any third party. You may not disclose Sun’s confidential information and may use it only for purposes specifically contemplated in this Agreement. Sun will treat Your confidential information with the same degree of care as it does its own similar information. The foregoing obligations do not apply to information which: (i) is rightfully obtained by recipient without an obligation to maintain its confidentiality; (ii) is or becomes generally known to the public through no act or omission of recipient, or (iii) is independently developed by recipient without use of the other party's Confidential Information. This Confidentiality section will not affect any other confidential disclosure agreement between the parties.

15. MISCELLANEOUS. Any action related to this Agreement will be governed by California law and controlling U.S. federal law. No choice of law rules of any jurisdiction will apply. If any provision of this Agreement is held to be unenforceable, this Agreement will remain in effect upon the parties' agreement to revised terms that most nearly accomplish the same effect. This Agreement is the entire agreement between You and Sun relating to its subject matter. It supersedes all prior or contemporaneous oral or written communications, proposals, representations and warranties and prevails over any conflicting or additional terms of any quote, order, acknowledgment, or other communication between the parties relating to its subject matter during the term of this Agreement. No modification of this Agreement will be binding, unless in writing and signed by an authorized representative of each party.

16. EXPORT REGULATIONS. All Software, documents, technical data, and any other materials delivered under this Agreement are subject to U.S. export control laws and may be subject to export or import regulations in other countries. You agree to comply strictly with these laws and regulations and acknowledge that you have the responsibility to obtain any licenses to export, re-export, or import as may be required after delivery to you. You certify that you are not identified on the most current U.S. export exclusion lists, including but not limited to the U.S. Department of Commerce's Denied Persons and Entities Lists and the U.S. Department of Treasury's Specially Designated Nationals List. You agree not to use anything provided by Sun under this Agreement for nuclear, missile, chemical or biological weaponry end uses.

17. U.S. GOVERNMENT RESTRICTED RIGHTS. If Software is being acquired by or on behalf of the U.S. Government or by a U.S. Government prime contractor or subcontractor (at any tier), then the Government's rights in Software and accompanying documentation will be only as set forth in this Agreement; this is in accordance with 48 CFR 227.7201 through 227.7202-4 (for Department of Defense (DOD) acquisitions) and with 48 CFR 2.101 and 12.212 (for non-DOD acquisitions).

Java for Business

 

All use and redistribution of the Java for Business binaries are licensed under Sun's Software License agreement.

 

 

Internal/In-house use – on Solaris: The Java for Business binaries (JDK &JRE) are available for individual and commercial use on the Solaris operating environment for no additional cost. For most customers, this will allow them to pick up the Solaris Java for Business JDK or JRE and use it in place of the Solaris Java SE JRE or JDK they have in use today. The license provided with Java for Business (JRE &JDK) provides the complete details regarding terms and conditions.

Internal/In-house use – with other Sun software: The Java for Business binaries (JDK &JRE) are also available for individual and commercial use with other Sun software, such as Sun's identity management, Web and application server products, at no additional cost. For most customers, this will allow them to pick up the Java for Business JDK or JRE and use it in place of the Java SE JRE or JDK they have in use with their Sun software today. The license provided with Java for Business (JRE &JDK) provides the complete details regarding terms and conditions. This use at no additional cost is available if only the Sun software is exercising or otherwise leveraging the functionality of the Sun Java for Business binaries.

Internal/In-house use – other Platforms (not with Sun Software): Customers can purchase individual and commercial use subscriptions or perpetual rights to use Java for Business binaries (JDK &JRE) internally on a per desktop, per server, or per employee (site license) basis. More details on Internal/In-house use license options and pricing is available on the product Web site.

Redistribution – Solaris Binaries: The Solaris Java for Business binaries (JDK &JRE) are available for redistribution environment for no additional cost, provided those companies register as a Licensed Solution Provider. For most partners, this will allow them to pick up the Solaris Java for Business JDK or JRE binaries and use it in place of the Solaris Java SE JRE or JDK binaries they have in use today. The license provided with Java for Business (JRE &JDK) provides the complete details regarding terms and conditions.

 

Redistribution – other Platforms: Partners can purchase the right to both redistribute Java for Business binaries with their products and/or enable their customers to download Java for Business binaries (JDK &JRE) directly from Sun. For most partners, this will allow them and their customers the ability to access and use Java for Business binaries in essentially the same fashion as with Java SE.
