R.C. § 125.02.Release and Permit: For purchases over $50,000, when DAS determines that it is not possible or advantageous to make the purchase, DAS will grant the agency a Release and Permit to make the purchase directly. Agencies are also required to obtain an IT Release and Permit for any purchases of telecommunications and computer services over $25,petitive Selection: Generally, agencies are required to make purchases by Competitive Selection. This is defined as a procurement conducted by and through DAS using one of the following procedures:Competitive sealed bidding under section 125.07 of the Revised Code;Competitive sealed proposals under section 125.071 of the Revised Code; Reverse auctions under section 125.072 of the Revised Code.Note that purchases made directly by agencies should also be solicited in a fair and open competitive manner.Controlling Board: provides legislative oversight over certain capital and operating expenditures by state agencies and has approval authority over various other state fiscal activities including waivers of competitive selection. An agency may make a purchase for an amount over $50,000 from a supplier without competitive selection if the Controlling Board approves the purchase. R.C. § 127.16.Direct Purchase Authority: An agency may make purchases using its own direct authority when:The purchase is less than $50,000; orThe purchase is more than $50,000 but DAS has issued a Release and Permit and the Controlling Board approves the purchase.Requisite Procurement Program Review: R.C. §125.035 requires agencies to first consider requisite programs for purchases of supplies and services. This program consists of non-profit organizations that employ people with work-limiting disabilities and offer goods and services.Business Enterprise Program: ODD's Business Enterprise Program through the Bureau of Services for the Visually Impaired (BSVI) assists people who are blind or have a visual impairment by creating employment in food service areas. This provides Ohioans with opportunities to operate cafeterias, snack bars, convenience stores, and vending locations.Office of Information Technology: The DAS Office of Information Technology (OIT) delivers statewide information technology and telecommunication services to state government agencies, boards and commissions as well as policy and standards development, lifecycle investment planning and privacy and security managementState Printing: DAS State Printing and Mail Services offers a full range of commercial procurement services with contract printers throughout the state, records and forms management, mail services, mainframe printing, fulfillment services and a network of copy centersOhio Pharmacy Services: The Department of Mental Health and Addiction Services, Ohio Pharmacy Services (formerly Office of Support Services) provides institutional agencies with various supplies and services. Eligible participants include state facilities, county health departments, community mental health agencies, free clinics, county jails, non-profits, etc.Ohio Facilities Construction Commission: The Ohio Facilities Construction Commission (OFCC) is responsible for guiding capital projects for state agencies, state-supported universities and community colleges, including Ohio’s comprehensive public K-12 school construction and renovation program, and managing the grants process for cultural facilities and school security programs.DAS Procurement WebsiteLocated at procure..All opportunities, whether issued by DAS or by another agency, exceeding $25,000 must be posted on the State of Ohio Procurement Website.Opportunities and awarded contracts are posted in a searchable database.Vendors can register to do business with the State and receive notification of opportunities through this website.Procurement MethodologiesInvitation to Bid (ITB): Competitive sealed bidding pursuant to R.C. § 125.11 that is awarded to the lowest responsive and responsible bidder.A bidder on the contract shall be considered responsive if the bidder's proposal responds to bid specifications in all material respects and contains no irregularities or deviations from the specifications which would affect the amount of the bid or otherwise give the bidder a competitive advantage. R.C. § 9.312.The factors that the state agency or political subdivision shall consider in determining whether a bidder on the contract is responsible include the experience of the bidder, the bidder's financial condition, conduct and performance on previous contracts, facilities, management skills, and ability to execute the contract properly. R.C. § 9.312.Request for Proposals (RFP): Process used to solicit competitive sealed proposals from vendors that will be evaluated on all factors and not solely limited to the lowest cost. The contract resulting from an RFP is awarded to the offeror who submits the proposal that is the most advantageous to the state.Proposals are exempt from disclosure under Ohio Public Records Act until awarded.Reverse Auction: A purchasing process in which offerors submit bids in competition to sell services or supplies in an open environment via the internet. Prices decrease as the bidding continues and the contract is awarded to the lowest bidder at the end of the reverse auction. The auction itself is an invitation-only, timed event that is open to bidders who have been prequalified.State Term Schedule Contracts (STS): STS is an optional negotiated contract that offers most-favored pricing to the state.DAS obtains a waiver of competitive selection from the Controlling Board to establish contracts with vendors. Agencies can purchase from the STS vendor at or below the prices listed on the schedule and should request quotes from multiple vendors in that category to promote competition.STS vendors must certify that the prices are the same as or better than those offered to their similarly situated, most favored customer.Master Maintenance Agreements (MMA): Optional contract available for maintenance and service of equipment that is no longer covered under a manufacturer’s warranty.Master Services Agreement (MSA): A contract for services only with related service attachments for specific services within the contract. A MSA is usually developed for telecommunication services.Master Licensing Agreement (MLA): A contract for software license(s) provided by the vendor. License(s) must be negotiated to incorporate Ohio terms and conditions. A maintenance agreement should be included as part of the license or in addition to the license agreement.Master Cloud Services Agreement (MCSA): A contract for hosted term license software, hosting outside of Ohio hardware, Software as a Service (Saas), Cloud Platform as a Service (Paas) or Cloud Infrastructure as a Service (IaaS).Cooperative Purchases/Piggyback Contracts: DAS may enter into cooperative purchasing agreements to purchase supplies or services with other entities, including other states, other purchasing consortia, the federal government, the Ohio Dept. of Transportation, and any political subdivision of this state. R.C. § 125.02.Request for Information (RFI): A non-binding procurement practice used to obtain comments, feedback, or reactions from potential responders (suppliers, contractors) prior to the issuance of a solicitation. Generally, price or cost is not required. Feedback may include best practices, industry standards, technology issues, etc.Request for Quotation (RFQ): A purchasing method used by agencies when making a purchase under their direct authority. A request is sent to the suppliers along with a description of the commodity or services needed and the suppliers is asked to respond with price and other information by a predetermined date. Evaluation and recommendation for award should be based on the quotation that best meets price, quality, delivery, service, past performance, and reliability. This methodology is not used by the DAS central procurement offices.Special ConsiderationsMinority Business Enterprise (MBE): an individual who is a United States citizen and owns and controls a business, or a partnership, corporation, or joint venture of any kind that is owned and controlled by United States citizens, which citizen or citizens are residents of this state and are members of one of the following economically disadvantaged groups: Blacks or African Americans, American Indians, Hispanics or Latinos, and Asians.A procurement preference program for socially and economically disadvantaged businesses.Agencies are required to set aside at least 15% of total purchases to be competed in a sheltered market open to Minority Business Enterprises only. R.C. §125.081. Encouraging Diversity, Growth, and Equity (EDGE): Agencies have a goal to award 5% of aggregate purchases to certified EDGE business enterprise. EDGE program participants are small socially and economically disadvantaged business enterprises owned and controlled by U.S. citizens who are Ohio residents.Buy Ohio Act: DAS is authorized to apply a preference for Ohio products or from a bidder with a significant Ohio economic presence. This preference only applies to opportunities procured through competitive sealed bids only (Invitations to Bid, Reverse Auction) and does not apply to competitive sealed proposals (Requests for Proposals). DAS shall review all bids to determine that the bidder’s offering is a “domestic source end product” that complies with Buy American Act.
