GUIDELINES FOR COMPLIANCE WITH NCLB AND SOA

The following information will help guide you the procedures to comply with the requirements for LEP students under the No Child Left Behind Act as well as the state Standards of Accreditation.

It is the intent of the law that all LEP (Limited English Proficient) students be assessed for purposes of measuring AYP, (Adequate Yearly Progress), for the SOA (state Standards of Accreditation) and to measure ELP. (English Language Proficiency). All students should be included in testing. All students who are designated LEP are entitled to standard and non-standard accommodations.

The chart included in this document will provide guidance in the administration of all tests as well as the inclusion of scores.

ELP – The test of English Language Proficiency will be administered to all LEP students each year in the spring. The test measures a student’s proficiency in English. This is a requirement under NCLB and began in the spring of 2002. The test can stand as a proxy for Reading and Language Arts under AYP.

AYP – Virginia has chosen to use the SOL tests to report adequate yearly progress. Students who are classified as level I or II in ESL may take the plain English form of the math test. They may also have the ELP test stand as a proxy for Reading and Language Arts.

The decision for a child to take a proxy or to have an exemption should be made by the individual school’s LEP committee. Accomodations that have been in place may be implemented at the time of testing.

Both the proxy for English Language Arts and the additional form of the Mathematics test may only be used for 3 consecutive years.

End of Course Tests – All students in end of course tests will do the following.

❑ All students will take the SOL assessment for any course with an end-of-course test.

❑ Scores for AYP will not be reported for students who have not been in school for a full academic year.

Scores for SOA, for state accreditation will not be reported for students who have been here for less than 11 semesters.

Grading – Students may receive a grade of “n” for no more than one semester. Teachers should implement appropriate accommodations and teaching strategies to provide the support necessary for students to be evaluated. Teachers should give students grades of A, B, C, D and F as soon possible.

ELP Assessment -

LEP students will continue to take the test of English Language Proficiency at the end of the year. Beginning in spring 2004, students will take the ELDA English language development assessment to measure their English proficiency. Scores on the ELDA will be compared to those from the previous year. Ten percent of the LEP student population in Henrico County must move out of ESL and twenty percent must move from one proficiency level to the next.

ESL Proficiency Levels – All LEP students who are receiving ESL instruction are classified by their proficiency in English based on the results of the annual test of English Language Proficiency administered in the spring. There are four classifications aligned with the Virginia English Language Proficiency Standards.

Monitor Status – Students who exit ESL will be formally monitored for two consecutive years. This includes students whose parents request that they be removed from the ESL program. Monitored students will take the ELP assessment in reading and writing each year that they are monitored. Each classroom teacher will be provided with a form on which to document progress. They will return the form to the ESL teacher at the school.
