Week 1 First Messages

Historically, how have human service workers incorporated law into their practice and advocacy roles? What are the potential advantages of using the legal system to improve client and community well-being?

What are the advantages and disadvantages of relying on precedent when making decisions?

How does testifying as an expert witness compare with testifying as a fact witness? What are the similarities? What are the differences?

Should a human service worker ever be held responsible for a client’s suicide? If so, under what circumstances? If not, why not?

Week 2 First Messages

How will the growth of racial and ethnic minority populations affect their place in American society? Will having a majority-minority society lessen discrimination? What will be the impact on the criminal justice system?

The struggle for equal rights for women has been similar in many ways to the struggle for equal rights for racial and ethnic minorities—but it gained traction about 50 years later. As you imagine what life will be like 50 years from now, what additional gains in equal rights can you envision?

Are traditional views of morality an appropriate consideration for the courts? This is a question that drives much of the law presented in the chapter. How has this played out in relation to Lesbian, Gay, Bisexual, and Transgender (LGBT) rights?

Is it ethical for human service workers to assist immigrants who they know are in the country without proper authorization? Should they ask about immigration status? What is their legal responsibility if they know that an immigrant is here illegally? Is that the same, or different, from their ethical responsibility?

How does the law treat searches of student property in school? Review the rationale behind allowing searches without a warrant, as well as the reasonableness requirement and how it has been applied in specific circumstances. How does your state treat locker searches? Do you think this is a good policy? Why or why not?

Week 3 First Messages

In the aftermath of the 2012 Penn State child abuse scandal, a number of states have instituted universal child abuse reporting laws. Are these laws a good idea? Why or why not? How can we best minimize both the underreporting and over reporting of child abuse?

Some states have a presumption against awarding custody to a parent who perpetrates domestic violence? Why or why not? What does the research tell us about the influence of intimate partner abuse on children? Is the research sufficiently compelling to warrant a legal presumption?

How would you explain the resistance to recognizing domestic violence as a crime?

To what extent should the law criminalize cybertalking, cyberharassment, and cyberbullying? Where do you think the line should be drawn? What do you think the appropriate consequences should be?

What are the likely consequences of the global increase in the older adult population? What impact on the criminal justice system can we expect?

Week 4 First Messages

What are the Caplan’s 7 characteristics of effective coping behavior? How do they apply to at risk populations?

What is the potential impact of secondary trauma on human service workers? How can agencies prevent or at least mitigate this impact?

What are the limitations of formal litigation and how can alternative dispute formats better serve those participating in the process? Does the ADR process favor one side of the other?

Does the current financial challenges facing our legal system make ADR a more viable option? Does this approach limit the attainment of justice for those that may choose to participate? Why or why not?

Discuss the stages mediation.

Week 5 First Messages

Do you agree with people who favor adult sanctions for juvenile offenders; for example, “If you’re old enough to do the crime, you’re old enough to do the time”? Why or why not? Where should the line be drawn? Why?

How might the issue of large numbers of inmates who suffer from mental illness or drug addiction be addressed? Is prison the appropriate place for these offenders? If so, under what conditions? If not, where should they be?

What are the four purposes of criminal punishment? How effective do you think the current system is in accomplishing each of these?

Three populations are currently exempt from the death penalty. If the court were to exempt a fourth, who should it be and why?

Why do you think there is such strong objection to the Affordable Care Act? What interests is the law trying to balance?

Should the insanity defense continue to be allowed? What are the purposes of NGRI and its consequences? What are the arguments for and against it?
