The Division of Alcoholic Beverages and Tobacco is responsible for licensing the alcoholic beverage and tobacco industries, for collection and auditing of taxes and fees paid by the licensees, and for enforcing the laws and regulations of the alcoholic beverage and tobacco industries.

How can ABT assist me as a road patrol officer?

Underage drinking in Bars & Clubs:

Many of the calls for service at bars are generated from underage drinking. We can work with you to reduce these problems.

ABT can help you identify fake id's and then we can work together to conduct random checks inside the bar.

ABT can provide an Investigative Aide that will attempt to make alcohol purchases inside the bar. If they sell to the underage person ABT will arrest the bartender and in some cases management staff.

How else can ABT assist me as a road patrol officer?

Convenience Stores that reportedly sell to underage persons:

ABT can send in an investigative aide to purchase alcohol or tobacco products. If the clerk sells to the aide they will be arrested. Subsequent arrests can lead to administrative fines against the business.

What other services can ABT provide to local departments?

ABT can provide hands on inservice training to your department either as part of roll call training or a more extensive training class.

Inspections of licensed premises: Any state, city, county police officer can inspect any licensed premises for tobacco or alcohol violations without a warrant. Any other criminal evidence found while searching for these violations is admissible in court.

Education of licenses premises: ABT provides vendor training through the Special Investigations Unit to educate the owners, managers, and door security on valid forms of id.

Laws Relating to Fake ID's and Underage Drinking:

FSS 322.2616 ? Zero Tolerance ? Automatic Administrative license suspension for 6 months to a year for anyone under 21 with over a .02 BAC. This is done with a roadside portable breath test machine that many departments issue to officers. These results are not criminally admissible.

FSS 562.111 - Possession of Alcohol products by persons under 21 years of age.

FSS 316.193 (1) ? DUI over .08 BAC.
