AFFIDAVIT OF KEVIN JAMES MILLERSHIP

I, Kevin James Millership, of the City of Penticton, in the Province of British Columbia, SWEAR THAT:

1. I am a seasonal first aid attendant employed by Safety First Services in Fort Nelson, B.C., and the plaintiff in this proposed class action. As such, I have personal knowledge of the matters deposed to herein, except where my information is based on information obtained from others, in which case I set out the source of that information and verily believe it to be true.

2. I have conducted a review of my Supreme Court of British Columbia, B.C. Court of Appeal and Supreme Court of Canada file in regards to this case, and have identified the following documents, with one email document from M. Giddings of Health Canada being new evidence:

i) An email from Canada’s member of the Sub/Committee, Ms. M. Giddings, to the plaintiff, Mr. Millership dated May 25, 2005, a copy of which is attached hereto as Exhibit “A”;

ii) Notes and Minutes of the 21st (May 12-13, 1997) to 27th (October 23-24, 2000) Sub/Committee Meetings, a copy of which is attached hereto as Exhibit “B”;

iii) An email from the Sub/Committee’s Secretary and Health Canada employee, Mr. D. Green, to Dr. David Locker of the U of T, a copy of which is attached hereto as Exhibit “C”;

iv) Health Canada’s 1999 commissioned report by Dr. David Locker of the U of T, entitled, Benefits and Risks of Water Fluoridation, An Update of the 1996 Federal-Provincial Sub-committee Report, a copy of which is attached hereto as Exhibit “D”;

v) Sub/Committee’s 1996 Fluoride Guideline, a copy of which is attached hereto as Exhibit “E”;

vi) Health Canada publication, July 2, 1994, Investigation of Inorganic Fluoride and Its Effect on the Occurrence of Dental Caries and Dental Fluorosis in Canada, a copy of which is attached hereto as Exhibit “F”;

vii) The City of Calgary Report of the Expert Panel for Water Fluoridation Review, March 1998, a copy of which is attached hereto as Exhibit “G”;

viii) Health Canada publication, 1977, Environmental Fluoride, a copy of which is attached hereto as Exhibit “H”;

ix) Journal of Canadian Dental Association article by Drs. David Locker and Howard Cohen of U of T entitled, The Science and Ethics of Water Fluoridation, a copy of which is attached hereto as Exhibit “I”;

x) J. Can Dent Association article, 1998;64: 636-9, entitled, Canadian Consensus Conference of the Appropriate Use of Fluoride Supplements for the Prevention of Dental Caries in Children, a copy of which is attached hereto as Exhibit “J”;

xi) J. Public Health Policy article, 1982; 49: 279-89, entitled, The Epidemiological Basis for Water Fluoridation in the Prevention of dental Caries, Burt, BA., a copy of which is attached hereto as Exhibit “K”;

xii) Canadian Dental Assoc. Journal, 1993; 59(3): 272-279, entitled, Appropriate Use of Fluoride in the 1990s, Clark, DC, a copy of which is attached hereto as Exhibit “L”; and,

xiii) Canadian Oxford Dictionary, definition of “fluorosis”, a copy of which is attached hereto as Exhibit “K”
