HOUSE RULES

AMENDMENT TO THE DECLARATION OF CONDOMINIUM

ADOPTED MARCH 24, 1987, Book 5222, Page 1346

We are anxious to create an atmosphere of modest luxury and pleasant living in our condominium home. A certain minimum of regulation is necessary for our mutual comfort. It is with this thought in mind that we ask the cooperation of not only the owners, but of all guests, guests-tenants, visitors and lessee/renters, to see to it that these rules are observed.

DEFINITIONS

Owner: From here on hereafter, ownership of a condominium apartment in Mayan Towers Condominium #1, shall be restricted only to an individual and/or his or her spouse. No resale shall be permitted to any corporation, company, partnership or combination of individual buyers.

Visitors: Persons who visit an owner, guest-tenant or lessee/renter of an apartment in our condominium and do not stay overnight.

Guests: Persons who visit an owner, guest-tenant or lessee/renter of an apartment in our condominium and who stay overnight.

Guest-Tenants: Persons who occupy an apartment with the written consent of an owner and who pay no consideration for such occupancy.

Lessee/Renters: Persons who occupy an apartment with the written consent of an owner and who pay consideration for such occupancy.

REGISTRATION

Anyone occupying an apartment as a guest, guest-tenant or lessee/renter is required to register in the registry book in front of office. This is to comply with the regulations of the Florida Hotel Commission (all multiple dwellings come under this jurisdiction), the fire regulations and also request that the above persons sign the register when leaving, so that, in case of fire or other emergency, no one will be overlooked.

All service personnel must register in the lobby prior to entering any unit or any portion of the common elements of the condominium.

RECREATIONAL FACILITIES

• Our recreational facilities are for the use only by owners, their visitors, guests, guest-tenants and lessee/renters.

• Swimming pool hours are from 8:30 A.M. until 10:00 P.M. The pool gates will be locked at 10:00 P.M.

• Showers are mandatory before entering the pool and must be taken each time before entering if one has been out of the pool for more than a few minutes. If creams and lotions have been used, a hot shower is mandatory!

• Persons with long hair must remove all pins and wear a swimming cap.

• No food or drink is allowed in the pool or on the deck area.

• Full responsibility for the safety and behavior of children must be assumed by the parents or supervisor. No child under the age of twelve shall be permitted in the pool without the presence of supervisors.

• Excessive noise, splashing, running and diving are not permitted. No rafts or other large objects are permitted in the pool. No forms of water polo are permitted.

• Untrained children must wear some form of rubber or plastic garments while in the pool.

• When coming from the beach, wash all sand and tar from feet at the gate. Supplies for this purpose are maintained there.

POOL AREA ACCESS

In order to avoid insurance risks and in keeping with fire safety regulations, it is mandatory that no persons access the pool area through the back stairwell fire doors. These doors are to be kept closed at all times.

POOL AREA ACCESS

The above rules concerning access to the pool area through the back stairwell fire doors has been rescinded.

ATTIRE

Persons wearing dripping bathing attire are not permitted to use the lobby or elevators. All persons should wear a coat, shirt or other upper garment, shoes or sandals in all public areas in the building.

SAFETY

• All hallways, stairways, elevators and public areas of the building must be kept free of grocery carts, toys, bicycles, etc. Everyone should help prevent accidents and assist in maintaining a neat and attractive building.

• It is forbidden to hang bathing suits, towels or other objects on the balcony railings. Sweeping and hosing off the balconies is not permitted. Use of any type of grill, or any open flame on the balconies is not permitted.

• Children may not loiter or play in the halls, on the stairways, in the lobby or elevators. Children under sixteen may not play pool unless accompanied by an adult.

SECURITY RESPONSIBILITY

• Keys for all apartments must be left with the office so that entrance to your apartment may be obtained in event of an emergency. No one will be permitted into your apartment except in the presence of the person in charge and with your express permission, except in the event of an emergency.

• Entrance into your apartment for the monthly extermination treatment will be done only in the presence of the person in charge.

• It is your responsibility to close all windows and doors, check all appliances and remove from shelves all food items not tightly sealed before leaving your apartment for an extended time.

• If your apartment is to be empty for more than twenty-four hours, the main water valve should be turned off and the fuse to the water heater pulled before you leave.

Whenever a unit owner or other occupant shall be absent from their unit in excess of one week, it is the responsibility of that owner or other occupant to turn off the water to the unit in advance of their departure.

• No flammable Christmas trees or decorations should be used in the apartments.

REFUSE

• All waste not acceptable to the disposal unit should be drained, wrapped and tied securely in plastic containers and either taken to the waste room (on the north side of the building) or placed in the chute. No loose papers or magazines may be placed in the chute. (Take all newspapers to the waste room.)

• BOTTLES, ALL GLASSWARE AND LOOSE ITEMS MUST NOT BE PLACED IN THE CHUTE. THEY MAY BE PLACED IN THE CONTAINERS IN THE LAUNDRY ROOM ON EACH FLOOR. GREASE MUST BE PUT IN PROPER CONTAINERS AND TREATED IN THE SAME MANNER.

• All refuse not suitable for the chute or containers in the laundry rooms must be taken to the waste, or trash room on the north side of the building.

• Only readily soluble waste should be flushed down toilets. Sanitary napkins, diapers, etc, should not be disposed of in this manner.

LAUNDRIES

• The laundry machines can be used only between the hours of 8:00 A.M. and 7:00 P.M. OUT OF COURTESY TO YOUR NEIGHBORS, DO NOT USE THE MACHINES AT ANY OTHER HOURS!

• Please be prompt in making the machines available for the next person by removing your wash as soon as the cycle has been completed.

• Do not overload the machines as this is a cause for them to malfunction and overflow.

LAUNDRIES (Continued)

• Keep the laundry room clean and neat. MAKE CERTAIN THAT YOU HAVE CLEANED THE FILTER AFTER USING THE DRIER! GREAT CARE MUST BE TAKEN IN THE USE OF BLEACH. BE CERTAIN THAT NONE IS SPILLED ON THE TILE OR CARPET. CARPET IS EASILY RUINED BY BLEACH!

GROCERY OR PACKAGE CARTS

• Grocery carts are available on the first floor. Please return carts to the first floor promptly after their use. DO NOT LEAVE THEM IN YOUR APARTMENT, IN THE HALLS, OR ON THE ELEVATORS. DO NOT LEAVE THEM OUTSIDE THE BUILDING!

• A clothing rack is available in the locked closet on the first floor where the pool equipment is kept. PLEASE RETURN RACK TO CLOSET PROMPTLY AFTER ITS USE!

• All persons using the grocery carts or clothing rack are requested to enter by one of the side doors. NO WHEELED VEHICLE GROCERY CART, CLOTHING RACK OR HEAVY EQUIPMENT IS TO BE BROUGHT INTO THE LOBBY!

• ALL HEAVY PACKAGES, FURNITURE DELIVERIES OR BUILDING MATERIALS WHOSE DESTINATION IS ONE OF THE UPPER FLOORS MUST REACH THAT DESTINATION BY WAY OF THE EAST ELEVATOR.

NOISE

As a courtesy to others, noise level must be kept at a minimum. All must give consideration to this problem both day and night, within the building, in the recreational area and the halls. Especially at night, refrain from loud conversations in the halls and parking areas. Television sets, radios and other sound producing instruments should be played softly after 11:00 at night. Motorcycles must be pushed into the street before starting the motors.

BUILDING SECURITY

• The front door of the lobby will be locked each night at 10:00 P.M. as a measure of greater security. If entering the building through the front door after 10:00 at night, be certain that this door is locked.

• Under no conditions admit a stranger to the building without proper credentials. Do not open the rear lobby door by means of the buzzer unless you are certain of the identity of the person seeking entrance!

• Do not leave outside doors open!

• Please turn off lights in toilets, bath house and sauna after use.

PETS

No domestic pets are permitted in the building or on the premises.

ALTERATIONS

Installation of shutters, jalousies, screen doors, lights and any other change in the outer appearance of the building must have prior approval of the Board of Directors. NO signs are to be displayed on the apartment doors, windows or balconies.

PARKING

• Each owner has a specific parking space assigned to that owner’s apartment. There is only ONE (1) parking space for each apartment. Guest spaces are in limited supply. Owners with more than one car must arrange for a parking space for the additional car, or cars, with an owner who does not have a car, or with the office person for the use of an available space.

• Guests must use the spaces marked “Guests”. Guest spaces shall not be used for overnight parking without the express permission of the office person.

All service personnel must park their vehicles in guest parking.

• All cars must be parked in a forward position, do not back into the space. Pull up to the bumper and stay within lines on perimeter parking.

• All owners should obtain yellow Mayan Towers parking stickers for application to the rear bumper. Cars parked illegally are subject to warning notification, fines and haulaway charges.

LEASES AND TRANSFER OF OWNERSHIP

No apartment may be sold, leased, rented, transferred or occupied except as specifically set forth herein:

a) No lease or rental can be entered into for a period of less than two months. Each resale, lease or rental is subject to the approval of the Board of Directors of the Associations. Owners are required to submit a request for such approval not less than twenty days prior to the starting date of the proposed occupancy.

No lease or rental can be entered into for a period of less than two months. Each resale, lease or rental is subject to the approval of the Board of Directors of the Association. Owners are required to submit a request for such approval not less than thirty (30) days in advance of the starting date of the proposed occupancy.

b) No resale, lease or rental of a condominium unit shall be made to any party other than an individual and/or his or her spouse. No resale, lease or rental shall be permitted to corporations, companies, partnerships or commercial or business organizations or combinations of individual buyers.

c) There shall be a processing charge of $50.00 payable by the owner to Mayan Towers Condominium No. 1, Inc., for each application for resale, lease or rental of an apartment. This payment shall accompany each

application. The processing charge for lease or rental may be waived if the present lessee applies for use of the same apartment now being occupied, for the same months of the following year while still using this apartment. AMENDED 3-6-1995, #95-072387, Book 8649 Page 1696 There shall be a processing charge in an amount determined by the Board of Directors from time to time in accordance with the provisions of the Florida Condominium Act payable by the seller to Mayan Towers Condominium #1, Inc. for each application for resale, lease or rent, by the selling owner. The payment for the processing of any resale, lease or rental shall accompany each application.

d) A unit owner requesting approval for resale, lease or rental of an apartment shall certify that the purchaser or lessee/renter has been provided with a copy of the condominium rules and regulations and that the purchaser or lessee/renter has read the same and has agreed to comply with said rules and regulations.

e) Occupancy of one bedroom apartments is limited to no more than four (4) persons. Occupancy of two bedroom apartments is limited to no more than six (6) persons.

f) Unit owners shall be responsible for all damage to the building, equipment and furnishings caused by their guests, visitors, family and lessee/renters.

g) All owners not in residence shall notify the office person in advance of the proposed occupancy of their apartment by any person other than the owner. The owner of the apartment shall make available to all such occupants a copy of the rules and regulations and apprise them of the requirements for compliance. A person who occupies an apartment in which the owner is not present, whether or not he is paying the owner for such occupancy is considered a guest-tenant or lessee/renter and accordingly, must conform to all requirements of the Association.
