1. PUBLIC COMMENTS:

3. APPROVAL OF CONSENT AGENDA:

Items on the Consent Agenda are routine business matters for action by the City Council with little or no public discussion. Most items have previously been discussed in committee and carry a staff or committee recommendation. Consent agenda items may be removed by a councilmember for discussion as part of the regular agenda.

A. MAYOR’S APPOINTMENTS: Appoint Ms. Belva Giesing and Ms. Barbara Owens to the Health Education Advisory Board; and, Appoint Mr. Brett Methner to the Historic Preservation Commission.

B. PUBLIC WORKS COMMITTEE:

NOTE: The following items were considered by the Public Works Committee on March 4, 2009.

1) Approval of Modification No. 1 to On-Call Agreement Dated October 18, 2007 (RFQ No. 07-160) (Renewal No. 07-160-1/1R for Professional Land Surveying Services.)

2) Award of RFP No. 09-058-1 and 09-058-2 to Terracon Consultants, Inc., and Kaw Valley Engineering to provide material testing, geotechnical engineering, and special inspection services for the Public Works Department based on unit prices in the attached bid tabulations.

3) Award of Bid No. 808011-C for Todd George Parkway Street Lighting, Blue Parkway to McKee Lane, to Teague Electrical Construction Company, Inc. for a total base bid in the amount of $210,202.50.

4) Award of Bid No. 808012-C for Blackwell Road Street Lighting, Shenandoah Drive to Langsford Road, to Teague Electrical Construction Company, Inc. for a total base bid in the amount of $161,378.60.

5) Award of RFQ 08-107-3 Design Services of Street Lighting for Woods Chapel Road Street Lighting Improvements to Burns & McDonnell, for an amount not-to-exceed $40,208.

6) Award of RFQ 08-107-4 Design Services of Street Lighting for Colbern Road Street Lighting Improvements to TapanAm Associates, Inc., for an amount not-to-exceed $88,091.

C. POLICE DEPARTMENT: Approval of Type G1 Liquor License Application for Embrace the Grape Beverage Catering, 616 SW Third Street.

4. PROPOSED ORDINANCES:

The following proposed ordinances, submitted to the Council as bills, are often passed with little or no public discussion. All items were previously discussed and considered by the Council or committees. This is a formal reading of proposed ordinances.

A. SUBSTITUTE BILL NO. 09-26 An ordinance amending the city of Lee’s summit schedule of fees and charges, ordinance no. 4634, as it relates to SOLID WASTE AND AIRPORT.

B. BILL NO. 09-27 AN ORDINANCE GRANTING A SPECIAL USE PERMIT RENEWAL FOR A GARDEN CENTER AND PLANT NURSERY IN DISTRICT CP-2 ON LAND LOCATED AT 1820 NE COUNTY PARK ROAD FOR A PERIOD OF FIFTEEN (15) YEARS TO EXPIRE MARCH 5, 2024, ALL IN ACCORDANCE WITH ARTICLE 10 WITHIN THE UNIFIED DEVELOPMENT ORDINANCE, FOR THE CITY OF LEE'S SUMMIT, MISSOURI.

C. BILL NO. 09-28 AN ORDINANCE APPROVING A PRELIMINARY DEVELOPMENT PLAN ON LAND LOCATED AT 237 NW BLUE PARKWAY, IN DISTRICT CP-2 AND PO, BUILDING ADDITION FOR MARIE ALLEN ENTERPRISES, ALL IN ACCORDANCE WITH THE PROVISIONS OF UNIFIED DEVELOPMENT ORDINANCE, NO. 5209, FOR THE CITY OF LEE'S SUMMIT, MISSOURI. D. BILL NO. 09-29 AN ORDINANCE AUTHORIZING THE EXECUTION OF AN EASEMENT ACQUISITION AND SEWER CONNECTION AGREEMENT BY AND BETWEEN NORMA JEAN WOOD AND THE CITY OF LEE’S SUMMIT.

E. BILL NO. 09-30 AN ORDINANCE AMENDING CHAPTER 13 OF THE CODE OF ORDINANCES OF THE CITY OF LEE’S SUMMIT, MISSOURI, ARTICLE III. FIRE CODE, TO MODIFY THE USE AND RETAIL SALE OF FIREWORKS WITHIN THE CORPORATE CITY LIMITS.

5. PUBLIC HEARINGS:

A. PUBLIC HEARING To Receive Testimony Concerning a Proposed Franchise Agreement with Missouri Gas Energy To Operate and Maintain A Gas Distribution System in the City of Lee’s Summit. 

6. OTHER BUSINESS:

A. REINTRODUCTION OF BILL NO. 09-19

1) BILL NO. 09-19 APPROVAL OF AN ORDINANCE AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF LEE’S SUMMIT, MISSOURI, AND THE FEDERAL AVIATION ADMINISTRATION FOR SERVICES RELATED TO THE RELOCATION OF FACILITIES AS PART OF THE CITY’S EAST TERMINAL AREA DEVELOPMENT PHASE 1 PROJECT.

B. DISCUSSION: Conceptual redevelopment plan and potential use of LCRA for 207 SE 3rd Street - Licata's Flowers.

C. DISCUSSION: City Initiated Rezoning – ADESSA Properties

D. DISCUSSION: Amendment to the existing real estate contract between the City and Tustin LLC.

1) BILL NO. 09-31 AN ORDINANCE APPROVING THE EXECUTION OF AMENDMENT NO. 1 TO THE REAL ESTATE SALES CONTRACT DATED OCTOBER 1, 2007, BY AND BETWEEN THE CITY OF LEE'S SUMMIT, MISSOURI AND TUSTIN, LLC.

E. PRESENTATION of a City Council Conceptual Proposal Process Chart

F. DISTRIBUTION of Excise License Tax Report
