Legislative IntentIt is the intent of this local law to allow the Village of New Berlin to adopt a budget for the fiscal year commencing June 1, 2021 that requires a real property tax levy in excess of the “tax levy limit” as defined by General Municipal Law § 3-c.Section 2. Authority This local law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes a local government’s governing body to override the property tax cap for the coming fiscal year by the adoption of a local law approved by a vote of sixty percent (60%) of said governing body. Section 3. Tax Levy Limit Override The Board of Trustees of the Village of New Berlin, County of Chenango, is hereby authorized to adopt a budget for the fiscal year commencing June 1, 2021 that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law §3-c. Section 4. Severability PUBLIC HEARING LOCAL LAW 1 OF 2021If a court determines that any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance is invalid or unconstitutional, the court’s order or judgment shall not affect, impair, or invalidate the remainder of this local law, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered. Section 5. Effective dateThis local law shall take effect immediately upon filing with the Secretary of State. There was no public comment on proposed law #1 of 2021. FIRE DEPARTMENTThe fire department responded to 6 calls in the month of December, bringing them to 76 calls year to date. The construction of the firehouse/community center is well under way. The general contractor is working on completing the project within the next few weeks. The Fireman’s prayer plaque is taking longer REGULAR MEETING ATTENDANCE PUBLIC CONCERNS FIRE DEPARTMENT than anticipated, but should be complete and ready for installation by the end of February. EMS REPORTThe ambulance had 59 calls during December, 20 to the Village of New Berlin, 17 to the Town of New Berlin, 5 to the Town of Pittsfield, and 17 other or mutual aid calls. There were 24 billable calls. The Village is awaiting the Town of Pittsfield to sign a contract for ambulance service for the 2021 calendar year. It was on their agenda for discussion at their regular board meeting for January, also being held the same night as the Village meeting. DPW REPORT Jared Kline was not in attendance. He had to drive to Beaver Falls, Pa to pick up a new brine tank for one of the DPW trucks. The Village tank broke during transport of brine and it was imperative to replace it immediately. Having the tank shipped was cost prohibitive. There is money in the equipment budget to cover the expense of the new tank. The board will be asked to approve the $7,000 expenditure under new business. The DPW is moving forward in preparing to make salt brine for the Village, which will save the Village on both time and expenses. There are a few area businesses that are interested in purchasing brine from the Village once we are up and running on production. Carol Riley and Jared Kline will be working with Michael Flannigan on a grant for the next phase of the water system upgrades. Administration costs of the grants that he writes are paid as part of the proceeds of the grants obtained. It would not have any cost to the Village. PRIOR MINUTESMinutes of the December meeting were approved on motion by Carol Riley, seconded by Dave Smith. VOTE: Smith – yes, Priola – yes, Riley – yes, Potter – yes. APPROVEDEMS REPORT DPW REPORT PRIOR MINUTES OLD BUSNESSThe Village board discussed options for covering the funding gap caused by the lack of contract from the grant for the firehouse/community center from Senator Seward. The Village has yet to receive a contract and the project is nearing completion. Mayor Potter says that the State is gearing up to release grant funding this year, but there have not been a release of dates or contracts at this time. It is imperative that the Village finds alternative means to cover the funding in the interim. Several options were discussed and evaluated over. Carol Riley made a motion to accept the first option reviewed as it would have the lowest impact on taxpayer in the event that the grant money does not come through. Michelle Priola seconded the motion. Dave Smith wanted to table the discussion so that he could discuss it first with the Fire Department’s building committee. Carol Riley reminded Dave that it is a board decision and not a committee decision. VOTE: Smith – no, Priola – yes, Riley – yes, Potter – yes. APPROVED A permissive referendum will be scheduled for the February meeting to approve $50,000 to be utilized from the Firehouse’s reserve account. NEW BUSINESSResolution – 2021-1 Whereas the Village of New Berlin will be starting budget preparation for the 2021/2022 Fiscal year that commences on June 1, 2021... Whereas, the Village board of trustees may find it necessary to override the property tax cap for the coming fiscal year... The computer is over 9 years and will be due to be replaced in the near future. Carol Riley thanked Kelly for her foresight in looking at laptops in the event that the State were to require another shutdown in the future it would allow for a smooth transition to keep things processed in a timely fashion. Dave Smith had questions due to the encryption of the laptop that was quoted and the Village’s cyber coverage on the insurance policy. The discussion was tabled until the February meeting when those questions could be answered. Dave Smith made the motion to approve the purchase of the replacement tank for Salt Brine in the amount of $7,000. Michelle Priola seconded the motion. .
