CODE ENFORCEMENT BOARD

• CALL TO ORDER
• ROLL CALL
BOARD MEMBERS PRESENT: Alice Rockhold, Jack Thomas, Dale Eichelberger, Lyle Parrigin & Jerry Wilder.
STAFF PRESENT: Code Enforcement Board Clerk: Tabitha Joiner, Code Enforcement Coordinator: Alex Colovos, Code Officials: Teddy Webb, David Herrman, Melissa Christerson and Tim Butts.
OTHER: Code Enforcement Board Attorney: David Broderick.
• APPROVAL OF MINUTES
June 28, 2011 – Eichelberger made a motion to approve the minutes as written. Parrigin seconded the motion, which passed unanimously.
• COMMENTS / ANNOUNCEMENTS
Code Enforcement Coordinator Alex Colovos spoke briefly about the departmental name change from Housing & Community Development to Neighborhood & Community Services.
Christerson spoke about the signs posted in the area around the square. Pictures were presented on the signs as well.
• PARKING / ANIMAL CONTROL/SMOKING CITATIONS
Case 2011-1886 – Parking Ticket BG116616 – 1704 Ogden Rd - Respondent: An Nguyen – Officer: Stephany Campbell
Citation amount: $25.00
Campbell explained that this vehicle was partially parked in the yellow marked curb. Normally a ticket will only be issued if half or more of a vehicle is parked in the yellow, but there was a parking lot directly beside where the vehicle was parked & it would have been difficult for someone pulling out of that parking lot to see around that vehicle. That is why the ticket was issued.
Nguyen stated he was not in the yellow very much & this was his first time getting a parking ticket. He was parking to go up to WKU for classes.
Wilder made a motion to uphold the citation and waive the fine. Rockhold seconded motion which passed unanimously.
• HEARING AGENDA
Case 2011-1455 – 501 Old Morgantown Road – Respondent: West Star Properties – Officer: Teddy Webb
Citation amount: $55.59
Respondent was not present.
Webb explained that this property is located where the city is expanding the road on Old Morgantown Rd & when our contractors had the property mowed, they had no trouble getting in & out of the property. The property is now in violation again due to overgrown grass & a new Notice of Violation has been mailed out.
No order needed. Citation & fine will stand as written.
Case 2011-917 – 1586 Old Louisville Rd – Respondent: Tony Jones – Officer: David Herrman
Citation amount: $505.59
Herrman started explaining that this was the third citation on this property. This came in as a complaint in May 2011 & was originally assigned to Teddy Webb, who went to look at the electrical issues. After going out to the property several times a meeting was set up with the owner as well as the business owner. At the meeting both parties were given a detailed list of all the items that needed to be brought into compliance.
Jones came to the podium and stated that they were never able to get & keep the power to the building that they had. The city would never give them power. Jones stated he didn’t understand a lot of what the cleanup was about & didn’t understand why it sat in this condition until he bought the property.
Rick Maxwell came to the podium stated that one time he went to the property, at that inspection the power cords were going into the structure through a hole in the wall, the power was cut off to the property at that time. The next time he had to go to this property an extension cord was plugged into the neighbor’s house leading into the structure. Maxwell explained to the neighbor that this was not allowed & to not plug the extension cord back up.
Glen Burns, chief building inspector, came to the podium and stated that the structure on the property was not a storage shed & was not the appropriate structure for work to be conducted in. A permit was approved for a storage building & that is all this building will be able to be used for. No power can go to a storage building because it is not a permanent structure.
Thomas made a motion to give until the August 23, 2011 board meeting to get the
property into compliance. At that time, if the property is in compliance the citation & fine will be waived. Eichelberger seconded motion which passed 3-2.
• OLD BUSINESS
Case 2010-573 – 545 Lost Cir – Respondent: Carla & Don Leeseberg – Code Official: Melissa Christerson
Citation amount - $130.54
Property is incompliance. No motion needed.
Case 2010-1466 – 1333 Scottsville Road – Respondent: William Davis & Keith Dietz – Code Official: David Herrman
Citation amount - $200.00
Case will be heard at the August 23, 2011 meeting.
A Motion was not required by the Board.
Case 2010-4235 – 814 Steeplechase Way – Respondent: Susan & Greg Gibson – Code Official: Melissa Christerson
Citation amount - $130.54
Colovos explained that he received an email from Tammy Wethington, paralegal for the city, that stated James Jones has filed in probate court to sell off all real-estate & to order the Gibson’s to vacate the property. The hearing is scheduled for 9/2/11 at 10:00 A M. There is also an eviction hearing to be held on 7/29/11 & then the set out would happen on 9/5/11 if the eviction is upheld.
CEB would like to revisit this property on August 23, 2011 meeting.
A Motion was not required by the Board.

Motion made to approve all fees was made by Rockhold and seconded by Parrigin. Motion passed unanimously.
Case 2010-1904/2010-3308/2011-737 – 1138 Cedarwood Way –Fees need to be removed due to the property being sold. Property was sold before lien was filed.
Citation Total: $461.08
Thomas made motion to remove fees from this property. Rockhold seconded motion which passed unanimously.
Case 2009-8080/2010-1567– 127 Riverwood Ave –Fees need to be removed due to the property being sold. Property was sold before lien was filed.
Citation Total: $376.08
Thomas made motion to remove fees from this property. Rockhold seconded motion which passed unanimously.
