A. CALL TO ORDER

The July 5, 2005, meeting of the DeSoto County Board of Supervisors was called to order by Supervisor Tommy Lewis, Board President.

Chief Deputy Charlie Brown of the DeSoto County Sheriff's Department was present and did open the DeSoto County Board of Supervisors meeting in a regular session to hear any and all business to come before the Board. The following were present:

The official minutes of the Board of Supervisors were read for the month of June 2005, pursuant to Section 19-3-27 of the Mississippi Code of 1972, Annotated. Supervisor Eugene Thach made the motion and Supervisor Tommy Lewis seconded the motion to approve the minutes of the Board of Supervisors, with clarifications made by the Supervisors, for the month of June 2005. The motion passed by a unanimous vote.

1. Port Commission Appointments ?

a. District 2

Supervisor Eugene Thach made the motion and Supervisor Allen Latimer seconded the motion to reappoint Jim Brown, 416 Sandalwood Dr., Southaven, Mississippi, 38671, as District 2 Port Commission appointee to serve a term set to expire July 1, 2010. The motion passed by a unanimous vote.

b. At Large

Supervisor Bill Russell made the motion and Supervisor Eugene Thach seconded the motion to hold this item over until July 6, 2005. The motion passed by a unanimous vote.

G. NEW BUSINESS

1. Tax Assessor ? Approval of Tax Roll

The DeSoto County Tax Assessor, Parker Pickle, appeared before the Board of Supervisors to present the preliminary tax rolls for Real & Personal Property Assessments for DeSoto County for the 2005 tax year. Mr. Pickle said that DeSoto County experienced a 9.7% increase in appraised value and an 8.4% in assessed value.

This day came on to be considered by the Board of Supervisors of DeSoto County, Mississippi, the matter of equalizing assessments of real and personal property for the year 2005, and the Board affirmatively finds and adjudicates that Parker Pickle, Tax Assessor of DeSoto County, has completed and filed the 2005 real and personal assessment rolls of DeSoto County, Mississippi, and in accordance with the provisions of Section 27-35-81, Mississippi Code 1972, has delivered the said rolls in legal form to the Clerk of the Board of Supervisors of this county on or before the First Monday of July 2005, and that said Assessor has made and appended to said real and personal rolls the affidavit in the form and as provided by law.

NOW THEREFORE, it is ordered that this Board of Supervisors will immediately at its July 5, 2005 meeting proceed to equalize such rolls and will cause to be assessed any person, or thing, found to be omitted, and correctly value any property found to be undervalued, and do all things required by Section 27-35-87, Code of 1972, and other laws, and cause all corrections to be made in the said rolls, and will complete such equalization at least ten (10) days before the August, 2005 meeting, and upon adjournment will immediately by newspaper publication notify the public that such rolls so equalized are ready and open for inspection and examination.

Supervisor Eugene Thach made the motion and Supervisor Bill Russell seconded the motion to accept the preliminary tax rolls for Real & Personal Property Assessments for DeSoto County for the 2005 tax year as presented by Tax Assessor Parker Pickle. The motion passed by a unanimous vote.

Supervisor Allen Latimer asked who assesses the value on railroads. Mr. Pickle said the

State.

Mr. Pickle said the growth does not appear to be slowing down.

Supervisor Thach asked about apartments and how we came out on that legislation. Mr. Pickle said he doesn't know either. He said the new legislation will reduce the County's tax income from low income apartments. He said the legislation is retroactive to 2005. He said in actual dollars the County will lose $288,000.

Supervisor Bill Russell made the motion and Supervisor Eugene Thach seconded the motion to accept the tax roll and to issue the Public Notice in connection with the tax roll. The motion passed by a unanimous vote.

Supervisor Jessie Medlin said that he read an article on the assessment of oil pipelines. Mr. Pickle said that there is a bill introduced in the U.S. Senate. Supervisor Russell asked the County Administrator to draft a letter opposing the pipeline assessment change to the State Senators and Representatives.

Mr. Pickle said that Section 42 low income apartments are retro and included in the recap.

Supervisor Bill Russell made the motion and Supervisor Jessie Medlin seconded the motion to authorize the County Administrator to draft a letter regarding the Section 42 apartment assessments voicing our concern about apartment's taxation and to voice our concern about the pipeline legislation to send to State Senators, Representatives, and the Governor. The motion passed by a unanimous vote.

2. Chamber of Commerce ? Hernando Music & Heritage Festival

Brian Goff, Director of the Hernando Chamber of Commerce, appeared before the Board of Supervisors regarding the Third Annual Hernando Music and Heritage Festival, which will be held September 29 ? October 1, 2005. Mr. Goff said that the festival is being moved to the last weekend in September due to the weather.

Mr. Goff said that he was before the Board of Supervisors for two purposes: 1) to request the use of public facilities. Mr. Goff said the event starts on Thursday, September 29. He said on Friday the event transitions to Losher Street, from Hwy 51 to the corner of Panola Street. Mr. Goff said, in addition, the request is to use the Courthouse for the events. He said the wedding renewal ceremony will take place on Saturday which promotes Hernando and the DeSoto County area.

Mr. Goff said there is a need to establish perimeters for the event. Mr. Goff said they have no control over what people bring to the festival. He said they are concerned about alcohol being brought into the event which is a liability. He said with an established perimeter there is control by the police officers and the Sheriff's Department. He said on Thursday and Friday the event will sell alcohol. On Saturday there will not be alcohol sales. Supervisor Thach asked who will control the event. Mr. Garriga said the police and Sheriff's Department will. He said the gate will be controlled by the staff.

Mr. Goff said the second request is for assistance for the event through the Park Funds. He said this is a popular event for this area.

Supervisor Jessie Medlin asked where Losher is closed. Mr. Goff said Hwy 51 to Timbeaux's to set up the stage. He said officers will be on the corner to direct traffic. Supervisor Medlin requested the event work toward not closing the streets if possible, especially Losher.

Supervisor Tommy Lewis asked what is being done on the Courthouse lawn. Mr. Goff said only the wedding renewal ceremony. He said in the event of rain this will move inside.

Supervisor Tommy Lewis made the motion and Supervisor Allen Latimer seconded the motion to transfer $1,000 from the District 5 Park Fund to Advertising County Resources, to transfer $500 from the District 2 Park Fund to Advertising County Resources and to transfer $1,000 from the District 1 Park Fund to Advertising County Resources and to approve the use of the Courthouse, keeping in mind that the Sheriff's Office has ultimate authority by Statute over the Courthouse, and to include the closing of the streets. The motion passed by a unanimous vote.

Supervisor Jessie Medlin said that he has a problem with closing the street. Mr. Goff said that he will talk to the event sponsor to avoid or decrease the closure if possible.

3. Pipe & Inspection Ordinance Public Hearing

Board Attorney Jody Neyman said that the Pipe and Inspection Ordinance has been approved and adopted by the Board of Supervisors. Mr. Neyman said the Public Hearing is to hear any questions from the public.

Supervisor Jessie Medlin made the motion and Supervisor Allen Latimer seconded the motion to open the Public Hearing on the Pipe and Inspection Ordinance. The motion passed by a unanimous vote.

Olive Branch City Engineer Steve Bigelow said that concrete pipe is in the best interest of the whole County. He thanked the Board of Supervisors for allowing its use.

Supervisor Bill Russell asked if Olive Branch is going to change their Ordinance. Mr. Bigelow said that their intention was to follow the County's Ordinance and their requests are handled administratively.

Board Attorney Jody Neyman said the Board of Supervisors needs to determine when the Ordinance is going into effect.

Supervisor Eugene Thach made the motion and Supervisor Bill Russell seconded the motion to close the Public Hearing. The motion passed by a unanimous vote.

County Engineer Andy Swims said that this change began in November 2004 and he felt that 30 days was a reasonable timeframe for the change, since there has been so much discussion already.

Supervisor Bill Russell asked why it is necessary to wait 30 days to put the Ordinance into effect. Mr. Swims said to allow 30 days would be going above and beyond the call of duty. He said 30 days would allow his department to send a letter out notifying people of the change.

Supervisor Tommy Lewis asked what would happen if an application is filed tomorrow. Mr. Swims said if they have submitted a plan before August 5th they will not be required to follow

the new Ordinance.

Supervisor Eugene Thach made the motion and Supervisor Jessie Medlin seconded the motion to approve the Pipe and Inspection Ordinance to go into effect in 30 days or August 5, 2005. The motion passed by a vote as follows:
