Instructions to Bidders

Sealed bids, for furnishing COPIERS, for the period of 3 or 4 years, July 1, 2018 through June 30, 2022, to the members of this cooperative will be received at the time and date below.

Bids will be received until 11:00 a.m. on May 3rd and must be submitted in a sealed envelope, plainly marked:

If you are mailing your bid or sending it by carrier service, please make sure you allow enough time for your bid to be received by May 2nd. You may mail the bid to the cooperative address listed below.

Any bid received after the date and time specified, will not be considered. The members of this bid reserve the right to accept or reject any and all bids in total or in part as they may deem to be in the best interest of the members that this Cooperative represents.

Bidders are urged to read all documents carefully and fill out all information requested. The specifications indicated the kind of products the Cooperative will accept bids on and are not meant to be restricted. If you are bidding on name brands and alternate brands, please specify the brand names and correct product numbers you are bidding on. Please make sure that all numbers and/or letters are clear in order to avoid a mistake. Each participating member will be solely responsible for ordering their items, arranging delivery of the items, and payment of their invoices.

The cooperative is requesting FIRM bid prices on copiers for the period of 3 or 4 years, July 1, 2018 through June 30, 2022.

Please submit a bid on EVERY item. If you do not carry the item or are not bidding on the item please note with a “no bid” on the price line. If an item on our bid and/or its packaging size is different from what you carry, you MUST note the changes on your bid.

NOTE:

EASTCONN Cooperative Purchasing reserves the right to increase or decrease the number of units to be purchased at the quoted unit price.

Bidders are instructed that additional members may be added or deleted at the pleasure of the cooperative. Our current committed membership is attached.

The considerations that will be looked at when choosing our vendor(s) for our bid are based on a 100 points system:

SPECIFICATIONS

PERIOD OF LEASE

1. 36 months (lease to commence 7/1/18 and terminate on 6/30/21). There is a one-two month buyout needed for the member’s contracts that expire after July 1, 2018.

48 months (lease to commence 7/1/18 and terminate on 6/30/22). There is a one-two month buyout needed for the member’s contracts that expire after July 1, 2018.

COPIER VOLUMES

1. See attached sheets, Appendix A for volumes of each copier by machine and location.

AWARDS OF BIDS

1. The members reserve the right to accept or reject any or all bids or to accept the bid deemed in the best interest of the school/member or Boards of Education. Bids are not solely awarded on the lowest prices.

2. The cooperative may not consider as informal any bid not prepared and submitted in accordance with provisions hereof, and hereby reserves the right to waive any rejections shall be in the best interest of the districts to do so.

3. Bidders are instructed that additional school districts/members may be added or deleted by the EASTCONN Cooperative during bid period.

4. The awarded contractor shall maintain, in effect, all necessary and required insurance coverage’s related to their business and equipment as specified by State and/or local authorities. A certificate of insurance must be supplied, if required.

5. The awarded vendor(s) MUST guarantee to keep the EASTCONN Cooperative’s bid pricing exclusive to EASTCONN Cooperative members for a period of 12 months commencing with the date of the bid award. The awarded vendor(s) may refer business who do not appear on the EASTCONN Cooperative’s participating membership list, to the EASTCONN Cooperative coordinator to become members in order to receive our exclusive pricing. Charging the EASTCONN Cooperative bid prices to non-member school districts will be in violation of this bid and the EASTCONN Cooperative will terminate their business with the vendor immediately. In addition, it could further disqualify that vendor from the next bid.

6. EASTCONN will award the contract to the lowest responsive and responsible bidder or bid/offer most advantageous to the program with price and other factors considered. {2 CFR Part 200.320©(2)(iv) or (d)(4)/7 CFR 3016.36(d)(2)}

7. This proposal shall become part of any contract signed with the awarded vendor.

8. Top two (2) bidders will be contacted on or before May 15th and be required to deliver a copier to EASTCONN in Hampton (376 Hartford Turnpike) to be tested for compatibility, user friendliness, and functionality. Copiers will need to be left for seven (7) days to be tested. After the seven days, the copiers will need to be promptly picked up at bidders’ expense.

LOCATION

1. Please be aware that some schools/members have security issues that you will need to meet regarding your delivering of your products.

INTENT

1. The Cooperative reserves the right to consider and accept modifications of these specifications, which, in the opinion of the Cooperative are in the best interest of the members involved.

BID SUBMISSION REQUIREMENTS

1. Please indicate the brand of copier in the brand column that you are submitting pricing on.

2. Any questions by bidders must be submitted in writing, not orally. Submission can be done via email to sgarcia@ or mail to EASTCONN, ATTN: Sandra Garcia, 1320 Main Street, Willimantic, CT 06226.

CONDITIONS OF BID

1. Companies must submit a bid on the bid proposal form for the supply and delivery of copiers to the members, as specified for the period of July 1, 2018 through June 30, 2022.

2. Bid prices shall be for a FIRM price starting on July 1, 2018 through June 30, 2022. (36 month or 48 month lease)

3. All members listed are committed to this bid.

4. Each carrier shall furnish a certificate of insurance issued by an insurance company showing that the Boards of Education will be protected from loss or damage to the Board of Education’s commodities, and injury or death of third persons or to carrier’s employees. Carrier will assume full common liability for all shipments.

5. Vendors must submit a capability statement with the bid proposal along with three (3) reference letters.

6. Bidders shall not sub-contract or sub-let any part of this bid without prior written permission of the cooperative.

7. Awarded bidder will need to payoff current contracts of copiers in the amount of $10,364.84.

QUIALITY AND STANDARDS

1. Vendor to be responsible for any products recalled from a manufacturer and to provide verification.

SERVICE

1. All service calls will be responded to within 4 hours of initial call.

2. If for any reason, the primary copier is down and unusable, a temporary replacement will be delivered within 24 hours until copier is repaired and in full working condition.

3. All machines must be supplied and maintained with additional toner and developer cartridges to prevent down time due to a shortage of supplies.

4. Training must be provided on both an initial basis and ongoing and individually as needed by the cooperative/members.

DELIVERY OF EQUIPMENT & SUPPLIES

1. All copiers must be delivered to each designated location and placed, set-up on a mutually agreed upon date by the awarded vendor and EASTCONN’s Cooperative at no cost. An implementation schedule shall be included. The members and vendor’s responsibilities shall be included. All equipment must be installed and functional no later than July 2, 2018. If the installed and functional date is after July 2, 2018, there will be a monetary penalty assessed to the vendor at a daily rate of $1,000 until all machines are installed functional at all locations.

2. All bids must include setup, supplies including initial toner, developer and everything else needed to allow turnkey operation.

3. All machines shall include staples as part of cost per copy if applicable.

TAX EXEMPT STATUS

1. Most of our members are exempt from the payment of Federal, State, or Local taxes, and enjoy such status under Section 12-412 of the General Statues of the State of Connecticut. Bid submissions should not include tax applications, unless there is a member that is not tax exempt, nor should any subsequent billings for items furnished.

BID PERIOD

1. The bid period is from July 1, 2018 through June 30, 2022. (dependent upon the lease option 36 or 48 month)

2. Sealed bids must be received by the EASTCONN Cooperative Purchasing office by 11 a.m. on May 3rd Faxed copies are not accepted.

3. Successful bids will be awarded by email before May 18, 2018.

INVOICES AND STATEMENTS

1. Monthly invoices will need to be submitted to members with a break out of actual meter readings, the true copies made on each copier and by each account.

2. All bills will be paid within forty-five (45) days of date of invoice.

3. Each participating member will be solely responsible for payment of its own invoices.

CONTRACT TERMINATION

1. The Cooperative, reserves the right to cancel this bid at any time the vendor’s performance is, in the opinion of the cooperative, deemed unsatisfactory. In such event, the cooperative, in writing, shall notify the vendor of such unsatisfactory performance and the vendor shall be given thirty (30) days to remedy the problem (s). If conditions do not meet the cooperative’s approval, the vendor will then be given, in writing, an additional thirty (30) days’ notice of termination. The cooperative members will be responsible for goods delivered and services rendered and accepted prior to the effective date of termination.

2. Members of the cooperative may terminate the contract at any point for convenience with a 60 days’ notice in writing.

3. In the event that a member’s location/business closes, the respective member reserves the right to cancel this contract within thirty (30) days after written notification to the awarded vendor. Example: A schools building closes, the district can cancel that portion of the contract.

4. A district may cancel a contract due to lack of appropriated funds.

EXECUTION OF CONTRACT

1. EASTCONN Cooperative will not agree to any additional terms and conditions except those conditions stated in this document.

2. All machines will be maintained on a cost per copy basis with an all-inclusive maintenance contract that includes everything except paper.

3. All machines will be the latest digital models offered by the manufacturer(s). All vendors must state the model release date for each copier model contained in their bid. All copiers shall be new. No used or refurbished copiers will be considered for award.

4. All machines are to be quoted individually. (spec sheet of machines attached)

5. All machines shall have networking capabilities when leased and will be deemed functional by the information services division director/technology director or his/her designee at each location.

6. Winning vendor will upgrade equipment upon request with no increase to members contracted price per copy.

7. Quarterly reports and a year-end report will be forwarded to the cooperative coordinator, which will reflect detail copier activities.

8. All bidders are required to provide electrical requirements for all copiers included in the bid.

9. The supplier shall be responsible for the payment of any and all local property taxes and insurances on the copiers supplied to the members under contract.

10. All internal storage and memory shall be wiped off/cleaned at the end of the lease and the storage/drive shall be re-formatted at the vendor’s expense. Proof that this has been done will be submitted to EASTCONN.

11. All machines shall be removed from the sites at the end of the lease at the vendor’s expense. All internal storage and memory shall be wiped off/cleaned from old machines prior to the machines leaving any of EASTCONN premises. Proof that his has been done will need to be submitted to EASTCONN within 48 hours.

12. Free capable out of the box follow me print per location on all machines with unlimited codes for employees/staff.

COPIER DRIVER/SOFTWARE

1. Compatible with Windows 7/10/Mac OS/ChromeOS (Airprint/Google Cloudprint).

2. Windows print server driver/software compatible with Windows Server 2012/2016.

3. All software functions available for all platforms (e.g end-user selection of options when printing).

4. Windows update compatible – driver will continue to work when Windows updates are performed on server or workstation.

Written Code of Conduct

EASTCONN Cooperative

Regulations: 2 CFR Part 200.318, formerly 7 CFR Part 3016.36(b)(3) and EASTCONN’s Cooperative local purchasing requirements.

Procedures: The EASTCONN Cooperative seeks to conduct all procurement procedures:

• in compliance with stated regulations; and

• to prohibit conflicts of interest and actions of employees engaged in the selection, award and administration of contracts.

No employee, officer, or agent may participate in the selection, award, or administration of a contract supported by a federal, state, or local award if he or she has a real or apparent conflict of interest. Such a conflict of interest would arise when the employee, officer, or agent, any member of his or her immediate family, his or her partner, or an organization which employs or is about to employ any of the parties indicated herein, has a financial or other interest in or a tangible personal benefit from a firm considered for a contract.
