ORDER OF REVOCATION

BE IT KNOWN that on this date came on for consideration the petition of the DIVISION OF TEACHER CERTIFICATION, TEXAS EDUCATION AGENCY, Petitioner, requesting that the Commissioner of Education enter an order revoking the following certificates held in the name of GLORIA P. HANDY, Respondent:

1. Paraprofessional Educational Secretary II Certificate No. XXX-XX-XXXX; and

2. Paraprofessional Educational Aide II Certificate No. XXX-XX-XXXX;

and, for just cause Petitioner alleges as follows:

6. Gloria P. Handy conducted her teaching activities in violation of the laws of this state by committing the following acts while employed as a paraprofessional at HISD (Huntsville Independent School District):

Intentional and knowing falsification of the following state documents:

(a) Texas Teacher Service Record - contains misrepresentations of dates of employment with Palo Verde Unified School District and forgery of a school official's authorized signature.

(b) Texas Teacher Service Record - contains alterations of comments by the personnel director for for Provo City Schools, Provo, Utah, and forgery of the school official's authorized signature.

7. As a result of the above misrepresentations and forgeries, Huntsville Independent School District made salary adjustments which overpaid Gloria P. Handy in the amount of $248.20. Huntsville Independent School District made demand for the over-payment by letter dated June 13, 1984, and offered to accept installment payments. Gloria P. Handy has not made any restitution of the money and continues to refuse to make payment.

A review of the administrative record reveals that, by letters dated January 4 and February 12, 1985, Respondent was granted the opportunity to file a request for a hearing to contest the proposed revocation action; and further, that by failure to claim the letter dated January 4, 1985 or to respond in any way to the letter dated February 12, 1985, Respondent has waived a hearing to contest such action. Therefore, in the absence of Respondent's Answer, Petitioner's allegations are taken as true, and, pursuant to Tex. Educ. Code Ann. §13.046 (Vernon 1972), Respondent is found to be unworthy to instruct the youth of this State, and therefore, it is accordingly

ORDERED that Petitioner's request be GRANTED, and Respondent's Texas Paraprofessional Certificates are hereby REVOKED; and, it is

FURTHER ORDERED that Petitioner ensure that appropriate notices be immediately prepared and distributed.
