CASE FILE CHECKLIST

APPLICATION FOR FEE WAIVER (If applicant qualifies, otherwise see fee requirements below)

___ Birth Certificate of applicant (with translation and affidavit of translation if needed)

___ Any additional identity document(s) of applicant (state ID, driver’s license, etc.)

___ Any prior immigration document(s) of applicant (I-94, Border crossing card, prior applications, other)

APPLICATIONS FOR EACH QUALIFYING FAMILY MEMBER (QFM)

___ Form G-28 Notice of Appearance for each QFM

___ Form I-918A for each QFM

___ Birth Certificates of each QFM (with translation and affidavit of translation if needed)

___ Marriage Certificate of QFM, if applicant’s spouse (with translation and affidavit of translation if needed)

___ Any additional identity document(s) of each QFM (state ID, driver’s license, etc.)

___ Any prior immigration documents of each QFM (I-94, Border crossing card, prior applications, other)

WAIVER APPLICATION (Applies to Primary Applicants and QFMs)

___ $585 filing fee for each waiver applicant, check or money order payable to: U.S. Department of Homeland Security (or fee waiver, above)

___ Form I-192 for applicant and each QFM (domestic or abroad), as needed

___ Form I-193 for any applicant or QFM abroad, as needed

___ A statement from each I-192 (or I-193) applicant regarding positive characteristics, connections to and accomplishments in the U.S., any volunteer work, community participation (school, church, etc.), why he/she cannot return to home country. Statement should also address negative factors (each waiver ground, criminal conduct, no passport). Include translation and affidavit of translation if needed.

____ Letters in support of character, community interest in keeping each I-192(or I-193) applicant or QFM (employers, neightbors, friends, family, shelter advocates, social workers, co-workers, religious leaders, children’s teachers, etc.)

___ Certificates of accomplishment, awards, academic achievements, etc. for each I-192 (or I-193) applicant

___ Police Clearance letters of places of residence/good conduct letters etc. for each I-192 (or I-193) applicant (Not required, but may be used if no other solid evidence of “public interest”)

___ Copies of any criminal records for applicant (police and court records, including traffic) and proof of compliance with case outcomes etc. for each I-192 (or I-193) applicant

___ Birth Certificates of all children of each I-192 (or I-193) applicant with translation and affidavit of translation if needed

___ Copy of biographic page of valid, unexpired passport of each I-92(or I-193) applicant (if no passport available, include as waiver ground on I-192 (or I-193))

APPLICATION FOR WORK AUTHORIZATION UNDER THE U VISA (For Derivatives Only)[1]

___ Two passport style photographs of each QFM

___ $380 filing fee for each I-765, check or money order payable to: U.S. Department of Homeland Security (or fee waiver, above)

___ Form I-765 for each QFM under category (a)(20) for work authorization approved U visa

[1] Please note that work authorization applications should be filed for all derivatives despite their age or ability to work. The I-765 should be filed concurrently with the derivatives I-918A application for QFMs in the U.S. For QFMs filing from abroad, the I-765 should be submitted once that QFM consular processes and arrives in the United States.
