Brief Overview of Professional Judgment

Slide 10 ? 2020 NASFAA

10

Professional Judgment Defined

Professional Judgment is the discretion granted to financial aid administrators by law to override dependency status and/or make adjustments to need analysis, including data elements used to calculate the EFC and costs within the COA components. The FAA decides if adjustments to standard components of need analysis are warranted due to special circumstances.

Statutory Authority and SubRegulatory Guidance

HEA 479A and 480(d)(7) The law prohibits ED from regulating the exercise of PJ, but allows sub-regulatory guidance: ? FSA Handbook, AVG Chapter 5 ? GEN-16-03 (PPY) ? GEN-11-15 and GEN-03-07(dependency

overrides) ? GEN-11-07 (participation in DL program) ? GEN-11-04, GEN-09-05, GEN-09-04, and EA

5/21/10 (updates on PJ)

Dear Colleague Letter GEN 09-05 No Longer Applies

? This DCL was recently marked "For Historical Purposes Only" on IFAP

? References to this guidance in the 2020-21 FSA Handbook were removed and "errata" were posted on 6/12/20

? Removes guidance for across the board zeroing out of unemployment benefits for independent students

? Does not change an FAA's authority to adjust any data element on a case by case basis

HEROES Act

ED encourages FAAs to use PJ to reflect more accurately the financial need of students identified as "affected individuals": ? Serving on active duty during a war or other military

operation or national emergency; ? Performing qualifying National Guard duty during a

war or other military operation or national emergency; ? Reside or are employed in a disaster area in connection with a national emergency; or ? Suffer economic hardship as a direct result of a war or other military operation or national emergency, as determined by ED.

14

Principles of PJ

? Case-by-case ? Fully documented ? FAA's own decision

? Can't use a PJ decision from another school ? Exception: dependency override
