NEW YORK, Oct. 3. If you happen
to own a railroad and know the combination at 26 Broadway, you can get
all tho lubricating- oil you want for 24
cents a gallon. If you are burdened
with a railroad and don't know the
combination the price will be 48 cents.
If, however, you happen to own a
larg-nectlon of the Standard Oil Company, to be known as the great mogul
of "the system," and to possess a little railroad as a side line, you will go
to an independent and get some good
oil to reduce the friction on the line.
These facts were brought out when
the Standard Oil hearing, which has as
Its object the dissolution of tne combine, was resumed here today. C. C.
Kteinbrenner, accountant of the Galena
Signal OH Company, a subsidiary of
the Standard, testified that his company supplies 97 per cent of the railroads of the United States, Canada and
Mexico with all the lubricating oil
they use. He caused some surprise by
saying that one of the few roads his
company does not supply is the Tidewater Railway In Virginia, owned by
H. H. Rogers. Mr. Kellogg, attorney
for the Government, suggested that
perhaps Mr. Rogers wanted good oil.
Mr. Stelnbrenner didn't know anything

LAW
Declare
Sherman
Act Restrains
Trade More Than Trusts.
DENVER. Oet. 3. According to a reso-
lution adopted by the annual convention
of the National Wholesale Druggists' As-
sociation, now In session here, the Slier-ma- n
law Is entirely too radical
and should be amended, or new legislation
enacted to permit reasonable trade agreements. The resolution declares the belief
of the association to be that the literal application of the Sherman law will create
the greatest possible restraint of trade,
although that is the condition It Is intended to prevent.
The association also declared cocaine to
be the most pernicious of all drugs and
one of Its members suggested that sales
to retailers be limited to an ounce at a
time. Just enough to use in prescriptions.
The National pure food law received
hearty support.
The report of the committee on elections, naming- - the following officers of
the Wholesale Druggists- - Association for
the ensuing year, was unanimously
adopted today by the convention.

RUSH WHEAT TO PORTLAND
TACOMA,
Wash., Oct. 3. (Special.)
Owing to shortage of ships at Tacoma
and a scarcity of cars everywhere, unusually heavy shipments of wheat are
passing through Tacoma for Portland,
where the grain will be loaded for Coastwise and foreign trade.
Early in the season there are usually
some shipments for the Coast, but nothing like the present rush has ever been
seen In the Northern Pacific yards. Six
hundred cars passed through for the Oregon metropolis last month, and no one
can see the end as yet.
A Northern Pacific official estimates
that about 90,000 bushels are handled
daily In the yards, and so far as can be
seen there will be no lot up in the supply for a month. The warehouses are
full and until ships can be rushed to Tacoma to load for the foreign trade, the
wheat must be shipped to other ports to
make room for more.
The testers at the, warehouses say that
the grade of the cars is high, and that
little of it has been damaged.

the Galena Signal Oil Company, which
secures its supply from the
Standard Oil Company at the same price
as it is sold to the railroads. The Galena
Signal Company gets no refund.
Mr. Kellogg then read a letter from
Charles Miller, president of the Galena
Signal Oil Company, written on February 23. 1!H6, to D. D. Morony, vice president of the Pittsburg, Shawmut & Northern Railroad, in which Mr. Miller stated
that the Galena Signal Oil Company was
supplying 97 per cent of the total railway mileage of the United States,
Canada and Mexico with lubricating oil.
Mr.
Steinbrenner said that he
thought the Galena company supplied
about 95 per cent of the total railway
mileage.
Contracts of railroads with
the Galena Signal Oil Company were
placed In evidence, showing the price
charged.
Mr. Kellogg cited a clause
In the contract stating that, if Franklin c.rude oil declined 25 cents below
J3.90 a barrel a reduction would be
made to the railroads. The witness
said no such reduction had been made
during the 14 years of his connection
with the Galena Signal Oil Company.'
The Galena company, he said, sells between Son, 000 and 600.0(10 barrels of
lubricating oil each year.
"Don't you know that the output of
Franklin crude oil Is only 40.000 barrels a year?" asked Mr. Kellogg. The
witness said he did not.
Mr. Kellogg called attention to a
clause in the Galena company's contract with the railroads by which a refund was to be allowed the roads in
case the cost of locomotive oil
$1.75 per 1000 miles. Mr. Stelnbrenner said that under this clause
the Galena concern refunded to the
Pennsylvania lines east of Pittsburg
about 44 per cent and on the Pittsburg,
Fort Wayne & Chicago line about 69g
cent on its purchases of lubricat-noil.
Mr. Kellogg had spread upon the
records a list of settlements with railroads for lubricating oil. The statements show the settlements made wi:h
about 80 railroads by the Galena company for lubricating oil for a period
Some railroads, Mr. Kel-loof years.
snld, did not have the refund provision in their oil contract.
Mr. Stelnbrenner said
the refund
made by the Galena company to the
Southern Pacific system in 1905 was 41
per cent of the gross invoice price, and
to the Baltimore & Ohio 23 per cent:
but there was no refund to the Southern Railroad or to the Delaware' &
Hudson Company.
