|Cheryl Perish – Chair |We’ve all heard the buzzwords.  On-line Access.  One-stop shopping.  E-recording.   The |

| |recording industry, much like others, is going through changes that help keep government |

|MCRA is proud to announce that Cheryl Perish is the Recorder of the Year for|communicating with its business partners.  There is new terminology also.  Technology |

|MCRA for 2007-2008, congratulations to Cheryl, again a fine example of the |Account, Compliance (Unallocated) Account, E-CRV,  E-Well,  PREP,  and GIS.   What is |

| |Very useful information was gathered through a survey conducted by Public Relations and |

|Changes in Well Certificate Fees and Information regarding |

|Well Disclosures |

|and Foreclosed Property |

|the following is an example of the information your office may choose to use for letters you will be sending out to your customers regarding both the Well Certificate |

|fee increase and Well Disclosure requirements on foreclosed properties. Thank you to Lynn Ette Schrupp, McCleod County Recorder, Lynn Ette compiled this information |

|for MCRA member reference. |

|Notice Re: Well Disclosure Certificates |

| |

|Per 2007 change to Minnesota Statute 103I.235 Sub 1 (I): |

|On July 1, 2008 the fee for a Well Disclosure Certificate will be $45.00. |

|This increase is due to an added surcharge by the State of Minnesota. For each Well Disclosure Certificate the county will forward $37.50 to the State of Minnesota and|

|the county will continue to retain $7.50. This fee will be required when any document is recorded on or after July 1, 2008 requiring a Well Disclosure Certificate. If |

|the real estate document that includes a Well Disclosure Certificate is rejected prior to July 1, 2008, corrected, and returned to us on or after July 1st it will |

|require the new fee. Please plan all closings accordingly. |

|Information from MDH regarding Well Disclosures on foreclosed property: |

|The Minnesota Department of Health is receiving an increasing number of inquiries from realtors, closing agents, and property buyers asking if the well disclosure |

|requirements are waived or the property is exempt from the requirements because the property being transferred is foreclosed property.  The Minnesota Association of |

|REALTORS®, local realtor associations, and county recorders are receiving similar inquiries.  For more information regarding Well Disclosure Certificates on foreclosed |

| |HF 3516, which included MN’s form of URPERA (Uniform Real Property |

| |Electronic Recording Act) was signed by the governor 4-25-08, effective|

| |7-1-08, and will switch the oversight of the development, |

| |implementation, and maintaining the standards of electronic recording |

| |in MN from the Electronic Real Estate Recording Task Force, chaired by |

| |the Office of the Secretary of State since 2001, to the Electronic Real|

| |Estate Recording Commission, to be administered by the Legislative |

| |Coordinating Commission. |
