DETERMINATION OF SALARIES AND ALLOWANCES OF MAGISTRATES
In terms of section 12(1) of the Magistrates Act, 1993 (Act No. 90 of 1993) (hereafter referred to as "the Act "), I hereby determine that the total remuneration of the positions of office bearers in Column 3 of Schedule 1 shall be as set out in Column 4 of Schedule 1 with effect from 01 April 2018, subject to the terms and conditions set out herein.
The total remuneration packages shall include the following elements:
2.1 A basic salary component equal to 70% of the total package, which constitutes the pensionable salary;
2.2 Pension benefit contribution to the applicable pension fund; and
2.3 A flexible portion for the remaining amount of the total remuneration.
2 Notice No. 1380 published in the Government Gazette No. 42107 of 13 December 2018, is hereby revoked.

APPLICATION
Any reference to "magistrates" in the notice, refers to all ranks of magistrates who have been permanently appointed in terms of section 9(1) if the Magistrates Court Act, 1994 (Act No. 32 of 1944), read with section 10 of the Magistrates Act, 1993 (Act No. 90 of 1993), including a magistrate serving his or her probationary period. The total remuneration package shall therefore not applicable to any magistrate who is not permanently appointed.
