GOAL: STUDENTS WILL LEARN HOW TO EFFICIENTLY RESEARCH A STATE ISSUE ON LEXIS ADVANCE, FIND RELEVANT SECONDARY SOURCES, CASE LAW, AND VALIDATE AUTHORITY WITH SHEPARD’S ® CITATION SERVICE. THIS KNOWLEDGE AND PRACTICE WILL APPLY TO FUTURE MEMO AND BRIEF ASSIGNMENTS.

NOTE:

a. This lesson plan assumes students have been introduced to and have a basic understanding of primary and secondary authority and binding vs. persuasive authority. This lesson plan is most effective after students become familiar with retrieving documents on Lexis Advance.

b. Each Lesson Plan contains four documents:

- Overview: This document is the Overview providing the Lesson Goals, Objectives, Contents, On-Demand training resources, and links to related lesson plan documents below.

-Teacher’s Guide: A detailed class outline including “Teacher Tips”.

-PowerPoint: Associated ppt with talking points and screen shots.

-Follow-up Exercises: Short exercises and questions to reinforce the lesson.

Objectives

1. KNOWLEDGE: AS A RESULT OF THIS CLASS STUDENTS WILL BE BETTER ABLE TO:

• Understand the components of a research plan

• Understand the value of consulting secondary sources first

• Understand how to refine search results

• Understand the importance of validating key authority

• Understand how to annotate and organize research electronically via folders

2. Skills: As a result of this class, students will be better able to:

• Generate search terms and develop a query

• Efficiently navigate and identify key secondary sources on Lexis Advance

• Efficiently refine case law results and locate the most relevant opinions

• Utilize Shepard’s to ensure relevant authority is still good law.

• Efficiently manage relevant research via electronic annotations and folders

Contents:

1. REVIEW RESEARCH PROCESS (SEE TEACHER’S GUIDE AND POWERPOINT)

2. Present Sample Assignment (see Teacher’s Guide and PowerPoint)

3. Develop a Research Plan

• What is the issue?

• What area of law does this issue address?

• What are the key search terms?

• What is the jurisdiction?

• What sources should we consult?

*review purpose and different types of secondary sources

4. Research the Issue on Lexis Advance (Live Demonstration or PPT)

• Refer to Teacher’s Guide outline

• Refer to accompanying PowerPoint if needed

5. Follow-up Exercises: Short 5 minute exercises for use in class or homework to reinforce how to locate and search secondary sources and case law, and how to manage research results.
